Speaker 2: (09:53)
All right. Is he still in the vehicle? Did you detain him or anything?

Officer Devin Brosnan: (09:57)

Rayshard Brooks: (12:08)
My wallet.

Officer Devin Brosnan: (12:09)
Yeah.

Rayshard Brooks: (12:11)
I said man, you know, I just had my wallet.

Officer Devin Brosnan: (12:12)
Right.

Rayshard Brooks: (12:13)
So yeah, I called my sister, she say, “Yeah, you had it.”

Officer Devin Brosnan: (12:16)
All right.

Rayshard Brooks: (12:16)
Why don’t you just put it in your sofa. I said, yeah, cool.

Officer Devin Brosnan: (12:18)
All right. Why don’t you just walk back to the car for me, all right? I keep asking you here. Where you’re coming from?

Rayshard Brooks: (12:23)
Actually, I just came from getting something to eat.

Officer Devin Brosnan: (12:26)
Okay.

Rayshard Brooks: (12:27)
From all over to the room.

Officer Devin Brosnan: (12:29)
Okay. Hey, why don’t you just get back in car for me? I hate to keep asking. I don’t want to…

Rayshard Brooks: (12:31)
I just want to make sure that everything’s good.

Officer Devin Brosnan: (12:36)
Yeah, you’re good, man. Why don’t you stay in the car for me? All right? I don’t want to keep asking you. Just sit in the car for me [inaudible 00:12:40] for a minute. Sir.

Rayshard Brooks: (12:44)
Oh, no problem. No problem.

Officer Devin Brosnan: (12:44)
Just sit in the car, man. All right? I hate to keep asking.

Rayshard Brooks: (12:47)
What’s your name, sir?

Officer Devin Brosnan: (12:47)
Brosnan.

Rayshard Brooks: (12:47)
Mr. Rosnan. Okay. All right. I apologize.

Officer Devin Brosnan: (12:52)
You’re good man, just stay in the car for me. Where were you coming from to get something to eat, you said.

Rayshard Brooks: (13:02)
Over on Jonesboro.

Officer Devin Brosnan: (13:04)
Jonesboro? Okay. So what are you doing here?

Rayshard Brooks: (13:07)
Something to eat.

Officer Devin Brosnan: (13:08)
Again? You just got something to eat again here?

Rayshard Brooks: (13:09)
Yeah.

Officer Devin Brosnan: (13:10)
Okay. Gotcha.

Rayshard Brooks: (13:11)
I was trying to see what she wanted, but like I said, she wasn’t answering and like, “Babe, what do you want to eat?” And she’s like, “I don’t know.”

Officer Devin Brosnan: (13:18)
Yeah. All right. Hey, just, why don’t you hop in the car, I mean, all right? Just relax in the car. What do you… You here for visit or what’s…

Rayshard Brooks: (13:29)
I’m visiting.

Officer Devin Brosnan: (13:30)
Where you visiting?

Rayshard Brooks: (13:31)
My mother’s gravesite.

Officer Devin Brosnan: (13:32)
Oh, I’m sorry to hear that.

Rayshard Brooks: (13:33)
Yeah.

Officer Devin Brosnan: (13:34)
How long has she passed for?

Rayshard Brooks: (13:37)
It’s been probably about a year and a half now, but…

Officer Devin Brosnan: (13:40)
Oh, okay. I’m sorry to hear that.

Rayshard Brooks: (13:41)
Her birthday’s just passed and my girlfriend’s birthday just passed, but I went to visit her and…

Officer Devin Brosnan: (13:48)
Yeah. All right.

Rayshard Brooks: (13:51)
We decided to eat Burger King tonight and hey, this happened.

Officer Devin Brosnan: (13:54)
I hear ya.

Rayshard Brooks: (13:54)
I said, “Babe, what’s going on?”

Officer Devin Brosnan: (13:59)
All right, so here’s we’re going to do. We’re going to talk to this officer here for a minute and then we’ll be good to go. Okay?

Rayshard Brooks: (14:02)
No problem.

Officer Devin Brosnan: (14:03)
All right. Thank you, sir. All right. Just stay in the car. Stay right there.

Rayshard Brooks: (14:06)
All right.

Officer Devin Brosnan: (14:08)
Hey, what’s going on?

Officer Garrett Rolfe: (14:09)
How’s it going?

Officer Devin Brosnan: (14:10)
So, found him passed out in the parking lot and he’s sitting here.

Officer Garrett Rolfe: (14:13)
So he was in the drive through.

Officer Devin Brosnan: (14:14)
Yeah. Car was on. Took me a few minutes to wake him up. Kept knocking, opened the door, shook him, woke up super groggy, got a pretty good smell of alcoholic beverage coming out of the car. Eyes are watery and glassy, slurring his words, wasn’t really sure where he was and he was telling me he had one drink, he said, earlier, standard size. He said, “I think just one drink,” but I can smell alcohol on him still. And was he was trying to tell me… I was, “Where you coming from?” He said “I’m coming from Jonesboro. I got food.” I said, “What are you doing here?” “Got more food.” So he’s really not too clear. Like, I got here, got there, but I mean, he’s slurring his words.

Officer Garrett Rolfe: (14:48)
So this was a 911 call, right?

Officer Devin Brosnan: (14:50)
Yeah. Yeah. The drive through called it in.

Officer Garrett Rolfe: (14:51)
So somebody called because he was in the drive through-

Officer Devin Brosnan: (14:53)
He just passed out in the car.

Officer Garrett Rolfe: (14:54)
Passed out in the drive through.

Officer Devin Brosnan: (14:55)
Yup. That’s where I found him.

Officer Garrett Rolfe: (14:56)
Okay. You just had him pull over.

Officer Devin Brosnan: (14:57)
Yeah, I had him move out of the way. And then when he pulled up, he actually hit over the curb onto the grass and like backed it up.

Officer Garrett Rolfe: (15:03)
Okay.

Officer Devin Brosnan: (15:03)
So if I leave him here he’s just going to drive again.

Officer Garrett Rolfe: (15:06)
Sure, absolutely. All right, let me go talk to him.

Officer Devin Brosnan: (15:07)
All right.

Officer Garrett Rolfe: (15:07)
Do you have his ID?

Officer Devin Brosnan: (15:12)
Yeah. Right there. This is a rental car. He said he’s visiting from Ohio.

Officer Garrett Rolfe: (15:15)
Hey, Mr. Brooks. Mr. Brooks?

Rayshard Brooks: (15:19)
Hey, how you doing?

Officer Garrett Rolfe: (15:19)
I’m Officer Rolfe with the Atlanta Police Department. How you doing?

Rayshard Brooks: (15:21)
I’m doing just fine.

Officer Garrett Rolfe: (15:22)
All right so, tell me. I wasn’t here. So can you tell me what happened before we got here?

Rayshard Brooks: (15:27)
Nothing happened. I just got here and was getting something to eat.

Officer Garrett Rolfe: (15:30)
Where were you coming from?

Rayshard Brooks: (15:32)
Well, my friend dropped me off here and she brought me here to get something to eat and…

Officer Garrett Rolfe: (15:38)
Your friend dropped you off where?

Rayshard Brooks: (15:40)
Here.

Officer Garrett Rolfe: (15:40)
At Wendy’s?

Rayshard Brooks: (15:41)
Yes.

Officer Garrett Rolfe: (15:42)
Okay. So…

Officer Garrett Rolfe: (15:45)
So where’s your friend now?

Rayshard Brooks: (15:47)
She’s at the hotel.

Officer Garrett Rolfe: (15:48)
What hotel?

Rayshard Brooks: (15:48)
Oh, right here, the Home Lodge.

Officer Garrett Rolfe: (15:52)
Where is that? What’s the address to it?

Rayshard Brooks: (15:54)
I’m not sure. I know she’s here at the Home Lodge.

Officer Garrett Rolfe: (16:00)
All right. So how did she drop you off here?

Rayshard Brooks: (16:03)
She drove here and dropped me off.

Officer Garrett Rolfe: (16:05)
In what car?

Rayshard Brooks: (16:07)
In a black Volvo. actually.

Officer Garrett Rolfe: (16:09)
Okay. So how did this car get here?

Rayshard Brooks: (16:12)
I mean, it was here before I came, like, this is my car. It’s a rental car. My sister… But I mean, like I told her, I came here. I met her here.

Officer Garrett Rolfe: (16:23)
Okay.

Rayshard Brooks: (16:23)
From the beginning. And she picked me up and we went out.

Officer Garrett Rolfe: (16:28)
So you met her here at the Wendy’s?

Rayshard Brooks: (16:29)
Yes.

Officer Garrett Rolfe: (16:30)
And then you went out with her.

Rayshard Brooks: (16:31)
Yes. And she came back here.

Officer Garrett Rolfe: (16:32)
And then she came and dropped her off.

Rayshard Brooks: (16:33)
And you know, I mean, like I told her, I say, “Hey, babe, I just want a burger or I want fries.” She said, “Hey, no problem. I’ll take you there. You get your fries and you come back to the hotel.”

Officer Garrett Rolfe: (16:46)
Okay.

Rayshard Brooks: (16:46)
No problem.

Officer Garrett Rolfe: (16:48)
So the reason why we’re here is because somebody called 911, because you were asleep behind the wheel while you were in the drive through, right? Do you recall that?

Rayshard Brooks: (16:58)
I don’t. I don’t.

Officer Garrett Rolfe: (17:00)
You don’t recall that? You don’t recall just minutes ago where you were passed out behind the wheel in the drive through?

Rayshard Brooks: (17:04)
Uh-uh (negative).

Officer Garrett Rolfe: (17:05)
You don’t recall that at all?

Rayshard Brooks: (17:07)
Absolutely, I don’t.

Officer Garrett Rolfe: (17:07)
Just a complete blur.

Rayshard Brooks: (17:08)
I wasn’t driving. Like I said, I just [inaudible 00:17:11] my girlfriend, she probably was sleeping, but like I said, I said, “Babe, I want french fries-”

Officer Garrett Rolfe: (17:18)
So far as I’m aware, you’re the only person that’s been seen in this vehicle. Right?

Officer Devin Brosnan: (17:21)
Yeah. The only person.

Officer Garrett Rolfe: (17:23)
And you’ve been in the driver’s seat the whole time. So how did the car get into the drive through line with you behind the wheel?

Rayshard Brooks: (17:32)
She drove here. I said, “Babe, I’m drinking…”

Officer Garrett Rolfe: (17:35)
In a black car.

Rayshard Brooks: (17:36)
In a black Volvo.

Officer Garrett Rolfe: (17:38)
And you got into your car.

Rayshard Brooks: (17:39)
I said, “Hey, you know what? No problem. I’ll just meet you at the hotel.” And then she said, “Then get out and-”

Officer Garrett Rolfe: (17:45)
Hold on, hold on. So after she drops you off here, in her black car, your car was parked where?

Rayshard Brooks: (17:51)
Here.

Officer Garrett Rolfe: (17:51)
Okay. So how did your car get from here to the drive through line?

Rayshard Brooks: (17:57)
I never moved.

Officer Garrett Rolfe: (17:59)
So how did it get there?

Rayshard Brooks: (18:00)
It never did get there. I told you I was in her car.

Officer Garrett Rolfe: (18:04)
Well, we’ve got a 911 call of people reporting a guy passed out behind the wheel in the line. This officer gets here and sees you. Everything’s on camera, sees you, in the line here.

Rayshard Brooks: (18:15)
Sees me here in line, but I wasn’t in the line. Did I pull you over in the line?

Officer Devin Brosnan: (18:20)
I walked up, had to wake you up, man.

Officer Garrett Rolfe: (18:22)
You didn’t pull him over.

Rayshard Brooks: (18:22)
Right here?

Officer Devin Brosnan: (18:23)
No, over there. I had to wake you up.

Rayshard Brooks: (18:27)
Well, look…

Officer Devin Brosnan: (18:29)
Then you went back to sleep and I had to wake you up again.

Rayshard Brooks: (18:32)
Like I said, I’m sorry if I… Hey, I just got something to eat. I went to visit my mother grave site. I’m not causing any problems.

Officer Garrett Rolfe: (18:45)
Well, we got to make sure that you’re safe to operate a vehicle now, do you know where you are?

Rayshard Brooks: (18:48)
Yeah, absolutely. I’m in Forest Park, Old Dixie Highway.

Officer Garrett Rolfe: (18:51)
Old Dixie Highway in Forest Park?

Rayshard Brooks: (18:52)
The Home Lodge is there, right here, Subway.

Officer Garrett Rolfe: (18:54)
Right… No Subway, man.

Rayshard Brooks: (18:58)
It’s a Subway right here. I’m cool. Like I said, I could have…

Officer Garrett Rolfe: (19:02)
So you think that you’re in Forest Park right now?

Rayshard Brooks: (19:04)
I’m on Old Dixie Highway, Clayton County.

Officer Garrett Rolfe: (19:07)
Right. No, you’re not.

Rayshard Brooks: (19:09)
Well, Forest Park, Georgia.

Officer Garrett Rolfe: (19:10)
Nope.

Rayshard Brooks: (19:12)
Jonesboro, Georgia.

Officer Garrett Rolfe: (19:13)
Nope. Try again?

Rayshard Brooks: (19:17)
I have to… I mean, like I said, I’m on Old Dixie Highway.

Officer Garrett Rolfe: (19:20)
Nope.

Rayshard Brooks: (19:21)
I’m not on Old Dixie Highway?

Officer Garrett Rolfe: (19:23)
Nope. Quite a ways away from it.

Rayshard Brooks: (19:26)
Huh? This is… A bridge is here.

Officer Garrett Rolfe: (19:32)
Nope. No bridge.

Rayshard Brooks: (19:34)
No, I’m saying, Old Dixie Highway.

Officer Garrett Rolfe: (19:35)
You’re not near Old Dixie Highway.

Rayshard Brooks: (19:38)
I’m not on…

Officer Garrett Rolfe: (19:39)
You’re not even in Clayton County.

Rayshard Brooks: (19:42)
Where am I?

Officer Garrett Rolfe: (19:42)
You’re in Atlanta.

Rayshard Brooks: (19:44)
Yes. Old Dixie Highway.

Officer Garrett Rolfe: (19:46)
Old Dixie Highway is not in Atlanta.

Rayshard Brooks: (19:49)
This Forest Park, Georgia. Right?

Officer Garrett Rolfe: (19:51)
Right. This isn’t Forest Park. This is Atlanta.

Rayshard Brooks: (19:53)
I mean-

Officer Garrett Rolfe: (19:56)
Anyway, how much have you had to drink today?

Rayshard Brooks: (19:58)
I drunk earlier.

Officer Garrett Rolfe: (19:59)
Okay. How much have you had to drink?

Rayshard Brooks: (20:01)
That’s when… I had one drink.

Officer Garrett Rolfe: (20:04)
Aw, you’re not being honest with me. How much did you have to drink?

Rayshard Brooks: (20:06)
I had one drink.

Officer Garrett Rolfe: (20:06)
Be honest with me. Over the course of the entire evening, from the time you started drinking until your very last drink, how many drinks did you consume?

Rayshard Brooks: (20:14)
I had one drink.

Officer Garrett Rolfe: (20:15)
What kind of drink was it?

Rayshard Brooks: (20:15)
A margarita.

Officer Garrett Rolfe: (20:17)
Okay. How big was the margarita?

Rayshard Brooks: (20:18)
It was those small cups.

Officer Garrett Rolfe: (20:20)
Small cup.

Rayshard Brooks: (20:21)
Yes, sir.

Officer Garrett Rolfe: (20:21)
Have you taken any medication today?

Rayshard Brooks: (20:22)
No sir.

Officer Garrett Rolfe: (20:23)
Any drugs of any kind-

Rayshard Brooks: (20:24)
No sir.

Officer Garrett Rolfe: (20:24)
Marijuana, cocaine, nothing like that?

Rayshard Brooks: (20:26)
No, sir.

Officer Garrett Rolfe: (20:26)
Do you have any medical conditions, physical… Hold on, let me finish. You have any medical conditions, physical defects or injuries that would affect your ability to walk, balance-

Rayshard Brooks: (20:34)
No sir, I’m cool.

Officer Garrett Rolfe: (20:35)
Or operate a vehicle safely?

Rayshard Brooks: (20:36)
I’m okay.

Officer Garrett Rolfe: (20:37)
Nothing whatsoever?

Rayshard Brooks: (20:38)
No, sir.

Officer Garrett Rolfe: (20:38)
No issues I need to know about.

Rayshard Brooks: (20:39)
No, sir.

Officer Garrett Rolfe: (20:40)
All right. Can you take your hat off for me? Just leave it in your car for me. You can just leave it in your car. Can you step out with me, please?

Rayshard Brooks: (20:48)
Yes, sir.

Officer Garrett Rolfe: (20:50)
Let’s walk back here. Do you have any weapons on you or anything like that?

Rayshard Brooks: (20:52)
I don’t have anything on me.

Officer Garrett Rolfe: (20:53)
Is it okay if I pat you down, just make sure?

Rayshard Brooks: (20:55)
If you… I have just money, gas and that was it.

Officer Garrett Rolfe: (21:00)
Is it okay if I pat you down and make sure you don’t have any weapons?

Rayshard Brooks: (21:02)
Absolutely. You’re fine.

Officer Garrett Rolfe: (21:03)
Turn around, face away from me real quick? What is this? Is this just a bunch of money in your pocket?

Rayshard Brooks: (21:11)
That’s just my wallet.

Officer Garrett Rolfe: (21:13)
What’s all this?

Rayshard Brooks: (21:13)
It’s just money.

Officer Garrett Rolfe: (21:16)
Why do you have… How much money do you have in your pocket?

Rayshard Brooks: (21:21)
I mean, maybe, a couple hundred bucks.

Officer Garrett Rolfe: (21:23)
Okay. Like a bunch of ones and stuff? Here.

Rayshard Brooks: (21:24)
Yeah, absolutely.

Officer Garrett Rolfe: (21:25)
Walk over here with me, please.

Rayshard Brooks: (21:26)
This is Wendy’s.

Officer Garrett Rolfe: (21:29)
Yes, this is Wendy’s.

Rayshard Brooks: (21:31)
I do remember.

Officer Garrett Rolfe: (21:33)
You can see the sign, right?

Rayshard Brooks: (21:34)
Absolutely.

Officer Garrett Rolfe: (21:34)
All right.

Rayshard Brooks: (21:35)
I just came to get something to eat.

Officer Garrett Rolfe: (21:37)
You mind just putting your phone on the trunk of your car? I don’t want you to have anything in your hands.

Rayshard Brooks: (21:39)
All right.

Officer Garrett Rolfe: (21:43)
All right. So no medical conditions, no injuries-

Rayshard Brooks: (21:44)
No sir.

Officer Garrett Rolfe: (21:45)
No physical defects?

Rayshard Brooks: (21:46)
No sir.

Officer Garrett Rolfe: (21:46)
Are you comfortable walking in these shoes?

Rayshard Brooks: (21:48)
Absolutely. Well, they’re brand new. I just bought them.

Officer Garrett Rolfe: (21:51)
Can you walk in them without falling, stumbling, anything like that? Staggering? You walk in them okay?

Rayshard Brooks: (21:58)
I just bought them.

Officer Garrett Rolfe: (22:00)
Can you walk in them okay?

Rayshard Brooks: (22:01)
Maybe.

Officer Garrett Rolfe: (22:01)
You don’t have to show me. Are you comfortable walking in the shoes?

Rayshard Brooks: (22:08)
They are comfortable, but-

Officer Garrett Rolfe: (22:10)
I’d just like to do some field sobriety tests. And if you’d like, if you’d prefer, you can keep them on. If you’re more comfortable, then you can take them off.

Rayshard Brooks: (22:17)
Like I said, I hadn’t been operating this vehicle.

Officer Garrett Rolfe: (22:20)
Yeah, you have. All right? So.

Rayshard Brooks: (22:22)
So, she came here. I got in the car. She parked. I have no problem. Like I said, I was just trying to get me something to eat.

Officer Garrett Rolfe: (22:30)
Okay.

Rayshard Brooks: (22:31)
And go back to my hotel.

Officer Garrett Rolfe: (22:33)
All right. Well, we had a police officer that actually personally witnessed you operating the vehicle. So, we know you’re operating the vehicle. All right? But, are you comfortable walking in these shoes?

Rayshard Brooks: (22:41)
Absolutely, sir.

Officer Garrett Rolfe: (22:42)
All right. Will you do some field sobriety tests for me so I can make sure you’re safe to operate the vehicle?

Rayshard Brooks: (22:47)
What should I do, sir?

Officer Garrett Rolfe: (22:49)
Well, first off, I just want to know you’re comfortable to walk in your shoes. You don’t have to do all that. Just say yes or no. Can you walk in the shoes-

Rayshard Brooks: (22:57)
Yes, sir.

Officer Garrett Rolfe: (22:58)
All right. Okay. Very good. All right. Just turn and face me. Turn and put your feet together with your hands down by your side. All right. Can you see the tip of my finger?

Rayshard Brooks: (23:00)
Yes, sir.

Officer Garrett Rolfe: (23:00)
All right. I want you to focus on the tip of my finger and follow it with your eyes without moving your head. Do you understand?

Rayshard Brooks: (23:00)
Yes, sir.

Officer Garrett Rolfe: (23:00)
All right. Don’t move your head. Keep your head still. Follow it with just your eyes. Do you understand me? Do you understand?

Rayshard Brooks: (23:00)
Yes, sir.

Officer Garrett Rolfe: (23:00)
All right. Very good.

Officer Garrett Rolfe: (23:00)
I’m going to go down and up. Stay focused on the tip of my finger. Follow it with just your eyes without moving your head.

Officer Garrett Rolfe: (23:00)
All right. Back up a little bit. Can you stand where my light is? I want you to stand with your feet together, hands down by your side. Don’t start anything until I tell you to. Do you understand?

Rayshard Brooks: (25:28)
Yes, sir.

Officer Garrett Rolfe: (25:28)
I want you to imagine a straight line coming out from your left foot. Take your right food, put it heel to toe in front of your left, just like this. Keep your hands by your side. Hold that position until I tell you to start. Don’t begin until I tell you to. Do you understand? You’re going to take a series of nine heel-to-toe steps counting them out loud. One, two, three. I took three steps. You’re going to go all the way to nine. When you get to nine, keep your lead foot planted. Take a series of small steps to turn yourself around. Take nine more heel-to-toe steps. One, two, three. All the way until nine. All right?

Officer Garrett Rolfe: (26:01)
During the test, look down at your feet. Count your steps out loud so that I can hear them. Keep your hands by your side, and don’t stop walking until you’ve cleared the test. Do you understand?

Rayshard Brooks: (26:08)
Yes. Absolutely.

Officer Garrett Rolfe: (26:09)
Do you have any questions about how to perform the test?

Rayshard Brooks: (26:12)
No, sir.

Officer Garrett Rolfe: (26:13)
All right. Here. Get back in the starting position. Put your right foot heel to toe in front of your left. Right foot heel to toe in front of your left. No, your right foot heel to toe in front of your left. There you go.

Rayshard Brooks: (26:19)
That’s how I was at first.

Officer Garrett Rolfe: (26:22)
Well, it was kind of off. All right? So-

Rayshard Brooks: (26:24)
These shoes are kind of long.

Officer Garrett Rolfe: (26:27)
All right. Are you comfortable performing the test in those shoes?

Rayshard Brooks: (26:30)
Yes, sir.

Officer Garrett Rolfe: (26:30)
If you want, you have the option to take them off. You want to leave them on?

Rayshard Brooks: (26:31)
Can I take them off?

Officer Garrett Rolfe: (26:37)
It’s up to you.

Rayshard Brooks: (26:37)
They’re brand new.

Officer Garrett Rolfe: (26:39)
It’s up to you. You can take them, or you can leave them, or you can take them off. Whatever you’re most comfortable with.

Rayshard Brooks: (26:44)
I’m not sure. They’re brand new.

Officer Garrett Rolfe: (26:49)
I’m not sure. I can’t help-

Rayshard Brooks: (26:49)
They’re brand new, sir. I just put them on.

Officer Garrett Rolfe: (26:51)
Okay. But-

Rayshard Brooks: (26:51)
I haven’t even drove in them or anything. But-

Officer Garrett Rolfe: (26:54)
It’s up to you. What do you want? All right. Do you want to do it with them on?

Rayshard Brooks: (26:56)
Yes.

Officer Garrett Rolfe: (26:57)
All right. If you understand all the instructions, you have no questions, go ahead and begin whenever you’re ready.

Rayshard Brooks: (27:01)
You said … Repeat that again for me, for the sobriety.

Officer Garrett Rolfe: (27:06)
You want me to demonstrate it again?

Rayshard Brooks: (27:07)
Yes, sir.

Officer Garrett Rolfe: (27:08)
All right. Hold that position. Don’t begin until I tell you to. Watch me while I demonstrate, okay? Keep your hands by your side. You’re going to take a series of nine heel-to-toe steps counting them out loud. One, two, three. I took three steps. You’re going all the way to nine. When you get to nine, keep your lead foot planted, take a series of small steps to turn yourself around, take nine heel-to-toe steps. One, two, three. All the way until nine. While you’re doing that, look down at your feet, keep your hands by your side, count your steps out loud so that I can hear them, and don’t stop walking until you’ve completed the test. You understand?

Rayshard Brooks: (27:42)
Start with my-

Officer Garrett Rolfe: (27:44)
You’re going to start in the starting position with your right foot heel to toe in front of your left. All right? Do you have any questions about how to perform the test?

Rayshard Brooks: (27:50)
No, sir.

Officer Garrett Rolfe: (27:51)
All right. If you understand all of the questions, go ahead and begin whenever you’re ready.

Rayshard Brooks: (28:06)
One, two, three, four, turn around. Nine? One, two, three, four, five, six, seven, eight, nine. [crosstalk 00:28:37]

Officer Garrett Rolfe: (28:36)
We’re busy. They’re going to have to call.

Rayshard Brooks: (28:36)
All right. I’m-

Officer Garrett Rolfe: (28:37)
Can you stand right there? Face my target. Put your feet together, hands down by your side. Don’t start anything until I tell you to. You’re going to pick whichever foot you’re most comfortable with, raise that foot approximately six inches above the ground, keeping both legs straight and your foot parallel to the ground, look at your toe, and count out loud 1001, 1002, 1003. So on and so on until I tell you to stop.

Officer Garrett Rolfe: (28:56)
While you’re doing that, keep your hands by your side, focus on your toe, and count out loud as I instructed. Do you understand?

Rayshard Brooks: (29:01)
Yes, sir.

Officer Garrett Rolfe: (29:02)
All right. Do you have any questions about how to perform the test?

Rayshard Brooks: (29:04)
Feet up, count out loud 1001, 1002, 1003, 1004, 1005, until you stop.

Officer Garrett Rolfe: (29:17)
Correct. All right. Do you have any questions about anything I demonstrated, or how to perform the test?

Rayshard Brooks: (29:20)
No, sir.

Officer Garrett Rolfe: (29:20)
All right. If you understand all the instructions clearly, go ahead and bring whenever you’re ready.

Rayshard Brooks: (29:24)
1001, 1002, 1003, 1004, 1005, 1006, 1007, 1008, 1009, 1010, 1011, 1012, 1013, 1014, 1015.

Officer Garrett Rolfe: (29:54)
Pick it up, keep going.

Rayshard Brooks: (29:56)
1016, 1017.

Officer Garrett Rolfe: (29:56)
All right. You can stop. [crosstalk 00:30:03] All right. On a scale from one to 10 with one being completely sober and 10 being very impaired, how do you feel right now?

Rayshard Brooks: (30:15)
I feel kind of good, sir. I’m acknowledgeable of everything that’s going on and, like I said, if I just came to get something to eat and I have people that verified, they made their order. I’m here right at the hotel Home Lodge Inn. It’s probably about maybe two minutes away from here.

Officer Garrett Rolfe: (30:44)
Did you understand what I asked? Did you understand the question?

Rayshard Brooks: (30:46)
Repeat it again for me.

Officer Garrett Rolfe: (30:50)
On a scale from one to 10 with one being completely sober and 10 being very impaired, how do you feel?

Rayshard Brooks: (30:56)
10. I’m very impaired.

Officer Garrett Rolfe: (30:56)
You feel very impaired?

Rayshard Brooks: (31:00)
Absolutely. I’m okay. I can do whatever. Like I said, I can make it happen, sir.

Officer Garrett Rolfe: (31:08)
I don’t think that means what you think it means. So, one being completely sober, haven’t drank anything, and 10 being hammered drunk, how do you feel? On a scale from one to 10.

Rayshard Brooks: (31:18)
I’m one.

Officer Garrett Rolfe: (31:18)
You feel completely sober.

Rayshard Brooks: (31:22)
Like I said, I just woke up.

Officer Garrett Rolfe: (31:23)
You don’t feel the effects of the alcohol that you had whatsoever.

Rayshard Brooks: (31:26)
Absolutely not. I can make it wherever I need to be. I’m right here. Like I said, I’m Home Lodge, sir.

Officer Garrett Rolfe: (31:35)
Home Lodge isn’t close to here.

Rayshard Brooks: (31:36)
It’s right behind, Home Lodge right here, ain’t it?

Officer Garrett Rolfe: (31:39)
Where do you think you are right now?

Rayshard Brooks: (31:40)
I’m on Old Dixie Highway.

Officer Garrett Rolfe: (31:42)
You’re not on Old Dixie Highway.

Rayshard Brooks: (31:43)
Well, I’m not on Old Dixie Highway.

Officer Garrett Rolfe: (31:44)
What city do you think you’re in?

Rayshard Brooks: (31:54)
She brought me here saying that I was on Jonesboro.

Officer Garrett Rolfe: (31:56)
So what city are you in?

Rayshard Brooks: (31:59)
Atlanta.

Officer Garrett Rolfe: (31:59)
Atlanta.

Rayshard Brooks: (31:59)
Yeah. Yes, sir.

Officer Garrett Rolfe: (32:00)
On what road?

Rayshard Brooks: (32:02)
McDonald Boulevard.

Officer Garrett Rolfe: (32:08)
No. So, let’s go back. How much have you had to drink?

Rayshard Brooks: (32:12)
She was drinking. Like I said, she brought me here.

Officer Garrett Rolfe: (32:14)
I don’t know who she is. I don’t care who she is. I said, how much have you been drinking?

Rayshard Brooks: (32:18)
Just a couple. That’s what I had. I had one and a half. That was it.

Officer Garrett Rolfe: (32:22)
So, is it a couple, or is it one, or is it one and a half?

Rayshard Brooks: (32:27)
When I got to the house, I put it away. I said, “Babe, let’s go. I feel I need to make it home” [inaudible 00:32:33]

Officer Garrett Rolfe: (32:33)
So one and a half drinks.

Rayshard Brooks: (32:34)
Yes, sir.

Officer Garrett Rolfe: (32:35)
All right. Of what?

Rayshard Brooks: (32:37)
It was just a daiquiri.

Officer Garrett Rolfe: (32:38)
A daiquiri.

Rayshard Brooks: (32:38)
Yes.

Officer Garrett Rolfe: (32:39)
One and a half daiquiris.

Rayshard Brooks: (32:40)
Yes. Absolutely. It was just a daiquiri. But-

Officer Garrett Rolfe: (32:45)
Nothing else.

Rayshard Brooks: (32:45)
Nothing else.

Officer Garrett Rolfe: (32:46)
Only a daiquiri.

Rayshard Brooks: (32:47)
Only.

Officer Garrett Rolfe: (32:47)
You haven’t had a margarita or anything?

Rayshard Brooks: (32:51)
No, no, no. It was just like the little daiquiri thing. Like I said, if I, I-

Rayshard Brooks: (33:00)
If I caused any … I never intend to bring anybody any problems. I just wanted me a burger.

Officer Garrett Rolfe: (33:10)
But no margaritas at all today?

Rayshard Brooks: (33:13)
No, no. Just a daiquiri.

Officer Garrett Rolfe: (33:13)
Just a daiquiri?

Rayshard Brooks: (33:17)
Yes.

Officer Garrett Rolfe: (33:17)
All right. [inaudible 00:33:17] And you haven’t drove your vehicle at all?

Rayshard Brooks: (33:25)
You say you caught me in the-

Officer Devin Brosnan: (33:27)
Right there. Right there. I woke you up and then I said, “You need to move the car.” And then you said, “Okay.” Then you went back to sleep. Then I opened your door again, I had to shake you and you woke up and then I asked you to move your car over there.

Rayshard Brooks: (33:40)
That’s the BP by the Marathon, Jonesboro Road. This is University Avenue.

Officer Garrett Rolfe: (33:50)
Yes. Very good.

Rayshard Brooks: (33:51)
This is University Avenue. I growed up here. [inaudible 00:33:51] She’s my girlfriend. She left off. I said, “Babe, I’m going to get Wendy’s and I’m going to go back to where-

Officer Garrett Rolfe: (33:59)
What I asked you was, have you drove that vehicle?

Rayshard Brooks: (34:04)
Probably from the point of the drive-thru to here to park.

Officer Garrett Rolfe: (34:10)
Okay. How did it get into the drive through?

Rayshard Brooks: (34:14)
She pulled out. I pulled out from here where this red car was. I remember this red car pulling out-

Officer Garrett Rolfe: (34:20)
It got into the drive-thru because you drove it into the drive through, correct?

Rayshard Brooks: (34:26)
If you caught me in the drive-thru, then … I didn’t drive here.

Officer Garrett Rolfe: (34:32)
My question is, your vehicle got into the drive-thru because you drove it there, right?

Rayshard Brooks: (34:37)
I backed out and drove … Baby, baby. I need burgers. She said, “Okay, fine. I’m going home.” No problem.

Officer Garrett Rolfe: (34:46)
Just so I understand what happened clearly. Your vehicle was in a parking spot. Your girlfriend dropped you off, you got into your vehicle, you backed it out, and you pulled it into the drive-thru. Correct?

Rayshard Brooks: (34:57)
Yes sir Mr. Rolfe.

Officer Garrett Rolfe: (34:59)
Then what led to you falling asleep behind the wheel?

Rayshard Brooks: (35:04)
I drank … I was on the phone call with her. She didn’t answer. She didn’t answer. She didn’t answer. I said, “Baby.” Last time I asked her. I said, “Baby, I’m getting burgers. What’s going on?” She said, “You’re supposed to go burgers. Go ahead and get burgers.” The phone went dead.

Rayshard Brooks: (35:26)
I said, “Well, you ain’t know your order. You know, whatever the case may be. Just let me know.” And the phone went there. Like I said, I can call her now [inaudible 00:35:38] She stays right down the road. I have a parking spot right down the street here. Like I said, if I caused any problems or anything-

Officer Garrett Rolfe: (35:49)
Hold on. Did you understand the question that I asked you?

Rayshard Brooks: (35:51)
Yes.

Officer Garrett Rolfe: (35:52)
What did I ask?

Rayshard Brooks: (35:52)
You said how did my car get from the driver’s spot to the drive-thru.

Officer Garrett Rolfe: (36:01)
That was the previous question, we answered that question. My next question was what led to you falling asleep behind the wheel? Why did you fall asleep behind the wheel?

Rayshard Brooks: (36:10)
I fell asleep because … I can’t blame nothing on her. It was my decision. I said, “Hey, if she can’t get her order together and I’m not feeling of tight right now, I’ll just park right here, go to sleep.” I’m just not feeling right.

Officer Garrett Rolfe: (36:34)
What do you mean you’re not feeling right?

Rayshard Brooks: (36:36)
She … Like I said-

Officer Garrett Rolfe: (36:39)
Do you think maybe that you had too much to drink and you realize that you shouldn’t drive so you parked?

Rayshard Brooks: (36:46)
I mean-

Officer Garrett Rolfe: (36:47)
Would that be accurate to say?

Rayshard Brooks: (36:51)
Yes sir, Mr. Rolfe. Yes.

Officer Garrett Rolfe: (36:53)
All right. So your girlfriend dropped you off, you got into the car, you backed out, [crosstalk 00:36:56], and you’re like, “Damn, I’m too drunk to drive.” And so you pulled back into the parking spot and parked, right?

Rayshard Brooks: (37:01)
I called her like, “Babe.”

Officer Garrett Rolfe: (37:03)
Is that accurate?

Rayshard Brooks: (37:05)
It’s a couple moments I got on the phone with her. I’m like, “Babe, hey. Damn. You want a number one, a number two, or …” She’s like, “Babe.”

Officer Garrett Rolfe: (37:17)
Would you agree-

Rayshard Brooks: (37:18)
You take care that you’re a man, you figure out what we’re going to eat tonight.

Officer Garrett Rolfe: (37:23)
Let’s move past that. Would you agree that you’ve had too much to drink to drive?

Rayshard Brooks: (37:27)
I could focus, Mr. Rolfe. I can focus.

Officer Garrett Rolfe: (37:30)
Would you agree that you had too much to drink to drive?

Rayshard Brooks: (37:32)
I haven’t had … to the point where I can’t focus. I was a little tired [inaudible 00:37:40] day because we just came from North Carolina.

Officer Garrett Rolfe: (37:42)
Do you think that you’re safe to operate a vehicle right now?

Rayshard Brooks: (37:43)
Absolutely Mr. Rolfe.

Officer Garrett Rolfe: (37:44)
And how much have you had to drink?

Rayshard Brooks: (37:46)
I had one and a half margaritas, Mr. Rolfe.

Officer Garrett Rolfe: (37:49)
One and a half margarita?

Rayshard Brooks: (37:50)
Yes, sir.

Officer Garrett Rolfe: (37:50)
Margaritas?

Rayshard Brooks: (37:51)
Yes.

Officer Garrett Rolfe: (37:51)
Have you had anything else today? Any other type of drink?

Rayshard Brooks: (37:54)
No sir.

Officer Garrett Rolfe: (37:54)
You haven’t had any daiquiris?

Rayshard Brooks: (37:55)
I haven’t had no daiquiri. I had one and a half little small cups of margarita. But I can … Y’all got me up with this.

Officer Garrett Rolfe: (38:05)
Got you up?

Rayshard Brooks: (38:07)
I’m going … No.

Officer Garrett Rolfe: (38:09)
Hey, will you take a preliminary breath test for me.

Rayshard Brooks: (38:12)
What’s that?

Officer Garrett Rolfe: (38:13)
It’s a little handheld machine. I have you blow into it and it lets me know if you’re positive or negative for the presence of alcohol in your breath.

Rayshard Brooks: (38:20)
I’ve been drinking. I do say it. But I’m only going a few minutes down the road, Mr. Rolfe.

Officer Garrett Rolfe: (38:30)
I got you. I’m just asking will you take a preliminary breath test for me?

Rayshard Brooks: (38:32)
I don’t know what it is.

Officer Garrett Rolfe: (38:35)
I just said it’s a little hand held machine. It lets me know if it’s positive or negative for the presence of alcohol. It’s part of my investigation.

Rayshard Brooks: (38:42)
You know it’s the presence.

Officer Garrett Rolfe: (38:43)
I know.

Rayshard Brooks: (38:44)
I’ve been drinking.

Officer Garrett Rolfe: (38:44)
I know. I can tell. That’s just part of my investigation-

Rayshard Brooks: (38:48)
But like I said-

Officer Garrett Rolfe: (38:49)
… Listen. listen-

Rayshard Brooks: (38:50)
… If I have to park this car right here right now and walk-

Officer Garrett Rolfe: (38:53)
… It’s just a yes or no. We don’t need to go back and forth about it. It’s just a yes or no.

Rayshard Brooks: (38:57)
But what if I take this test and … I don’t care about … I can walk home.

Officer Garrett Rolfe: (39:04)
Why would you-

Rayshard Brooks: (39:04)
I don’t have to park … My car’s legit.

Officer Garrett Rolfe: (39:07)
Why would you walk home?

Rayshard Brooks: (39:09)
I just don’t want to be in violation of anybody. I can walk. My sister’s house is right here.

Officer Garrett Rolfe: (39:14)
Do you think you’d be in violation of something if you were to drive your vehicle?

Rayshard Brooks: (39:18)
If that’s less possible for me to park here, lock the car up, and do everything that I need to do within the presence of you guys, I can just go home. I have my daughters there right now. My daughter’s birthday was yesterday.

Officer Garrett Rolfe: (39:37)
All right, hold up Mr. Brooks. Will you take a preliminary breath test for me? It’s a yes or no.

Rayshard Brooks: (39:39)
I don’t want to refuse anything.

Officer Garrett Rolfe: (39:43)
It’s yes or no. It’s completely up to you.

Rayshard Brooks: (39:44)
Yes, I will.

Officer Garrett Rolfe: (39:44)
Okay. Just wait here while I grab it.

Rayshard Brooks: (39:59)
Oh, man.

Officer Devin Brosnan: (40:00)
What’s up? Just trying to make sure man, you’re safe to drive.

Rayshard Brooks: (40:04)
I know, man. I just …

Officer Devin Brosnan: (40:06)
You scared me a little bit because you were sleeping in there. That’s why we’re just making sure you’re okay.

Rayshard Brooks: (40:12)
I know. You’re just doing your job.

Officer Garrett Rolfe: (40:17)
All right. Just take a deep breath in, put your mouth over the mouth piece, blow as hard as you can until I tell you to stop. Blow, blow, blow, blow, blow, blow, blow, blow, blow, blow, stop. Very good.

Rayshard Brooks: (40:26)
I just had a few drinks. That’s it.

Officer Garrett Rolfe: (40:27)
How many?

Rayshard Brooks: (40:28)
One and a half like I said. I was into the second cup. I wasn’t even … I told her, “Babe, let’s go.” Because I’m hungry. I need to eat.

Officer Garrett Rolfe: (40:36)
What kind of drinks did you have?

Rayshard Brooks: (40:38)
I’m not sure. It’s something she ordered. She said top shelf or whatever.

Officer Garrett Rolfe: (40:41)
Top shelf what?

Rayshard Brooks: (40:43)
I’m not sure. Like I said, it was her birthday and … It was my daughter’s birthday intent to have a good time and I said, “Babe, I’m hungry. Let’s go.” My baby’s mom, she was there. I said, “Babe, go ahead. I’m cool. Here’s the money for the blow up bed tomorrow. Here’s the money to enjoy herself tomorrow.” Even a burger or something. Just take me home, I’m ready to go.

Officer Garrett Rolfe: (41:18)
You had about one and a half drinks but you don’t remember what kind of drinks it was?

Rayshard Brooks: (41:21)
No, sir. I really don’t Mr. Rolfe.

Officer Garrett Rolfe: (41:23)
All right. I think you’ve had too much to drink to be driving. Put your hands behind your back for me. Put your hands behind your back. Hey, hey! Stop fighting. Stop fighting. Stop fighting. Stop fighting. You’re going to get tased. You’re going to get tased!

Rayshard Brooks: (41:39)
Stop, Mr. Rolfe. Stop.

Officer Garrett Rolfe: (41:42)
Stop! You’re going to get tased.

Rayshard Brooks: (41:44)
Mr Rolfe.

Officer Garrett Rolfe: (41:45)
Hey! Hands off the f***ing taser!

Rayshard Brooks: (42:01)
Stop! Stop!

Officer Garrett Rolfe: (42:01)
Hands off the taser! [inaudible 00:42:01] Stop fighting! He got my f***ing taser. 63. [inaudible 00:09:12].

(Rayshard Brooks grabs an officer’s taser, runs away with it, then gunshots are fired by the police)

Speaker 5: (42:11)
Come on, man.

Speaker 6: (42:12)
Come on! What the f***? [inaudible 00:42:12] you f***ing shoot him? What the f***? Come on! What the f***? That’s totally unnecessary.

Speaker 5: (42:12)
Man, that’s messed up, man.

Speaker 6: (42:12)
Why would you think that’s necessary?

Police Interview After Shooting

Paramedic: (04:34)
Did he hit you with it?

Officer Garrett Rolfe: (04:34)
I felt it but I don’t know…

Interviewing Officer: (04:40)
Give me, if you’re willing and able- I don’t need anything too specific at this junction because I know you’re still evaluating that. Just give me the pure basis of how we wound up here.

Officer Garrett Rolfe: (04:55)
I was called to deal with a DUI investigation.

Interviewing Officer: (04:57)
Okay so there was already three officers already on site?

Officer Garrett Rolfe: (04:59)
Yeah.

Officer Garrett Rolfe: (05:00)
You could tell probable cause to arrest the suspect for DUI. He resisted arrest and he gained control of the other officer’s taser and started running as I pursued him. He turned and started firing the taser at me.

Interviewing Officer: (05:11)
Okay.

Unknown Officer 1: (05:11)
You feel good, you all right?

Officer Garrett Rolfe: (05:14)
Yeah, still got the adrenaline pumping.

Unknown Officer 2: (05:19)
You all right?

Officer Garrett Rolfe: (05:20)
Yeah I’m okay.

Unknown Officer 2: (05:21)
All right good, good good good good. All right, we’re going to take care of you, brother. I’m just glad you’re all right, that’s my biggest concern.

Officer Garrett Rolfe: (05:28)
Yeah we’re good.

Unknown Officer 2: (05:29)
All right good. You talked to your wife, you talked to your family, everybody?

Officer Garrett Rolfe: (05:32)
No, I didn’t call anybody other than the IPPO.

Unknown Officer 2: (05:34)
Okay. All right, hopefully we’ll get this cleared up. Anything you need from me?

Officer Garrett Rolfe: (05:39)
Any update on the… On Mr. Brooks?

Unknown Officer 2: (05:40)
No, I haven’t checked yet.

Officer Garrett Rolfe: (05:40)
Okay.

Unknown Officer 2: (05:41)
We’ll get that squared away, all right?

Officer Devin Brosnan: (05:41)
All right.

Unknown Officer 2: (05:41)
You’re good.
