Speaker 1 (00:00):

Back on record in State versus Davis, C377407. Normal party present. Anything we need to address outside the presence, Mr. DiGiacomo?

Mr. DiGiacomo (00:08):

Just one thing. Apparently it was marked State's proposed 145 and I said 149. And so, the clerk marked it as admitted 149 instead of admitted 145. So we just need to correct the record. We're going to replace the 149 with the 145. She asked me to put it on the record.

Speaker 1 (00:28):

Perfect. Any objection, Mr. Sand?

Mr. Sand (00:29):

No objection, Your Honor.

Speaker 1 (00:30):

Perfect. That'll be done. Was there anything that you needed to put on record regarding a statement not being introduced?

Mr. DiGiacomo (00:45):

I don't think we need to put it on the record, but we... I mean, I know the court has ruled on it, but we've made the determination not to offer it.

Speaker 1 (00:51):

Which statement is that? Just if we ever need an-

Mr. DiGiacomo (00:53):

Appellate Court.

Speaker 1 (01:12):

Okay. All right. Anything else we need to address before we bring the jury back in?

Mr. Sand (01:39):

No, Your Honor.

Mr. DiGiacomo (01:40):

No, Your Honor.

Speaker 1 (01:42):

Okay. Let's bring them in.

Speaker 2 (01:43):

Stand for the jury.

Speaker 1 (02:17):

All right. Do the parties stipulate to the presence of the jury?

Mr. DiGiacomo (02:20):

Yes, Your Honor.

Speaker 1 (02:21):

You may be seated. Welcome back, ladies and gentlemen. We are still in the state's case in chief. State, who's the next witness you will be calling at this time?

Mr. DiGiacomo (02:30):

Denvonta Lee.

Speaker 1 (02:30):

Denvonta?

Mr. DiGiacomo (02:30):

You do solemnly swear the testimony you're about to give in this action shall be the truth, the whole truth, and nothing but the truth, so help you God?

Denvonta Lee (03:06):

Yes, I do.

Speaker 1 (03:07):

You may be seated. May I please have you state and spell your first and last name for the record?

Denvonta Lee (03:16):

Devonta Lee. Spelled D-E-N-V-O-N-T-A, last name Lee, L-E-E.

Speaker 1 (03:20):

Thanks, Mr. Lee, for being here. Mr. Quall, whenever you're ready, you may proceed.

Mr. Quall (03:25):

All right. Thank you. Sir, you did not volunteer to be here. Is that fair?

Denvonta Lee (03:28):

No, I didn't.

Mr. Quall (03:30):

In fact, you're under a court order to be here?

Denvonta Lee (03:33):

Yes.

Mr. Quall (03:33):

Through a subpoena?

Denvonta Lee (03:34):

Yes.

Mr. Quall (03:35):

In fact, you have expressed many times the fact that you do not want to participate in this.

Denvonta Lee (03:40):

Yeah.

Mr. Quall (03:43):

But understanding that you're a court order, you don't have a choice whether or not to sit in that chair. Is that fair?

Denvonta Lee (03:48):

Yeah, that's fair.

Mr. Quall (03:51):

Okay. I want to ask you a little bit about the mid 1990s. Where were you living?

Denvonta Lee (03:56):

At the time, I think Hawthorne.

Mr. Quall (03:59):

Did you ever start spending time in Compton?

Denvonta Lee (04:01):

Yes.

Mr. Quall (04:02):

And who were you spending time with?

Denvonta Lee (04:09):

My homeboys and people around, friends.

Mr. Quall (04:15):

At some point, were you spending time with a person that you knew as Big Dre?

Denvonta Lee (04:21):

Yes.

Mr. Quall (04:23):

Would you describe him as a friend?

Denvonta Lee (04:24):

Yeah.

Mr. Quall (04:25):

Okay. And then later on, did you start spending time with a person by the name of Orlando Anderson?

Denvonta Lee (04:32):

Yes, I did.

Mr. Quall (04:33):

Okay. Would you consider him a friend?

Denvonta Lee (04:34):

Yes.

Mr. Quall (04:36):

Okay. As a result of your relationship with Orlando Anderson, did you start coming into contact with the Southside Compton Crips?

Denvonta Lee (04:44):

Yes, I did.

Mr. Quall (04:45):

Can you tell us how that happened?

Denvonta Lee (04:48):

Meaning, I mean, we used to go over there and hang out. We wasn't from over there at that time, but we knew a couple of people. So you know what I mean? We'd go over there, hang out or whatnot, chill.

Mr. Quall (05:03):

And then is it fair to say at some point that you were given a option of joining Southside Crips or facing a different kind of repercussion?

Denvonta Lee (05:18):

Yeah, I would say it was an option. Either/or, basically.

Mr. Quall (05:25):

And can you tell us what the either/or was?

Denvonta Lee (05:28):

Well, at the time, it was either we're going to join or we just can't come around no more.

Mr. Quall (05:38):

And did you ultimately join?

Denvonta Lee (05:40):

Yeah, I did.

Mr. Quall (05:41):

And how does that work? How did you join?

Denvonta Lee (05:44):

You get put on, meaning have a fight or whatever. Things of that nature.

Mr. Quall (05:51):

This fight, is it always a one-on-one or sometimes is it multiple people on one?

Denvonta Lee (05:55):

Sometimes it's not one-on-one. If you get lucky, you know what I mean? You might get a fair one like that, but other than that, sometimes it's not one-on-one.

Mr. Quall (06:07):

And when you say a fair one, you mean a one-on-one basically?

Denvonta Lee (06:09):

Yeah.

Mr. Quall (06:13):

All right. And so did you get a fair one or did you have to get jumped in by multiple people?

Denvonta Lee (06:19):

Oh, I had a fair one. Yeah. It was not multiple people.

Mr. Quall (06:21):

And how'd that come about, you getting a fair one?

Denvonta Lee (06:28):

I mean, I don't understand the question.

Mr. Quall (06:30):

Well, did Mr. Anderson assist you in joining the Southside Crips?

Denvonta Lee (06:36):

Oh, honestly, he didn't assist us on joining nothing. He just was there to make sure, because we're friends of his, to make sure basically that we had a fair shake. We get a fair chance. Won't get dogged out or not unless you got dogged out by that one, whoever he was fighting. So yeah, he was there to make sure that everything went pretty much as smooth as he can go.

Mr. Quall (07:02):

And so Orlando Anderson was basically looking out for you?

Denvonta Lee (07:05):

Yeah, he was looking out for all of us.

Mr. Quall (07:08):

Now, were you familiar with a person that went by the moniker Keefy D?

Denvonta Lee (07:14):

Yes.

Mr. Quall (07:15):

And who was he in the South Side Crips in the mid '90s?

Denvonta Lee (07:22):

He was a hustler. He was known for hustling. That's what I knew from him is he was a hustler, grew up around there. That's basically what he was. Yeah.

Mr. Quall (07:44):

And when you say he was a hustler, for those of us who don't understand what that means, what does that mean? Is he getting money? Is he doing other things?

Denvonta Lee (07:53):

He getting money. Yeah. He's getting money. That's what he is.

Mr. Quall (07:55):

And how is he getting money?

Denvonta Lee (07:56):

On a higher level.

Mr. Quall (07:57):

On a higher level. So he's not just getting... There are some people who are, let's say hustling, that get money on maybe a lower level and then there are people who are making bigger money. Is that fair?

Denvonta Lee (08:07):

Yeah, of course you could say that's safe to say that he's on a bigger level.

Mr. Quall (08:11):

He was on a bigger level. And when we're talking about getting money, are we talking about through working a nine to five or are we talking about narcotics?

Denvonta Lee (08:20):

It was narcotics.

Mr. Quall (08:24):

All right. And then so you got initiated into the Southside Crips through a fair one. After that, would you hang around the Southside area a lot?

Denvonta Lee (08:38):

Yeah, of course.

Mr. Quall (08:40):

And is it sometimes referred to as the neighborhood?

Denvonta Lee (08:42):

You said-

Mr. Quall (08:43):

The neighborhood is like-

Denvonta Lee (08:51):

Yeah. I mean, that's where we're from. That's where we were going to be.

Mr. Quall (08:51):

Okay. And we talked about Orlando Anderson. Did he have any relation to Keefy D?

Denvonta Lee (08:58):

Did Orlando?

Mr. Quall (08:58):

Yeah.

Denvonta Lee (08:59):

Yeah, that was his nephew.

Mr. Quall (09:01):

Okay. Orlando was Keefy's-

Denvonta Lee (09:02):

Keefy's nephew.

Mr. Quall (09:02):

Okay. And being a Davis or being part of that family in Southside, was that a big deal?

Denvonta Lee (09:13):

I wouldn't say it was a big deal because it's a lot of families in our neighborhood, but they were pretty prominent family.

Mr. Quall (09:26):

And then the day you got initiated, did DeAndre also get initiated?

Denvonta Lee (09:33):

Yes.

Mr. Quall (09:35):

And are you familiar with somebody by the name of Terrence Brown?

Denvonta Lee (09:39):

Yes.

Mr. Quall (09:41):

Was he older than you or was he your age?

Denvonta Lee (09:44):

Yeah. He was older than me. Yeah, he was older than me.

Mr. Quall (09:47):

So I assume he was in before you were in?

Denvonta Lee (09:51):

Yeah. Way longer. Yeah, before. Yeah.

Mr. Quall (09:54):

He's more of a contempt. You were kind of in the group that Big Dre, Orlando, that age group?

Denvonta Lee (10:00):

Yeah, that's that era. Yeah.

Mr. Quall (10:03):

And then Terrence Brown was, I'd say, would it be fair to say Terrence Brown's part of an older group along with Mr. Dale?

Denvonta Lee (10:09):

Yes. Yes.

Mr. Quall (10:14):

During that time, did the Southside have any rival gangs in Compton?

Denvonta Lee (10:21):

We had a lot of rival gangs in Compton.

Mr. Quall (10:23):

Yeah. Understood. Was Mob Piru one of those rival gangs?

Denvonta Lee (10:29):

Yes.

Mr. Quall (10:31):

And Luders Park Pyro also?

Denvonta Lee (10:33):

Yes.

Mr. Quall (10:35):

In the mid '90s specifically, like 1995, 1996, was there a war going on between Southside and Mob Piru?

Denvonta Lee (10:45):

Yes.

Mr. Quall (10:46):

I'm going to focus your attention to around 1995. In 1995, were you aware whether or not Mob Piru was associating with a music label?

Denvonta Lee (11:03):

Yes, I did. Yeah.

Mr. Quall (11:04):

And what music label was that?

Denvonta Lee (11:06):

Death Row Records.

Mr. Quall (11:08):

And were you familiar with somebody by the name of, or went by the name of Suge Knight?

Denvonta Lee (11:12):

Yes.

Mr. Quall (11:13):

And would you say that he associated it with Mob Piru?

Denvonta Lee (11:16):

Yes.

Mr. Quall (11:17):

Okay. Were you familiar with somebody by the name of Tupac Shakur?

Denvonta Lee (11:22):

Yeah.

Mr. Quall (11:24):

And would he also associate with Suge Knight, Death Row and Mob Piru?

Denvonta Lee (11:29):

Yes.

Mr. Quall (11:33):

Now, with regards to Southside, were you guys hanging out with another record label?

Denvonta Lee (11:43):

I mean, we have hung out with one another record label, yes.

Mr. Quall (11:45):

Yeah. And what record label was that?

Denvonta Lee (11:48):

It was Bad Boy.

Mr. Quall (11:50):

And Bad Boy, is that the record label that was being run by Sean Puffy Combs?

Denvonta Lee (11:56):

Correct.

Mr. Quall (11:57):

And when you say you would associate with them, would you go to concerts? Would you just hang out? What would be the nature of the connection that you saw between Southside and Bad Boy?

Denvonta Lee (12:10):

I mean, we went to a couple of concerts. I seen them before that concerts or they came to our neighborhood before.

Mr. Quall (12:24):

And when you would go to concerts, who would organize you going to that concert? How would you know to go to the concert?

Denvonta Lee (12:32):

Well, we just basically all do because they'd say we got tickets or da, da, da, da. And they'd be like, "Okay, we're going to go to the concert. You get your ticket and you go."

Mr. Quall (12:44):

Was your understanding part of it was to ensure that Bad Boy was not bothered by other gangs?

Denvonta Lee (12:54):

That was the basis of it, I believe. Yeah, I would say that.

Mr. Quall (13:01):

And was there a particular gang that people in Bad Boy were worried about?

Denvonta Lee (13:06):

Yeah, they was worried about the Death Row.

Mr. Quall (13:11):

I want to take your attention to the summer of 1996, in particular the Lakewood Mall. Are you aware of an incident that took place at the Lakewood Mall in the summer of 1996?

Denvonta Lee (13:24):

Yes, I am.

Mr. Quall (13:26):

How are you familiar with that event?

Denvonta Lee (13:28):

Because I was there.

Mr. Quall (13:33):

And that summer of Lakewood Mall, what happened? What were you doing at Lakewood Mall?

Denvonta Lee (13:40):

One of our friends, he was going off to college and he had went up there to grab some things to get prepared for college. So we went along with him.

Mr. Quall (13:52):

Do you know where the money came from for this person who's going to college to get these things?

Denvonta Lee (13:57):

Yeah. Keefy was helping try to get you there. He needed a lot of... I don't know what college kids need really, but need a little TV probably, a little clothes and things of that nature.

Mr. Quall (14:10):

And Lakewood Mall's not in Compton, is it?

Denvonta Lee (14:14):

Not at all.

Mr. Quall (14:15):

Is it fair to say it's about 15, 20 minutes away from Compton?

Denvonta Lee (14:19):

Yeah, if that.

Mr. Quall (14:23):

And just so things have changed in the last 30 years.

Denvonta Lee (14:26):

Of course.

Mr. Quall (14:26):

Back then you couldn't order things on Amazon and have them delivered to your house, right? You actually had to go-

Denvonta Lee (14:30):

No, I doubt it. I don't remember.

Mr. Quall (14:35):

So at the Lakewood Mall, you were there with other Southside Crip members. Is that fair to say?

Denvonta Lee (14:43):

Yes.

Mr. Quall (14:43):

And was Orlando Anderson one of the people that were with you?

Denvonta Lee (14:47):

Yes, Orlando was with us.

Mr. Quall (14:50):

Okay. And then did you happen to run in that day into people from Mob Piru or Death Row Records?

Denvonta Lee (14:56):

Yes, we did.

Mr. Quall (14:57):

Can you tell us about that?

Denvonta Lee (14:59):

Well, we basically were coming from different sides of the mall and we were walking towards each other. I guess we basically seen each other simultaneously. And we noticed people. They noticed us. They kept coming our way. We kept coming that way. And a couple of words was exchanged once it got close enough. You know what I mean? And that's when the fight broke out.

Mr. Quall (15:28):

So a fight broke out?

Denvonta Lee (15:29):

Yeah.

Mr. Quall (15:30):

And by that, we're talking about people punching each other and tackling each other type of thing?

Denvonta Lee (15:35):

Yeah.

Mr. Quall (15:37):

On the other side, were you aware of somebody by the name of Trayvon Lane there?

Denvonta Lee (15:42):

Yeah, I was aware of Trayvon. Yeah.

Mr. Quall (15:46):

And in particular, there's talk about a death row chain or medallion hanging from Trayvon Lane's neck. Did you see that?

Denvonta Lee (15:59):

Did I see the chain?

Mr. Quall (16:00):

Yeah.

Denvonta Lee (16:00):

Yeah, I seen the chain.

Mr. Quall (16:02):

Okay. During the fight, did anything happen to that chain?

Denvonta Lee (16:07):

Yeah. During the brawl, it came off his neck.

Mr. Quall (16:15):

Now, let me ask you something about the significance of a chain or something like that. Is there any special significance to taking somebody's chain?

Denvonta Lee (16:24):

Yeah, I would think so. Yeah.

Mr. Quall (16:29):

Can you explain that?

Denvonta Lee (16:31):

I mean, that was their logo. So it's like you taking that from him is like you got something to at least harp about or to say, look, I took this. That's all it would be.

Mr. Quall (16:46):

Would it be considered disrespectful to rip somebody's chain off?

Denvonta Lee (16:50):

Yes.

Mr. Quall (16:54):

How did that brawl end? What made you guys stop fighting?

Denvonta Lee (17:01):

Oh, well, the police came. You know what I mean? The police came, separated the parties. They didn't even try to talk to nobody or nothing. They just wanted to get the situation under control. Everybody just leave, just get out of there. So that's what they did. They came in, they separated us basically. We went our way. They went their way.

Mr. Quall (17:27):

Is it fair to say that Lakewood is a little different of a place than Compton?

Denvonta Lee (17:34):

Somewhat. Yeah. Yeah, it is.

Mr. Quall (17:37):

A little more suburban?

Denvonta Lee (17:38):

A little more. Yeah.

Mr. Quall (17:40):

And at that point, it sounds like that whoever the police was in Lakewood just was asking you guys to get out of there, right?

Denvonta Lee (17:47):

Yeah. They just wanted it to be... You in the mall. It's families, kids. They just wanted to get it handled, situated and get people out of there.

Mr. Quall (18:01):

Permission to approach, Your Honor?

Speaker 1 (18:03):

You may.

Mr. Quall (18:06):

I'm going to show you some exhibits that's already been admitted. I'm going to show you Exhibit 62. Who's that?

Denvonta Lee (18:17):

Mr. Davis.

Mr. Quall (18:19):

Show you exhibit number 63. Who's that?

Denvonta Lee (18:22):

Mr. Anderson.

Mr. Quall (18:24):

Show you exhibit number 64. Who's that?

Denvonta Lee (18:27):

Mr. Smith.

Mr. Quall (18:29):

I'm going to show you exhibit number 65. Who's that?

Denvonta Lee (18:32):

Mr. Brown.

Mr. Quall (18:34):

I'm going to show you exhibit number 60. Who's that?

Denvonta Lee (18:36):

So that's Trayvon.

Mr. Quall (18:39):

Okay. And I'm going to show you exhibit number 70. Do you recognize the people in here? The ones faces that are blurred?

Denvonta Lee (18:51):

The only people I know, Orlando, me, and Pidre.

Mr. Quall (18:58):

And then is this just a wider out version of that photo?

Denvonta Lee (19:01):

Yeah. Same thing. Same deal. What I just told you, three plus three.

Mr. Quall (19:05):

Okay. And then I'm going to show you what's been already admitted States 66. Do you recognize who's in that photo?

Denvonta Lee (19:13):

Yeah, Orlando and Keith.

Mr. Quall (19:25):

Did you go to the Mike Tyson fight when Mike Tyson fought Bruce Selden the weekend that Tupac Shakur got shot?

Denvonta Lee (19:34):

No, I didn't.

Mr. Quall (19:35):

How come?

Denvonta Lee (19:36):

I was incarcerated.

Mr. Quall (19:38):

It's fair to say that that incarceration began in July 8th of 1996?

Denvonta Lee (19:44):

Yeah, somewhere around there.

Mr. Quall (19:45):

Okay. In 2006, is it fair to say that you started doing work for the DEA?

Denvonta Lee (20:00):

Yeah, HIDA.

Mr. Quall (20:04):

Yeah, HIDA. And is that after you got caught trafficking some drugs as well?

Denvonta Lee (20:11):

Correct.

Mr. Quall (20:12):

And in the mid-2000s, you got five payments. Is that right?

Denvonta Lee (20:18):

I think something like that.

Mr. Quall (20:20):

And that was for $2,000, $500, $1,000, $1,300, and $500 for a total of $5,300. Is that fair?

Denvonta Lee (20:30):

That's probably fair to say. I don't know exactly.

Mr. Quall (20:32):

You don't remember, but if I told you that, you wouldn't disagree with me?

Denvonta Lee (20:36):

No, not at all.

Mr. Quall (20:39):

Okay. Just a moment. State pass the witness.

Speaker 1 (20:45):

Okay. Cross, Mr. Sand?

Mr. Sand (20:48):

Thank you, Your Honor. Mr. Lee, your street moniker is Dirt Rock?

Denvonta Lee (20:59):

Correct.

Mr. Sand (20:59):

Okay. And how did you come with that moniker? How did that happen?

Denvonta Lee (21:05):

It was given to me.

Mr. Sand (21:08):

And with regards to your testimony here today, you've told us a little bit about your work with HIDA. That's for drugs, correct?

Denvonta Lee (21:18):

Yeah, correct.

Mr. Sand (21:19):

And while you were-

Denvonta Lee (21:20):

Drugs and other things. HIDA is a task force, so it's drugs and everything. ATF, DEA, all that.

Mr. Sand (21:27):

Right.

Denvonta Lee (21:27):

Right.

Mr. Sand (21:27):

And with regards to your work with HIDA, of course, because it's about everything, technically, if you saw other types of crimes being committed while you're working for HIDA, you would tell the HIDA people because it's part of a overall task force, right?

Denvonta Lee (21:46):

No, not necessarily. I'm going to tell them what they asked me about. I'm not going to tell them nothing outside of the realm of what they're seeking or looking for.

Mr. Sand (21:59):

Right. And fair to say though, with regards to what they were seeking and looking for, at some point, they were targeting Mr. Davis as a drug dealer, right?

Denvonta Lee (22:07):

Yeah.

Mr. Sand (22:08):

And so you were helping them with that information that they needed, right? And that information came in early of 2008, meaning that you were helping him in April and May and that kind of thing.

Denvonta Lee (22:20):

I'm not sure the dates, but I think he was helping. I don't remember the dates.

Mr. Sand (22:29):

Your Honor, would a review of a report from the DOJ with regard to your participation help refresh your recollection?

Denvonta Lee (22:36):

It might. Yeah. Sure.

Mr. Sand (22:52):

Just take a look at the report. Look at the date. Don't say anything and then I'll ask you some questions.

Denvonta Lee (22:57):

I got the date. Where's the date? Is it... Okay. I recall. Yeah.

Mr. Sand (23:16):

Okay. And with regard to this document I gave you, it looks like the date that I've shown you is a date for July 10th, 2008. Is that right?

Denvonta Lee (23:26):

Yes, that's the date that's on there.

Mr. Sand (23:29):

Okay. And fair to say for the jury, once again, you're working with the HIDA team, and that's even prior to July of 2008, you were working with the HIDA team, fair?

Denvonta Lee (23:39):

You said prior to?

Mr. Sand (23:41):

July of 2008.

Denvonta Lee (23:42):

In 2008?

Mr. Sand (23:44):

Yes, sir.

Denvonta Lee (23:45):

I was working with HIDA. I only worked with HIDA one time, so I don't know what you're trying to insinuate.

Mr. Sand (23:53):

All right. And I want to make sure that we're clear for the jury.

Denvonta Lee (23:55):

I understand.

Mr. Sand (23:58):

Let me show you my job here. Would a review of another document help you refresh your recollection as to how many times you worked with HIDA?

Denvonta Lee (24:03):

It might. Let me see.

Mr. Sand (24:22):

May I approach, Your Honor?

Speaker 1 (24:22):

You may.

Mr. Sand (24:28):

Sorry. All right, sir. Now I'm showing you what document. Do you recall having an interview with a couple of the special agents from HIDA on September 10th, 2007?

Denvonta Lee (24:55):

Yes, I recall.

Mr. Sand (24:56):

All right. And then also, once again, just for the jury's edification, I'm showing you a document here. Were you also working with HIDA on April 3rd, 2008?

Denvonta Lee (25:10):

See, working and being interviewed is two different things.

Mr. Sand (25:13):

Okay. So you were being interviewed by HIDA on April 3rd, 2008?

Denvonta Lee (25:20):

Yeah, that's what it says.

Mr. Sand (25:21):

And you were given information with regards to Mr. Davis on April 3rd, 2008, right?

Denvonta Lee (25:26):

I didn't get no information about Mr. Davis. I didn't even know at the time what... You know what I mean? I was there on what I was there for.

Mr. Sand (25:37):

Once again, this is about drugs. I'm talking about drugs. So regarding 2008, April 3rd, were you there to speak to HIDA agents about drugs?

Denvonta Lee (25:59):

Yeah, pretty much. Not entirely, but yes.

Mr. Sand (26:02):

All right. When you say not entirely, what do you mean?

Denvonta Lee (26:06):

I'm saying we did talk about drugs. We talked... Yeah, we did.

Mr. Sand (26:10):

Anything else besides drugs in your 2000... I want to make sure the jury understands. Anything in April 2008 besides drugs that you talked about?

Denvonta Lee (26:17):

No, that's it. That's all we talked about.

Mr. Sand (26:28):

All right. Thank you, sir. Now, in your time that you spent with HIDA, you had shared some information with regards to what we now call the Lakewood incident. You remember if we just talked about this a second ago?

Denvonta Lee (26:46):

Yeah.

Mr. Sand (26:47):

All right. Can you tell the ladies and gentlemen of the jury when the Lakewood incident occurred?

Denvonta Lee (26:53):

It was in 96. I want to say July. That's what I want to. Yeah, that's July. I feel it was July of 1996.

Mr. Sand (27:07):

Can you help us as to how you know it was in July?

Denvonta Lee (27:11):

Yeah, because it was the summer.

Mr. Sand (27:13):

It was in summer.

Denvonta Lee (27:14):

And he was getting ready to go to school. I know he had to be there that summer to start up his training and stuff for football.

Mr. Sand (27:24):

Okay. So if somebody else, an FBI agent came in here and told us that it was a couple weeks before the fight in Las Vegas, would he be mistaken?

Denvonta Lee (27:36):

You said who came in and said what?

Mr. Sand (27:38):

If somebody else testified about that date and said it happened at-

Mr. DiGiacomo (27:42):

Objection, Your Honor, to have this witness talk about what another witness stated.

Mr. Sand (27:47):

I'm just asking if that witness was stated what he said.

Speaker 1 (27:52):

He can't opine as to whether he's mistaken or not.

Mr. Sand (27:53):

I'll withdraw the question, Your Honor.

Speaker 1 (27:54):

Okay.

Mr. Sand (27:55):

Let me ask you this. You shared the details of the Lakewood incident, right? You told people about... You described it, fair?

Denvonta Lee (28:04):

Describe it to who?

Mr. Sand (28:06):

To various different people over the time that since the time it happened. You've explained it to various different people. In fact, to us right now, today.

Denvonta Lee (28:18):

Yeah. So I mean I did because I'm doing it to a y'all right now. So yeah.

Mr. Sand (28:19):

Right. And so with regards to your description, can you tell us, describe for us what happened during the Lakewood Mall incident?

Denvonta Lee (28:27):

Same thing I just told him that we got a fight.

Mr. Sand (28:34):

Now, isn't it fair though that at some point in the future, and I want to make sure I'm clear as to the date, you had an interview with a Detective Mog from Metro?

Denvonta Lee (28:42):

Oh yeah, I did.

Mr. Sand (28:45):

Okay. And you recall that that interview was actually on July 11th, 2023 in Las Vegas?

Denvonta Lee (28:53):

Yeah, about that. Yeah.

Mr. Sand (28:54):

Right. And would looking over a transcript of your interview with Detective Mog help refresh your recollection as to what you told him on that day?

Denvonta Lee (29:04):

Well, I couldn't tell him too much more different than what I already said. So yeah, come on with it.

Mr. Sand (29:13):

Right. All right.

(29:13)
May I approach, Your Honor?

Speaker 1 (29:13):

You may.

Mr. Sand (29:50):

Okay, sir. I'm showing you your respond here. And I want you to read [inaudible 00:30:00].

Denvonta Lee (29:59):

Okay. Now what's your question?

Mr. Sand (30:44):

Now with regard to what you reviewed, fair to say that you told Detective Locke a more specific sort of thing that happened at the Lake Wood Mall, right?

Denvonta Lee (30:54):

Yeah, I would say.

Mr. Sand (30:55):

Yeah. Can you tell us, for instance, the location of where the fight took place?

Denvonta Lee (31:01):

It was by Foot Locker.

Mr. Sand (31:02):

By the Foot Locker?

Denvonta Lee (31:03):

Yeah.

Mr. Sand (31:04):

In fact, you had made mention that the fight at the Foot Locker was so bad that they had to remodel it after the thing had gone down at the Lakewood Mall, fair?

Denvonta Lee (31:14):

Yeah, iit was turned into the world Foot Locker.

Mr. Sand (31:16):

Right. You described it as mayhem that was occurring in that Foot Locker.

Denvonta Lee (31:22):

Yeah.

Mr. Sand (31:23):

Okay. One moment please, Your Honor.

Speaker 1 (31:30):

Of course.

Mr. Sand (31:41):

Your Honor, I have no further... Actually, I do. Sorry, let me back up real quick. Nope, that's it. I have no further questions of this witness.

Speaker 1 (31:46):

Any further questions, Mr. Quall?

Mr. Quall (31:48):

No.

Speaker 3 (32:10):

Your Honor, I'll pass the witness except for one thing, I don't think I moved before the witness, please, I don't think I moved the exhibits into evidence, I just want to be clear about that before the witness is off the stand.

Carli Kierny (32:22):

Okay.

Speaker 3 (32:23):

Which is state is moving proposed exhibit 71, 70, 65, 64 into evidence.

Carli Kierny (32:37):

64, 65, 70, and 71.

Speaker 3 (32:40):

That's impressive. Yeah.

Carli Kierny (32:42):

Any objection?

Speaker 4 (32:42):

No objection, Your Honor.

Carli Kierny (32:42):

They'll be admitted.

Speaker 3 (32:45):

Thank you, Your Honor. Then with that, no further questions.

Carli Kierny (32:47):

All right. One final thing, Mr. Lee, any members of the jury have any questions for this witness? Okay. Got it. May I have the parties approach.

(32:57)
All right. A question from one of our jurors, Mr. Lee, what did you receive multiple payments for if you gave information to [inaudible 00:33:33] once?

Mr. Lee (33:35):

Well, it was during the course of the investigation and things like that, that's what it was for. During the course of the whole thing, they have different ways of looking out for you or giving you something to kind of help your situation or something like that.

Carli Kierny (34:00):

Any follow up based on that, State?

Speaker 3 (34:03):

No.

Carli Kierny (34:03):

Defense?

Speaker 4 (34:04):

No, Your Honor.

Carli Kierny (34:05):

All right. Thank you for being with us, Mr. Lee. You are excused.

Mr. Lee (34:15):

Thank you.

Carli Kierny (34:16):

You're welcome.

(34:17)
Who's your next witness, State?

Speaker 5 (34:19):

Judge, we're going to play the 2008 statement, which I think will probably take up the rest of the day.

Carli Kierny (34:22):

Okay. So it's already been admitted. Remind us what exhibit that is.

Speaker 5 (34:28):

That's a great question. I think it's going to be ... Actually, I don't know. I'm going to have to grab the disc.

Carli Kierny (34:42):

Okay.

Speaker 5 (34:42):

I have it uploaded on my computer.

Carli Kierny (34:42):

Do you know, Ryan?

Ryan (34:42):

I don't know.

Carli Kierny (34:42):

Okay.

Speaker 5 (34:53):

Give me one second.

Ryan (34:54):

117, the 2008 interview?

Speaker 5 (34:54):

Yep.

Speaker 3 (34:54):

117.

Carli Kierny (34:57):

So you can proceed with playing Exhibit 117 then.

Speaker 3 (35:00):

Thank you.

Speaker 5 (35:07):

If we just maybe put the volume down at the beginning, because it's really staticky, and then we'll turn it up when they start talking.

Audio: Speaker 13 (35:12):

[inaudible 00:36:10].

Audio: Speaker 2 (36:17):

Hey. How you doing? Good to see you, sir.

Audio: Higgins (36:17):

How you doing? Good to to see you.

Audio: Speaker 13 (36:17):

[inaudible 00:36:21]

Audio: Speaker 1 (37:20):

You get this thing catered?

Audio: Greg Kading (37:22):

Yeah, I figured we'd be here for a while.

Audio: Speaker 13 (37:23):

[inaudible 00:37:38]

Audio: Speaker 1 (37:40):

Oh, dude, you can just walk out there and buy breakfast. I might do that.

Audio: Speaker 2 (37:47):

Yeah?

Audio: Greg Kading (37:47):

Hey, man, you hungry, Keefe? You want something to eat? We're going to be here for a while, couple hours, three, four hours maybe.

Audio: Duane Davis (37:52):

Oh, man, I got to pick up my wife though.

Audio: Greg Kading (37:52):

What time?

Audio: Duane Davis (37:52):

2:30.

Audio: Greg Kading (37:52):

Okay. We'll have you out of here by 1:30.

Audio: Duane Davis (37:52):

All right.

Audio: Greg Kading (37:52):

Oh, look. Do they have any of that [inaudible 00:38:09] liquor?

Audio: Speaker 13 (37:52):

[inaudible 00:38:17]

Audio: Duane Davis (37:52):

I ain't send no spook down gang, either.

Audio: Greg Kading (37:52):

Okay.

Audio: Duane Davis (37:52):

I told you it wasn't her.

Audio: Greg Kading (37:52):

Okay.

Audio: Speaker 13 (37:52):

Good stuff.

Audio: Greg Kading (37:52):

Who was this guy again, Yafeu Fula?

Audio: Speaker 2 (39:18):

He was the guy, he was a witness that got shot and killed after the incident. And before, he really had an ability to make any statements.

Audio: Greg Kading (39:28):

Where's Blake? He's out there talking?

Audio: Speaker 2 (39:28):

He's talking to-

Audio: Greg Kading (39:28):

[inaudible 00:40:35].

Audio: Speaker 2 (39:28):

Dupree, yeah.

Audio: Duane Davis (41:19):

I never said I seen Reggie Wright up there neither.

Audio: Greg Kading (41:21):

Okay.

Audio: Duane Davis (41:22):

All right.

Audio: Greg Kading (41:30):

Regarding what? In Compton or at the Biggie thing?

Audio: Duane Davis (41:32):

At the Biggie thing.

Audio: Greg Kading (41:32):

Okay.

Audio: Duane Davis (41:32):

The Tupac [inaudible 00:42:27] murder homicide in Compton concerning the two ... Okay, yeah, yeah, yeah.

Audio: Speaker 2 (42:42):

A lot of shooting in Compton after that Tupac thing.

Audio: Dupree (42:44):

Sorry if we're late guys.

Audio: Speaker 13 (42:44):

[inaudible 00:43:07].

Audio: Dupree (42:44):

You know how it is.

Audio: Speaker 1 (42:44):

So difficult out here to make a living.

Audio: Speaker 2 (42:44):

Trying to hustle?

Audio: Higgins (43:12):

Oh, I'm trying, man, but nobody wants to buy anything from me. No, I'm just kidding, I'm kidding.

Audio: Greg Kading (43:19):

Duane keeps going over his original statements that he gave during after his arrest back in 90 whatever it was.

Audio: Higgins (43:32):

Are you hiding the donut with the coffee and that?

Audio: Greg Kading (43:35):

These guys wouldn't let me get any.

Audio: Higgins (43:37):

See, see, I know how y'all see [inaudible 00:43:40].

Audio: Greg Kading (43:39):

I'm trying to help you out, man. I'm looking after your heartbeat.

Audio: Higgins (43:41):

It's true. See a fat boy and he acts like he ain't got no food.

Audio: Speaker 13 (43:42):

[inaudible 00:43:46]

Audio: Greg Kading (43:42):

Okay. Oh God.

Audio: Speaker 13 (43:42):

[inaudible 00:44:06]

Audio: Higgins (43:42):

How you guys been?

Audio: Speaker 2 (43:42):

Good, man. Good.

Audio: Higgins (43:42):

How's the holiday going?

Audio: Speaker 2 (44:12):

So far so good.

Audio: Higgins (44:13):

Really? Yeah, it's coming up fast, isn't it? Faster than I expected.

Audio: Speaker 2 (44:18):

Next week, next week, it'll be here and be over. Which is always a good thing.

Audio: Higgins (44:19):

Yeah.

(44:19)
Is my secretary here? Or someone else let you guys in?

Audio: Speaker 2 (44:44):

It was Opal.

Audio: Higgins (44:45):

Oh, it was Opal?

Audio: Speaker 2 (44:46):

Yeah.

Audio: Higgins (44:47):

Okay.

Audio: Speaker 1 (44:51):

Some dude came in with a cart full of food, people came out like ants, man.

Audio: Higgins (44:55):

Okay.

Audio: Speaker 1 (44:57):

They got some guy pulling a cart around selling sandwiches.

Audio: Higgins (45:00):

Oh yeah, yeah, they do that around here.

Audio: Speaker 1 (45:01):

That's pretty cool.

Audio: Higgins (45:02):

For people that don't want to go to the cafes that they just have, they come from sweet to sweet.

Audio: Speaker 1 (45:07):

Right.

Audio: Higgins (45:08):

I know, it is pretty ... because there's not a lot of restaurants around here.

Audio: Speaker 1 (45:10):

Yeah, that's convenient, man.

Audio: Higgins (45:12):

Yeah, it's convenient. Because restaurants are expensive, I guess.

Audio: Speaker 1 (45:16):

Yeah.

Audio: Higgins (45:17):

Yeah, I never eat around here.

Audio: Speaker 1 (45:18):

Do they charge a lot? I didn't ask him how much it was.

Audio: Higgins (45:25):

Yeah, probably five bucks or six bucks or whatever they can get. But it's a smart move, it's smart because can probably make a couple of hundred bucks a day. Ain't seen you in a while, man.

Audio: Dupree (45:45):

I know, it's the holidays.

Audio: Higgins (45:45):

Yeah.

Audio: Dupree (45:45):

Nice office, man.

Audio: Higgins (45:58):

It's meager surroundings. Oh yes. We're moving down the street actually to a different building.

Audio: Dupree (46:05):

Is that right?

Audio: Higgins (46:08):

Yeah. We thought you wanted to be part of history.

Audio: Dupree (46:11):

That's ironic.

Audio: Higgins (46:12):

Yeah. It's nice if we get it.

Audio: Dupree (46:12):

Yeah. It's real nice. I see it from the outside, not the inside.

Audio: Higgins (46:20):

Yeah, this lawyer and doctor bought it, I know the lawyer, her name is Shelly McMillan, and this doctor bought it. And they [inaudible 00:46:26]

Audio: Greg Kading (46:26):

He's at the hospital right now with his father. [inaudible 00:46:31]

Audio: Higgins (46:32):

Okay.

Audio: Greg Kading (46:36):

Yeah. I've already ... Okay.

Audio: Higgins (46:42):

That's a Nike watch?

Audio: Greg Kading (46:44):

I've already spoken with somebody from your guys office and provided it all, probably two weeks ago.

Audio: Speaker 13 (46:48):

[inaudible 00:46:49]

Audio: Higgins (46:48):

Nice.

Audio: Dupree (46:49):

Thanks, man. My wife got it for me.

Audio: Higgins (46:52):

She loves you, huh?

Audio: Dupree (46:55):

[inaudible 00:46:56] Only on my birthday. [inaudible 00:46:58]

Audio: Greg Kading (47:00):

Yeah.

Audio: Higgins (47:00):

Call on your birthday.

Audio: Speaker 13 (47:01):

[inaudible 00:47:04]

Audio: Greg Kading (47:03):

I don't have it with me right now, I'm actually at work and I'm in a meeting. And he has his medical card with him because he's going back in for another pre-op today. His mom does and she's with him so he can call her.

Audio: Speaker 13 (47:18):

[inaudible 00:47:23]

Audio: Higgins (47:22):

What does that exactly look now?

Audio: Dupree (47:24):

No. Oh no, that's his statements from-

Audio: Speaker 2 (47:27):

Prior statements when he was arrested.

Audio: Higgins (47:28):

Okay.

Audio: Greg Kading (47:28):

Yeah.

Audio: Speaker 13 (47:28):

[inaudible 00:47:29]

Audio: Greg Kading (47:29):

It's 909331.

Audio: Speaker 1 (47:34):

Well, I'm not going to look in it.

Audio: Speaker 13 (47:35):

[inaudible 00:47:36]

Audio: Greg Kading (47:35):

6272.

Audio: Duane Davis (47:35):

A $19 phone

Audio: Speaker 1 (47:41):

What? It really doesn't look like it.

Audio: Higgins (47:43):

What time is it?

Audio: Speaker 1 (47:54):

It's a throw away.

Audio: Dupree (47:54):

Boost.

Audio: Higgins (47:54):

Oh, a Boost phone, oh, they changed and they're nice.

Audio: Speaker 13 (47:54):

[inaudible 00:47:55]

Audio: Dupree (47:54):

That's what they call it?

Audio: Speaker 1 (47:54):

You just got to throw them away faster, man.

Audio: Duane Davis (47:57):

I was, yeah, the motherfucker sitting next to me. [inaudible 00:48:05]

Audio: Greg Kading (47:58):

I like the way that Vegas does their reports.

Audio: Speaker 2 (48:54):

It's almost like a federal report.

Audio: Greg Kading (48:56):

It's unique, yeah.

Audio: Speaker 2 (48:58):

A lot of agencies have adopted that federal reporting system that the FBI uses for the way they structure their reports. I don't know why.

Audio: Speaker 13 (49:12):

[inaudible 00:49:16].

Audio: Speaker 2 (49:15):

Anything's better than LA though. LA's are so screwed up the way they do it.

Audio: Higgins (49:37):

Hey Greg, can I have a piece of that scratch paper? Thank you.

Audio: Greg Kading (49:45):

You just need one or you want-

Audio: Higgins (49:45):

Just one.

Audio: Greg Kading (50:16):

And we got accused of doing this one too. So an anonymous caller said, "Not through the LAPD, working security field Tupac." We can't win, can we?

Audio: Dupree (50:31):

Someone knows we tip her.

Audio: Speaker 2 (50:31):

Yeah, LAPD are a bunch of killers, man.

Audio: Greg Kading (50:35):

Here's the interesting ... 9/24/96, a caller from New York claiming to be Sean Duffy Combs said he hired someone to blow up night and something went wrong, girls got involved. This was interesting.

Audio: Speaker 2 (50:51):

I believe that one.

Audio: Greg Kading (50:53):

Are you going to call in on himself?

Audio: Speaker 2 (50:55):

Yeah. No, but somebody just calling in.

Audio: Greg Kading (50:57):

I say, is this he called?

Audio: Speaker 2 (51:02):

Yeah. Well, he had to put some credibility to it. Yeah.

Audio: Speaker 13 (51:07):

[inaudible 00:51:18]

Audio: Greg Kading (51:33):

Keefe, the second one is almost identical to the first one, so we don't need to go through that if you haven't already.

Audio: Speaker 1 (53:06):

Wait, Keefe, the guy who wrote that wants to know if you still have the girls going to the club selling ecstasy?

Audio: Duane Davis (53:11):

Selling ecstasy?

Audio: Speaker 1 (53:12):

Yeah. That's the guy who wrote that.

Audio: Duane Davis (53:20):

Man is as crazy as hell. [inaudible 00:53:17] no ecstasy. Me and Graham Brim, I was the leader.

Audio: Greg Kading (53:23):

So, really the only thing is the thing about Santana Block, the thing about getting dope from Pat back in '93 or whatever you said it was. And then what was the third thing? Oh, Reggie, right. Those were the only three things?

Audio: Duane Davis (53:38):

Yeah.

Audio: Greg Kading (53:40):

Well, what about that whole shit about Tupac?

Audio: Duane Davis (53:42):

What did you say?

Audio: Greg Kading (53:43):

The whole-

Audio: Duane Davis (53:43):

Oh yeah, that was bullshit.

Audio: Greg Kading (53:47):

Okay. All right. You can pass this back over here.

(53:52)
Today, Keefe, today what we're going to do, we're just going to go over with a fine tooth comb the Las Vegas incident, because we're going to draft up our report regarding that specific thing. And then we're going to cover a few other things that we do have to emphasize to you that everything in this report has to be right on. Because if down the road it's determined that some of these details are incorrect, then everything's off the table. So everything in this report cannot be like that report.

Audio: Duane Davis (54:22):

Hey, I want to say this though too. I feel, like I said that day, don't bullshit me and I won't bullshit y'all. You know what I'm saying? I feel I'm being bullshitted.

Audio: Greg Kading (54:34):

Regarding what, your deal?

Audio: Duane Davis (54:35):

You said yesterday, "Hell, Mike, I need to talk to Mike." You said it was over.

Audio: Greg Kading (54:40):

I need to talk to Mike, one, just because I've still got a tracker on his car. Two, I need his statement regarding the place in Paramount that was in his name. And there's some questions that are regarding to Mike. We're not bringing Mike in in order to arrest him. But since Mike already knows that the police have contacted you and you're working with them, there should be no problem. It's up to Mike to keep his own mouth shut. We're not going to be asking him about his people or his associates, that's not of concern to us.

Audio: Speaker 1 (55:12):

If you hadn't have told Mike, we wouldn't have talked to him. We wouldn't want to talk to him.

Audio: Duane Davis (55:23):

Okay. Another thing, I know y'all have been over at Kevin's house.

Audio: Greg Kading (55:25):

On surveillance?

Audio: Duane Davis (55:25):

No, no.

Audio: Greg Kading (55:27):

No, we've never been to Kevin's house.

Audio: Duane Davis (55:28):

Y'all haven't?

Audio: Greg Kading (55:29):

Ever.

Audio: Duane Davis (55:30):

Because I feel, why would y'all want to hire Edie?

Audio: Greg Kading (55:36):

There's some problems in my opinion, this may not be a shared opinion, but I just don't believe in Edie's ethics. I think he's a dirty attorney. I think that Edie will lie, cheat and steal in order to get himself out of any kind of problem. I think that there was ethical problems with the way that he had Orlando testify on behalf of Suge Knight. And that whole thing is a problem we don't want to have to deal with. And as you know, Edie Fall also represents Michael Durrough. And we just don't want all those problems.

Audio: Duane Davis (56:08):

He represent Michael Durrough right now?

Audio: Greg Kading (56:11):

Yeah, right now. Him and Rene Campbell.

Audio: Duane Davis (56:18):

Yeah.

Audio: Speaker 2 (56:18):

You know Rene Campbell?

Audio: Duane Davis (56:19):

I know Al, was in, was it San Bernardino, he ain't have no fucking reason being down there. You know what I'm saying? I'm up on everything, dude. You think I'm not.

Audio: Greg Kading (56:32):

Well, Keefe, you got to do your homework, we respect that. Don't read too much into anything.

Audio: Duane Davis (56:39):

I'm not going to do nothing to them dudes. I'm over it, man. I'm up on everything, dude. That's why he was in San Bernardino. What the fuck? He wrote me a letter. "Keefe, I'll never tell on you." This and this and that. Oooh. Yeah. I know you was in San Bernardino, coming to MDC, coming to see y'all, all that. I know all that shit, man. It was about two, three years ago. I know about the Tommy thing over there in Carlton Square. Boom. Man, I know a whole lot of shit, dude.

Audio: Greg Kading (57:10):

Okay. Well, you probably know more than us. We're doing our homework as we go. But again, we just don't want to deal with those problems that come along with Michael and that attorney. I don't believe in the guy. Had my encounters with him before and they didn't go well.

Audio: Speaker 1 (57:34):

And Keefe, some of the people that might be real close to you that you may want to protect may be the same people that sold you out. So take that into consideration when you're saying, "I don't want to give up Compton. I don't want to give up my homeboys," stuff like that. I mean, I'm not saying anybody did it [inaudible 00:57:53]

Audio: Duane Davis (57:54):

I know. He said Edie or Pat could be working with us. And that fucked me up. You know what I'm saying?

Audio: Higgins (58:01):

Well, Keefe, let me say this, I know you-

Audio: Duane Davis (58:03):

And I know, let me say one more thing.

Audio: Higgins (58:05):

Yes, sir.

Audio: Duane Davis (58:06):

And you said, "I got some shit going to break your heart, going to break you to your knees." I know y'all was going to arrest me for this shit, man. You know what I'm saying? I knew that shit, dog. You know what I'm saying?

Audio: Speaker 1 (58:16):

Yeah.

Audio: Dupree (58:18):

But that's how it go, that's how the game goes. You know how it is.

Audio: Duane Davis (58:21):

Yeah. These dudes are cold, man.

Audio: Higgins (58:23):

Well, let me say this to you, Keefe.

Audio: Speaker 13 (58:24):

[inaudible 00:58:27]

Audio: Duane Davis (58:26):

I'm serious, I never thought I would retire, but y'all heard me on the phone, man, I'm through with this shit. You know what I'm saying? Too many dirty motherfuckers, low down, cross artists, everything. But they don't know I'm putting the double cross down. Fuck him.

Audio: Higgins (58:41):

Would you let me say something.

Audio: Duane Davis (58:42):

Yeah.

Audio: Higgins (58:44):

I know you have used Edie and you felt comfortable with Edie, but I want to say this, and I know you've sent him a lot of business stuff, but I would think you would think at this point that maybe you shouldn't think that way because you wouldn't be here because a lot of people that he dealt with may have participated in getting your ass here.

Audio: Duane Davis (59:01):

I know.

Audio: Higgins (59:03):

So I think you might want to look at it a little differently.

Audio: Duane Davis (59:05):

Yeah.

Audio: Speaker 2 (59:06):

You got to look at the whole picture. And I think you're starting to do that.

Audio: Higgins (59:09):

It's a great picture.

Audio: Duane Davis (59:10):

And weighing with Snoop Dogg's uncle. You know what I'm saying? Then at the airport with the fuck ass plane tickets. Y'all came and got him out. And his wife even put him on blast. Shit, I don't know how you got out.

Audio: Dupree (59:24):

Just hold on. All the people, all the speculation, just hold on to that [inaudible 00:59:29]

Audio: Duane Davis (59:31):

I'm going to leave you alone, yeah. [inaudible 00:59:31] all that shit. Which is why I smoke weed because I'm a dangerous motherfucker without smoking weed, dude. I get mad easy. You know what I'm saying?

Audio: Dupree (59:39):

We know you, man. We know what you can do.

Audio: Greg Kading (59:42):

That's how Greg is without coffee.

Audio: Duane Davis (59:44):

Yeah. Y'all be sitting there, keep me calm, keep me from hurting people, man.

Audio: Speaker 1 (59:44):

You don't want to do that.

Audio: Dupree (59:49):

Well, you know what, man, just like you out the game, leave all that behind. [inaudible 00:59:53]. Just stop thinking about who did what and just think they all did it. And then just trust the person sleeping in your bed with you, your wife. Other than that, just shut it down. Let's go forward.

Audio: Higgins (01:00:03):

No, and your lawyer.

Audio: Dupree (01:00:04):

Well, your lawyer.

Audio: Speaker 13 (01:00:04):

[inaudible 01:00:07]

Audio: Duane Davis (01:00:07):

I understand. This is dirty world.

Audio: Dupree (01:00:10):

And Greg got some other stuff he wants to talk [inaudible 01:00:13].

Audio: Duane Davis (01:00:12):

Okay.

Audio: Greg Kading (01:00:14):

What this ultimately comes down to is how valuable your life is, your family. And when I say your family, I don't mean your extended family, I mean your brothers and your sisters and your wife and your kids, that's it. Anything beyond that, as far as we're concerned, is fair game.

Audio: Duane Davis (01:00:31):

I thought Speedy-

Audio: Greg Kading (01:00:31):

Kevin will work out his own deals. Speedy ain't got a lot on the table. I don't think that's going to be a problem. And we'll throw that one in, if that's what's important to you, we'll throw that one in. But besides that, man, everything else is fair game for us.

Audio: Higgins (01:00:45):

I just want to say this, and me and Keefe have had the conversation, I tried to explain to Keefe, some people out there that you may have love for, but you can't control that their stuff is way out, that's not within your zone. You know what I'm saying?

Audio: Duane Davis (01:00:58):

I know, I know.

Audio: Higgins (01:00:59):

So you have to understand that.

Audio: Duane Davis (01:01:02):

All the son of bitches did me dirty.

Audio: Higgins (01:01:04):

They're not ... he's out on his own.

Audio: Duane Davis (01:01:06):

The majority of them. You know what I'm saying?

Audio: Greg Kading (01:01:09):

Again, don't think beyond your family. Don't be concerned with anything beyond your family. Kevin will come in, he'll work his own deal out. He's got to do that. He's got a lot of liability out there in Richmond. And so your brother's going to have to come in and work his own details out. Which I'm sure he'll do because he doesn't want his own family disrupted.

Audio: Higgins (01:01:30):

He can help himself. But if you can't control him, that's his situation, he created it. [inaudible 01:01:34]

Audio: Duane Davis (01:01:34):

They ain't like the old school dudes, man. You know what I'm saying? It ain't like the '80s and the early '90s dudes. These new wave, MySpace gang bangers. I know what's up, man. I'm through with this shit. I'm through with that neighborhood, all that. You know what I'm saying? I'm through with that shit, man.

Audio: Higgins (01:01:59):

Well, that's-

Audio: Duane Davis (01:02:00):

Corona way lovelier than Compton. I can get my head blowed off. You know what I'm saying? Paying 300,000/400,000 for a house, you walk out the street, you get your head blowed off. It's crazy. Yeah. All right, I'm ready.

Audio: Greg Kading (01:02:14):

Okay. So again, today's report that's going to get generated is specifically on Tupac Las Vegas incident. And we'll get you a copy of that report and have you make sure everything's solid before it's completed.

Audio: Duane Davis (01:02:28):

All right. Man, well, I feel I can still go to jail with that, because this is federal and that's [inaudible 01:02:33]

Audio: Greg Kading (01:02:33):

What is said right here cannot be used against you, Keefe. Nothing you say today can be used against you.

Audio: Higgins (01:02:38):

Yeah, nobody's trying to-

Audio: Duane Davis (01:02:42):

I was just waiting on the news camera to be at my house, man. You know what I'm saying?

Audio: Dupree (01:02:43):

He's just nervous. We're not going to ...

Audio: Speaker 2 (01:02:46):

You got to trust us too.

Audio: Dupree (01:02:47):

You're just nervous.

Audio: Duane Davis (01:02:49):

It's something like what I said to you yesterday, I didn't know whether to phone up or die.

Audio: Greg Kading (01:02:49):

If something like that was to happen to-

Audio: Speaker 13 (01:02:49):

[inaudible 01:02:50]

Audio: Higgins (01:02:49):

Oh yeah, my phone was off.

Audio: Duane Davis (01:02:49):

I didn't know whether to phone, I said, "Man, stay here."

Audio: Dupree (01:02:50):

That's why he sent me, man. He was trying to send somebody to knock on your door. And it's like spam or something.

Audio: Duane Davis (01:02:57):

Yeah. And he said, " Hey, you looking ragged." "Motherfucker, you just scared the living shit [Inaudible 01:03:13].

Audio: Speaker 13 (01:03:12):

[inaudible 01:03:18].

Audio: Duane Davis (01:03:17):

Yeah, yeah. I swear I had a dream that the cameras was there. [inaudible 01:03:26].

Audio: Dupree (01:03:22):

Just give us a number.

Audio: Greg Kading (01:03:27):

That ain't going to happen. We told you that nothing leaves this room. And that's the way it is. We wouldn't do that.

Audio: Duane Davis (01:03:31):

Yeah. Then my sister, "You a punk motherfucker." You know what I'm saying?

Audio: Higgins (01:03:38):

Why?

Audio: Duane Davis (01:03:38):

Huh?

Audio: Speaker 2 (01:03:40):

Was that in your dream?

Audio: Duane Davis (01:03:47):

No. That little mama, man, is crazy as hell, man.

Audio: Speaker 13 (01:03:47):

[inaudible 01:03:47].

Audio: Dupree (01:03:47):

She know about this?

Audio: Duane Davis (01:03:47):

No, she don't know.

Audio: Dupree (01:03:48):

No, don't tell her nothing, man, [inaudible 01:03:52] She's going to bring her business if it coming out like that.

Audio: Duane Davis (01:03:54):

Hell yeah. Bust me in the head with a pistol or something. "Motherfucker, what you doing?"

Audio: Dupree (01:03:58):

That's what we saying. We're going to keep meeting from time to time like this. Live your life, stay out of trouble, do what ...

Darren (01:04:00):

Meet from time to time like this. Live your life, stay out of trouble, do what you do. If you don't say nothing, it's cool. But if you go out there and start talking and looking for people who you possibly think talk to us and all that kind of stuff, you can cause your-

Audio: Duane Davis (01:04:17):

Problems. Yeah.

Darren (01:04:17):

We got to move forward on these questions we're getting ready to ask, because we're going to keep going over and over this and it's going to take too much time.

Greg (01:04:25):

All right. So that's it. We're going to start. Me and Jeff went back to New York, did a little bit of groundwork back there. As far as the Tupac things going, we just want to run down all the leads as far as they relate to Zip and to Puffy and that kind of thing. But at some point in time we will have to go hit up, bubble up, get his statement, and the other dude that was in the car that's still alive.

Audio: Duane Davis (01:04:54):

Ain't nobody else still alive.

Greg (01:04:54):

Corey?

Audio: Duane Davis (01:04:57):

Corey wasn't here.

Greg (01:04:58):

No.

Audio: Duane Davis (01:04:59):

Big, Dre and Lane. They both dead.

Greg (01:05:01):

No, the other dude, Kitar Carol with the pink.

Darren (01:05:04):

In the car behind, you want to show them the diagram first and see?

Greg (01:05:06):

Yeah.

Speaker 6 (01:05:11):

Maybe be more clarifying it. Who's in that car with Zip? The van with Zip.

Audio: Duane Davis (01:05:13):

He wasn't in the van. He was in that van.

Greg (01:05:17):

That's the way we had it. You let me know. Let us know if that seating arrangement is right or wrong.

Darren (01:05:24):

If there's anything you want to change for the seating arrangement or whatever, just mark it on that one. Wherever you was sitting, wherever Nando was sitting, who was in that car behind?

Audio: Duane Davis (01:05:38):

Well, y'all done this shit already.

Darren (01:05:45):

But the seating arrangement might be ... because were you driving?

Audio: Duane Davis (01:05:45):

What?

Darren (01:05:47):

Were you driving in the first car? Because see that line says you're driving. Okay. And who was driving the ... Debbie Allen was in the car behind by herself?

Audio: Duane Davis (01:06:05):

No. He wasn't even there.

Darren (01:06:06):

None of them guys were in the car behind?

Speaker 6 (01:06:08):

So Orlando shot across Dre?

Audio: Duane Davis (01:06:12):

He leaned over on the window. He rolled down the window, popped.

Speaker 6 (01:06:18):

Who was it?

Audio: Duane Davis (01:06:18):

If they would've drove on my side, I would've popped them. You know what I'm saying? But they was on the other side.

Darren (01:06:23):

Right. So was there a second car behind you guys?

Audio: Duane Davis (01:06:26):

No, it was some girls hit that corner with us, dog, and we shot out they windows. I said, "These bitches got more work than the dudes." You know what I'm saying?

Speaker 6 (01:06:35):

But at any time was it this car behind you?

Audio: Duane Davis (01:06:38):

Not at all.

Darren (01:06:38):

None of the homies was behind you? Three or four cars behind, nothing like that?

Audio: Duane Davis (01:06:42):

No.

Darren (01:06:42):

Just one car?

Audio: Duane Davis (01:06:42):

Just one car. Then we hit the corner. The girl followed us and we shot out of her window. Then they got scared and stopped.

Darren (01:06:53):

But they weren't with you guys?

Audio: Duane Davis (01:06:54):

They weren't with us. No.

Greg (01:06:57):

Push that back over here real quick.

Audio: Duane Davis (01:07:00):

We would think even security would follow them. You know what I'm saying? [inaudible 01:07:08]. They followed us halfway and shot out their windows.

Greg (01:07:12):

Those are all the guys that you would recognize as being in the car, right? Lane, DeAndre and Terrance? Okay. T-Brown. Okay. So Orlando would've had to lean over the top of Dre, right?

Audio: Duane Davis (01:07:37):

Yeah. He did, yeah.

Greg (01:07:41):

Okay. All right. Well, that's what all the witnesses said too from the back.

Audio: Duane Davis (01:07:43):

That was a heartbreaker. Oh, man.

Greg (01:07:53):

Okay. All right. So leading up to that, do you know who Trevon Lane is?

Audio: Duane Davis (01:07:59):

Yeah, I know who he is.

Greg (01:08:01):

Okay. So do you see Trevon there just before the MGM at all?

Audio: Duane Davis (01:08:06):

I didn't see him.

Greg (01:08:07):

Okay. All right. Then let's start back at the beginning. Let's go back to, this is '96, three concerts. Where were the concerts where you talked to Puffy and Zip at?

Audio: Duane Davis (01:08:25):

That wasn't '96. When they gave it a BET tour, there was everybody on the show. Let me see. It was Naughty by Nature, they was on the show. Mary J, what's that dude name? Jodeci, Craig Mack, Biggie, Faith, and Junior Mafia.

Greg (01:08:50):

That was the group.

Darren (01:08:50):

That's BET tour or BET fest? It was a BET tour.

Audio: Duane Davis (01:08:50):

BET tour.

Darren (01:08:55):

Where was it at? Do you remember that?

Audio: Duane Davis (01:08:56):

It was in San Diego. We went to one in San Diego. Went to one in Anaheim, Irvine, then in Vegas.

Greg (01:09:12):

And all four of those locations, San Diego, Anaheim, Irvine, and Vegas, that was all the same tour? It was all BET tour with those acts?

Audio: Duane Davis (01:09:22):

Except the Irvine. Irvine was the summer jam.

Greg (01:09:28):

Okay. Can you hit those acts again? [inaudible 01:09:30] Naughty by Nature, Biggie, Faith, Jodeci ...

Audio: Duane Davis (01:09:34):

And Mafia.

Greg (01:09:35):

Junior Mafia?

Audio: Duane Davis (01:09:37):

And Mafia and Biggie.

Greg (01:09:40):

Faith Evans, right?

Audio: Duane Davis (01:09:43):

Yeah.

Greg (01:09:43):

Okay. All right.

Darren (01:09:47):

So all the acts on there were from Bad Boy, basically?

Audio: Duane Davis (01:09:50):

Mostly, yeah. [inaudible 01:09:53] Jodeci and Mary Jay doing it.

Darren (01:09:55):

So pretty much for Bad Boy, Puffy.

Audio: Duane Davis (01:09:58):

Yeah.

Darren (01:10:02):

Tour.

Greg (01:10:03):

Are you going to be able to track down those dates, Darren?

Darren (01:10:05):

Yeah. I can know. I can know them. Yeah.

Greg (01:10:12):

All right. Now, on all four of those occasions, there's San Diego, Anaheim, Irvine, and Vegas. Which ones do you actually talk to Puffy at?

Audio: Duane Davis (01:10:21):

Every one of them.

Greg (01:10:22):

Every one of them?

Audio: Duane Davis (01:10:24):

Yeah.

Greg (01:10:24):

Which of those four is it when you talked to him about murdering Tupac?

Audio: Duane Davis (01:10:27):

It was really about both of them. Either one of them.

Greg (01:10:35):

Tupac and Suge, you mean?

Audio: Duane Davis (01:10:40):

Yeah. A couple of times at Greenblatts.

Greg (01:10:43):

And where?

Audio: Duane Davis (01:10:49):

Greenblatts on Sunset.

Speaker 6 (01:10:49):

Hey Greg, do you want to go back to when they first got in contact?

Greg (01:10:52):

Yeah, we can start there. What year did Flint introduce you to Zip?

Audio: Duane Davis (01:11:08):

It was maybe like '91, '92.

Greg (01:11:09):

Oh, way back then?

Audio: Duane Davis (01:11:10):

Yeah.

Greg (01:11:17):

Okay. Early '90s. Where does Flint introduce you to Zip at?

Audio: Duane Davis (01:11:22):

We had a baseball game. The pitcher, they was calling him Dwight Gooden. "We got a Dwight Gooden. We used to play for cases of Champagne." They ran their team and we played in the South Side.

Darren (01:11:38):

South Side Santana kind of like thing? Or just Flint?

Audio: Duane Davis (01:11:41):

They really think he an imposter. The Santana's dude. You know what I'm saying? Because he just really ... They charged him, you know what I'm saying? He wanted to join their game. They was the baddest gang back then, but they don't really recognize him. They be yelling they, asking them for money and everything.

Greg (01:12:01):

But it was Santana's baseball team?

Audio: Duane Davis (01:12:03):

No. It was some LA dudes. It was Kelly, Keyshawn Johnson, a few more dudes.

Speaker 6 (01:12:12):

So is it like a high school field?

Audio: Duane Davis (01:12:14):

No, a park. South Park.

Speaker 6 (01:12:14):

South Park.

Darren (01:12:21):

So y'all basically played against them?

Audio: Duane Davis (01:12:23):

Yeah.

Darren (01:12:24):

How many occasions did that happen?

Audio: Duane Davis (01:12:26):

About three or four times.

Darren (01:12:26):

Three or four times?

Audio: Duane Davis (01:12:27):

Yeah.

Darren (01:12:29):

All in one summer or was it over a period of like a couple years or just all in one summer?

Audio: Duane Davis (01:12:31):

Maybe like a year, within a year.

Speaker 6 (01:12:32):

Can I step our for a second? He wants to talk.

Darren (01:12:32):

Were you the captain of your team?

Audio: Duane Davis (01:12:43):

Yeah.

Darren (01:12:43):

Who was the captain of the other team?

Audio: Duane Davis (01:12:43):

Flint?

Darren (01:12:46):

So basically your team and his team, whoever he brought, most of your players were what? South Side.

Audio: Duane Davis (01:12:50):

Yeah.

Darren (01:12:52):

And he bought a lot of LA cats.

Audio: Duane Davis (01:12:59):

We had a little barbecue and we kicked it up. When we lost the game, we paid them the bottles. Went to the store and paid them a bottle.

Greg (01:13:07):

So you played for what, Champagne?

Audio: Duane Davis (01:13:10):

Yeah. Dom Cristal, yeah.

Greg (01:13:17):

Okay. So that's early '90s. Flint's was busy doing PCP even back then?

Audio: Duane Davis (01:13:24):

I can't say. He was kind of starving then.

Greg (01:13:26):

Okay.

Audio: Duane Davis (01:13:26):

They used to always ask me for money and all that shit.

Greg (01:13:26):

Okay.

Audio: Duane Davis (01:13:34):

But '91, then we went out there in '91.

Greg (01:13:36):

To New York?

Audio: Duane Davis (01:13:37):

Yeah, about three weeks.

Darren (01:13:41):

Because he brought Zip to the last baseball game or one of the first baseball games. Did Zip come to all three games?

Audio: Duane Davis (01:13:48):

Yeah. Yeah, he was a pitcher.

Darren (01:13:53):

Okay.

Audio: Duane Davis (01:13:53):

They used to call him Dwight Gooden. Dwight Gooden for y'all.

Darren (01:13:59):

That's how Flint introduced him as Dwight Gooden, boom. He came in, he was a pitcher.

Audio: Duane Davis (01:14:01):

He doing a fancy curve ball and all that. Yeah. We was good athletes in South side. A lot of good athletes.

Darren (01:14:08):

Kurt Landon was a good athlete.

Audio: Duane Davis (01:14:09):

Sure.

Greg (01:14:11):

Is that who you know at Zip?

Audio: Duane Davis (01:14:13):

Yeah. Now he got hair now. That might be old. [inaudible 01:14:25]

Darren (01:14:25):

So when you went out there in New York, where'd you guys stay then? Who'd you stay with?

Audio: Duane Davis (01:14:36):

We stayed at different ... we stayed at, was that in the Bronx? What is that? Best Western in the Bronx.

Darren (01:14:43):

I don't mean to take up an interview, but-

Audio: Duane Davis (01:14:44):

We stayed at his house a couple times during a period of time.

Greg (01:14:50):

At Zip's house?

Audio: Duane Davis (01:14:51):

Yeah. It was a little apartment.

Greg (01:14:52):

Apartment.

Audio: Duane Davis (01:14:53):

It was in Jersey City.

Greg (01:15:02):

Okay. When you're out in New York, do you meet Puff out there?

Audio: Duane Davis (01:15:08):

Not doing that. I met him. He gave a party at a little club down in Santa Monica on Paradise.

Darren (01:15:17):

Where Paradise 24 used to be in?

Audio: Duane Davis (01:15:20):

Yeah, it was Paradise, yeah. On Santa Monica [inaudible 01:15:21]. Yeah. That's where I first met him.

Greg (01:15:24):

That's okay, Keefe. We're going to try to keep this in order. So we'll get to that part.

Audio: Duane Davis (01:15:28):

Okay.

Greg (01:15:28):

So now you're in New York with Zip and Flint. And what's happening in New York? Why are you guys out there?

Audio: Duane Davis (01:15:37):

I had brought some birds out there and they kind of like ran the sham. I guess he gave Fats the money a couple days later. He jumped in the cab and leave. So I'm still out there like three weeks trying to get my fucking money. You know what I'm saying?

Greg (01:15:56):

Fats fucked you over?

Audio: Duane Davis (01:15:57):

That's what it looked like. You know what I'm saying? So what's the name gave me the rest of the cabs and said, "I gave Flint the money."

Darren (01:16:06):

How many birds did you have that he took there?

Audio: Duane Davis (01:16:07):

Three.

Darren (01:16:07):

Just three birds? Okay.

Greg (01:16:25):

Because Zip tells you that he already gave Flint the money, Flint's phoned out.

Audio: Duane Davis (01:16:28):

Yeah.

Greg (01:16:29):

And then Zip gives you the remainder of the money?

Audio: Duane Davis (01:16:31):

Yeah.

Greg (01:16:32):

How much was the remainder?

Audio: Duane Davis (01:16:34):

Like 17,000.

Greg (01:16:36):

Why was he playing baseball? Do you know?

Darren (01:16:39):

If I can just tell you something. Do you know what brought Zip out here? Because he's originally from New York.

Audio: Duane Davis (01:16:43):

Yeah.

Darren (01:16:44):

What was he out here for?

Audio: Duane Davis (01:16:45):

He just come out and party and have fun.

Darren (01:16:48):

Okay. But he never have a house out here where he lived or anything like that that you remember?

Audio: Duane Davis (01:16:50):

No, he never took me to no house.

Darren (01:16:53):

So every time he was here, he was just visiting basically?

Audio: Duane Davis (01:16:55):

Yeah.

Greg (01:16:57):

Didn't know him to have a girl out here that he'd spend, he'd have a girl out here he'd spend time with?

Audio: Duane Davis (01:17:04):

He had a lot of girls. Nobody played with Zip.

Greg (01:17:04):

Yeah, yeah, yeah. One particular like that.

Speaker 6 (01:17:08):

So when Zip's playing baseball with Santana, it's just coincidence that he's out here. He's just out here for fun, right?

Darren (01:17:17):

You ever seen this girl before? Maybe that? Tony, I mean. Maybe Tony. They call him Tony.

Audio: Duane Davis (01:17:26):

I ain't ever seen her.

Darren (01:17:27):

So you ain't ever seen her talking to-

Greg (01:17:28):

No, I guess.

Darren (01:17:32):

So he didn't have no main girl. Just a bunch of girls he's just flipping or whatever. Y'all just player player to each other?

Greg (01:17:39):

Okay. All right. So you're out there, you're doing some dope with Zip. And then what happens next in your guys' relationship? You come back to Compton, you're running your game out here and how you just continue to have an ongoing relationship with Zip or do you always have to go through Flint?

Audio: Duane Davis (01:17:59):

Shit, if they fuck me, you think I'm going to them up? I had three, four birds. I'm ballin'. Fuck them. You what I'm saying?

Darren (01:18:05):

So you never got paid for the three birds after you got ... When did you get paid for the.

Audio: Duane Davis (01:18:12):

They gave me the 17,000 and he said, "Fat saving the rest of the money." So I just, okay, fuck it. When he come around.

Darren (01:18:16):

So you just take it. You didn't even get that money never?

Audio: Duane Davis (01:18:18):

Yeah. That's right. Then he come buy two, 10 sometimes. He had to be all COD. No front season.

Darren (01:18:29):

So he used to get a lot of the stuff from you?

Greg (01:18:32):

No, he's talking about Zip.

Audio: Duane Davis (01:18:37):

Flint. Flint. He's just gone. After he did that.

Greg (01:18:37):

Right.

Audio: Duane Davis (01:18:37):

COD from then on.

Speaker 6 (01:18:42):

But you just let that first one go, huh? He was ballin' back then. [inaudible 01:18:52] business, huh?

Audio: Duane Davis (01:18:53):

Yeah, you on yourself. That's how I took it.

Darren (01:18:56):

So he would keep your number. They would keep coming to you, but he'd be COD, cash on delivery, buying birds over the years?

Audio: Duane Davis (01:19:02):

He went to jail maybe. We did about two or three transactions. He went to jail after that. And I asked him why the fuck you would go out to Miami and you know I got the shit here. That's what you get.

Darren (01:19:15):

Because that's what he's doing, going to Miami and getting some stuff? And he got popped?

Audio: Duane Davis (01:19:19):

That's where he got popped. Yeah.

Speaker 6 (01:19:21):

But when you brought the stuff back to New York that first time, who was that stuff for?

Audio: Duane Davis (01:19:25):

For Zip.

Speaker 6 (01:19:27):

It was for Zip?

Audio: Duane Davis (01:19:28):

Yeah.

Darren (01:19:29):

But Flint brokered it. He kind of was the middle man?

Audio: Duane Davis (01:19:31):

Yeah.

Greg (01:19:35):

Okay. After you have your little deals with Flint, do you end up having, you start doing anything with Zip, like directly with Zip back and forth to New York?

Audio: Duane Davis (01:19:43):

When he went to jail.

Greg (01:19:48):

Flint did?

Audio: Duane Davis (01:19:49):

Yeah. He called say Zip snitching. So I was like, Zip snitching? And he's like, "Yeah, man." I said, "Well, why the fuck your nephew was with him every day?" You know what I'm saying? That don't sound good. Maybe he trying to keep me away from him. I mean, that's what Zip came and said, "Man, he just trying to keep us away, man. We can get money."

Greg (01:20:10):

You said his nephew was with him all the time?

Audio: Duane Davis (01:20:12):

Little Dee and Derek.

Darren (01:20:14):

Derek and Darryl and want to [inaudible 01:20:18] Because what, they hung out with Zip a lot?

Audio: Duane Davis (01:20:21):

Yeah, they was hanging out with Zip.

Darren (01:20:23):

When Flint was in jail?

Audio: Duane Davis (01:20:23):

Yeah.

Darren (01:20:24):

He was making money with him or he was just hanging with him for the girls and stuff?

Audio: Duane Davis (01:20:28):

No, I really wasn't doing they business. I was just handling my business, man. They was with the girls. They do the cars, all that shit.

Greg (01:20:40):

Okay. All right. So time goes on. This is through the early '90s. Flint gets popped in Miami. And then anything else significant regarding Zip and Flint? You guys just all got your drug games going on? No talk or issues with any of the. No talk or issues with anything about Tupac at those early stages?

Audio: Duane Davis (01:21:09):

No. He was still with them all digital underground or somebody, them other people.

Darren (01:21:15):

So he hadn't been playing death row yet?

Audio: Duane Davis (01:21:17):

No.

Darren (01:21:17):

But when Flint and Zip fell out, there wasn't no beating just word. He snitching, he's snitching.

Audio: Duane Davis (01:21:21):

That's when he said that was some bullshit so we could stay away from each other. So that was it? Yeah. I said, "Why your nephew still hanging with him? If he's snitching, that don't look good."

Speaker 6 (01:21:32):

So then you hooked back up with Zip because you know it was bullshit?

Audio: Duane Davis (01:21:39):

Then I did that water deal with him with Fat Bernard that's in the paperwork already.

Greg (01:21:42):

Okay. Okay. So you do the water deal. Was that pretty accurate what you said regarding the water deal that you guys fucked Patrick over?

Audio: Duane Davis (01:21:52):

Patrick Bernard?

Greg (01:22:00):

Yeah.

Audio: Duane Davis (01:22:11):

I didn't say we fucked him over.

Greg (01:22:11):

Well, he did.

Audio: Duane Davis (01:22:11):

I think he got his money. He didn't? Okay, he probably didn't. 15 years ago. Deals went down between then.

Greg (01:22:20):

Now why is the PCP deal getting brokered by you and not Flint? Why isn't Zip going directly to Flint?

Audio: Duane Davis (01:22:30):

Because he was in jail.

Greg (01:22:31):

Oh, okay.

Darren (01:22:36):

So you became closer with Zip while Flint was in jail and you started doing business with him?

Audio: Duane Davis (01:22:40):

Yeah, we started hanging out when he come to LA he'd come and hang out with me. We'd go partying.

Darren (01:22:42):

First half. And everybody was cool on Flint at that time. Man, because he was in jail, whatever.

Audio: Duane Davis (01:22:55):

Man, this don't match neither. 100 keys. You get three years. Oh, son of a bitch. Oh, Lord.

Darren (01:22:56):

Y'all thought he was just like, he was telling man. Nobody would've messed with him.

Audio: Duane Davis (01:23:11):

I don't know, man. We know in Cory, 200 Keys, in Columbus, Ohio, you give fucking 30 bucks. Oh yeah. I got more than that on a phone call.

Darren (01:23:15):

Who's your lawyer back then we got that time?

Audio: Duane Davis (01:23:21):

[inaudible 01:23:21] Yeah, that shit don't add up where.

Darren (01:23:25):

So you and Zip keep doing deals, doing deals in between. At some time, how does Pac or Big get brought up into the situation as far as you?

Audio: Duane Davis (01:23:37):

We just started kicking it and we met the boy at the, he gave ... what was that? A BET party for the BET awards. This is like '92, '93 at the club in Santa Monica. And Mary J was there.

Darren (01:23:53):

Paradise.

Audio: Duane Davis (01:23:54):

That tall dude, the nephew used to have dreads. He would after that. What's his name?

Darren (01:23:54):

Busta Rhymes?

Audio: Duane Davis (01:24:03):

Busta Rhymes.

Darren (01:24:04):

At Paradise? That was the time?

Audio: Duane Davis (01:24:11):

Yeah. [inaudible 01:24:11] He thought he was all big shit. He stopped. We was going to beat the fuck out of that boy. But he wasted a drink on me and I'm like, "What the fuck" That's where I met the first day I met Puff.

Darren (01:24:25):

Zip introduced him. He said, "This is my boy." What he introduced him as? "This my friend, this is my nephew."

Audio: Duane Davis (01:24:28):

My boy.

Darren (01:24:29):

This is my boy. Didn't even see themselves as relatives or anything like that? Like that was his nephew or is that how he acted towards him?

Audio: Duane Davis (01:24:35):

No, this is my boy, but that's Puff. Okay. And after that, they used my car on the video.

Darren (01:24:44):

Which car was that?

Audio: Duane Davis (01:24:44):

The '64 Chevy I had.

Darren (01:24:46):

What color was it?

Audio: Duane Davis (01:24:50):

Brown. Usher, he had Usher.

Darren (01:24:50):

It was in Usher's video?

Audio: Duane Davis (01:24:51):

It was Usher video. Puff was driving the car. That's when he had LA had him for a while.

Darren (01:25:03):

You remember the song?

Audio: Duane Davis (01:25:06):

Can I Get With It? That was his first song ever. Usher's first song ever. He was in a Laker uniform. And he had the little kid dancing on my car when it got back. It was fucked up and he paid to get it repainted. They sent me 2,500 for that.

Darren (01:25:25):

Puff did?

Audio: Duane Davis (01:25:25):

Yeah.

Darren (01:25:27):

You directly? Were you dealing with him directly at this time or because of the car or were you dealing with somebody in his management team?

Audio: Duane Davis (01:25:33):

No.

Greg (01:25:33):

How'd you get the money? Was it a cash? Check?

Audio: Duane Davis (01:25:34):

Check. from-

Greg (01:25:35):

Bad Boys?

Audio: Duane Davis (01:25:35):

Yeah.

Greg (01:25:38):

In the name of Keith Davis?

Audio: Duane Davis (01:25:40):

No, we put it in Compton Hydraulics.

Darren (01:25:42):

Oh, okay.

Audio: Duane Davis (01:25:56):

That's when we owned the hydraulic one.

Greg (01:25:56):

I'm sorry, what's the cat's name again? The video dude?

Speaker 6 (01:25:57):

Usher.

Darren (01:25:58):

Usher.

Greg (01:26:00):

Okay.

Darren (01:26:00):

Can I Get With It?

Greg (01:26:02):

That was '92?

Darren (01:26:03):

What year was that again? '92.

Audio: Duane Davis (01:26:07):

'92, '93 years.

Darren (01:26:08):

He was like 16, 15 years old.

Audio: Duane Davis (01:26:08):

14. Yeah and a little kid. "Mama, can I buy the car?" Yeah.

Darren (01:26:15):

And then after that, was your relationship right with the deal with Zip?

Audio: Duane Davis (01:26:19):

Yeah. We used to go, go to the club, pop the bottles, all the bitches come.

Darren (01:26:25):

Good style, right?

Audio: Duane Davis (01:26:26):

Yeah.

Darren (01:26:26):

How often would he come out here? Zip?

Audio: Duane Davis (01:26:30):

Shit. Like once a month.

Darren (01:26:33):

Did Puffy have a place out here? Didn't he have a place out here? Where he stayed at? House?

Audio: Duane Davis (01:26:37):

Back then, no. No, he didn't. He was scared shitless out here because of the voice.

Darren (01:26:45):

So that beef had started by then?

Audio: Duane Davis (01:26:47):

No, it started ... They went out for that award in New York and he said, "You don't want to be here. Fuck you. You want to be your own video, [inaudible 01:26:58]" That's when it started. Then we seen right after that, at that summer jam, we on the stage drinking water, smoking and he like, "Hey Keffe D, let me holler at you. So how the fuck you meet them dudes, dog?" "Same way I met you, motherfucker."

Greg (01:27:17):

Suge said that?

Audio: Duane Davis (01:27:18):

Yeah. Suge asked me, "How you meet them dudes?" I'm like, "Man, same way I met you."

Darren (01:27:23):

That was at the '95 Summer Jame summer festival?

Audio: Duane Davis (01:27:27):

'95. That's when One More Chance was out. [inaudible 01:27:29]

Greg (01:27:28):

Go back a little bit. We go back. Zip is coming out once a month. You met Puff at the Paradise Club at the BET Awards. He asked you to use your car, you use your car, you end up getting damaged. He pays you. And then Zip's coming out once a month. Prior to the times when you start talking about the beef with Pac and Suge, how many times do you meet Puffy?

Audio: Duane Davis (01:28:02):

How many times we met him before the beef day? Maybe about three, four times.

Greg (01:28:03):

Three, four times. Always like at a social event?

Audio: Duane Davis (01:28:06):

Yeah.

Greg (01:28:06):

Okay.

Audio: Duane Davis (01:28:07):

Greenblatts was mostly, that's where we would start.

Greg (01:28:09):

Green Patch?

Audio: Duane Davis (01:28:09):

Greenblatts and on Sunset by the [inaudible 01:28:16].

Greg (01:28:09):

Oh.

Audio: Duane Davis (01:28:16):

It's a little upstairs and just like a deli.

Greg (01:28:22):

It's called ... Right next to the comedy store?

Audio: Duane Davis (01:28:25):

Yeah. Then there's a strip club and the deli, yeah.

Greg (01:28:30):

Okay. So you see him at these different events out here, just kind of socialize, shoot the shit. Nothing going on. And then does the incident at Summer Jam take place before Puffy gets up on stage and makes that statement about if you don't want to produce a read in your videos? Which happens first?

Audio: Duane Davis (01:28:58):

I don't know. I would have to check the dates. I'm quite sure that the Summer Jam happened first. He got jealous because Biggie took over the record charts. You know what I'm saying? Bam. Biggie, that One More Change was hot.

Darren (01:29:13):

Yeah. So when you saw him at the Summer Jam, he wasn't mad at you for being with them like he was trading. He was just saying how you knew them.

Audio: Duane Davis (01:29:20):

"How the fuck you meet them dudes." Yeah.

Darren (01:29:22):

He didn't mess with you like that anybody. He couldn't get mad at you, right? It wasn't an issue. Okay. So you meet him there. Who was all at that summer jam? Was Clint with you then? Was he at the jail? He was in jail?

Audio: Duane Davis (01:29:37):

He was in jail.

Darren (01:29:38):

Zip was with you?

Audio: Duane Davis (01:29:39):

Zip. You know your boy Wynn, the face that you love.

Darren (01:29:42):

He's not even like that, man.

Audio: Duane Davis (01:29:49):

No, he told me that. He just afraid he just love. Man. I've been with that dude for 43 years, dude. Give him my number.

Darren (01:30:04):

Man, show him some love. He ain't like that, man. It ain't like that.

Audio: Duane Davis (01:30:07):

I know. He's just trying to help himself.

Darren (01:30:07):

I didn't even say that, man. Just let it go.

Audio: Duane Davis (01:30:09):

Right. Move forward. I'm a dog, though. Fuck it.

Darren (01:30:14):

Y'all see him?

Audio: Duane Davis (01:30:16):

I got to. Shit. He gave me the hug of our life. You gave a hug of your life? He gave me the hug of his life.

Greg (01:30:27):

So when you're at the Summer Jam, you're up on stage and Puff is there, right?

Audio: Duane Davis (01:30:30):

Yeah.

Greg (01:30:30):

Suge says, "Hey, how you know these guys?" You tell-

Audio: Duane Davis (01:30:32):

How did we leave off? He was on the other side of the stage over here and they left off this way. I came back in the back of the stage. Like, "Keffe D, let me holler at you." Went over there and he told me, "Yeah, how you beat them dudes?" "Same way I met you motherfucker." He don't know I helped his ass out a lot.

Greg (01:30:53):

Well, when you say, "Same way I met you," I'm assuming that you know these guys because of the drug trade. Is that how you knew Suge?

Audio: Duane Davis (01:31:00):

No. I put him ... When I started that music industry, I mean that death row shit, man.

Greg (01:31:09):

With Pat.

Audio: Duane Davis (01:31:11):

I did the work for that shit.

Greg (01:31:12):

Okay. All right. Well, we'll get to that. But that hadn't even started yet really. Okay. In '95, you've already got some kind of little. You've got your relationship with Suge because of the money that you gave him from Pat, right?

Audio: Duane Davis (01:31:26):

We've been knowing each other before him and Pat even met. We was little kids.

Darren (01:31:28):

Same neighborhood.

Audio: Duane Davis (01:31:28):

No, no. Football team great accompany.

Greg (01:31:34):

Okay. That's kind of going to be a different issue. Let's stay on track here.

Darren (01:31:40):

So after the Superfest, you say that to Suge and then you walk off. Everything's cool. Was Puffy scared of Suge at that time?

Audio: Duane Davis (01:31:46):

No, he wasn't.

Darren (01:31:48):

Okay.

Audio: Duane Davis (01:31:49):

Then one day me and Zip rolling up greenly and the phone rang and he wanted to speak to me like, "Man, you think it's cool to come out there for our concerts?" I said, " Why you can't come?" Talking about big boy CEO. I'm like, "Man, that dude ain't nothing. Come on."

Darren (01:32:08):

Is Zip on the phone with you?

Audio: Duane Davis (01:32:09):

No. He called Zip phone and I was in the car saying, "Hey boy, I want to speak to you." "Hey man, you think its cool to come out there?" I'm like, "Yeah, it's cool, man. Just give us like 45, 50 tickets."

Speaker 6 (01:32:20):

So Puff called Zip's phone. Zip gives you the phone.

Audio: Duane Davis (01:32:29):

Yeah.

Speaker 6 (01:32:30):

Puff says to you, "Is it cool to come out there?" You said, "Yeah, just give me some tickets."

Audio: Duane Davis (01:32:34):

He gave me tickets.

Darren (01:32:37):

So he didn't give you no money, no security, nothing like that, just tickets?

Audio: Duane Davis (01:32:39):

He gave us some tickets and I brought the crew. Yeah. We went up there deep. They didn't show up.

Darren (01:32:50):

And that's the big concert you're talking about, the tour that they were on with Jodeci and all that?

Audio: Duane Davis (01:32:55):

This one we brought out the forest.

Darren (01:32:55):

And that's the Anaheim.

Audio: Duane Davis (01:32:58):

We went and brought 12 people to the one in San Diego.

Darren (01:33:02):

12 cars?

Audio: Duane Davis (01:33:03):

Probably like 12 people.

Speaker 6 (01:33:04):

Yeah. And you're saying he didn't show up to, are you talking about Suge?

Audio: Duane Davis (01:33:09):

Suge? They didn't show up, no.

Darren (01:33:15):

Okay. So no problems at the concert. They're having a good time. Pop bottle's already out here the whole time. Nothing else happened. No other events happened, no problems during that time, right?

Audio: Duane Davis (01:33:25):

Right. No problem.

Darren (01:33:27):

Okay. You and Zip keep doing what y'all doing, no business or whatever. What's the next little thing that might've happened as time went by? Because by then the beat should have jumped off or been coming that way.

Audio: Duane Davis (01:33:36):

Yeah, that's where it started. I think the boy in Atlanta got shot.

Darren (01:33:42):

Jai.

Audio: Duane Davis (01:33:43):

Is that shooting partner from ... I think he's from Capital Park.

Darren (01:33:47):

Yeah.

Audio: Duane Davis (01:33:48):

He got shot. That's what really scared the boy.

Darren (01:33:55):

Do you know anything about that murder? Did he do it? I mean, did Puff have something to do with it?

Audio: Duane Davis (01:33:58):

His boy shot him a-

Darren (01:34:00):

Okay. So that's the truth? You know for a fact or you know from hearing?

Audio: Duane Davis (01:34:02):

I heard from hearing.

Darren (01:34:07):

Inside stuff or just street stuff?

Audio: Duane Davis (01:34:10):

Inside.

Darren (01:34:12):

So Wolfe did ... Wolfe did kill him?

Audio: Duane Davis (01:34:15):

Yeah.

Darren (01:34:16):

All right.

Speaker 6 (01:34:17):

There were some talk that some south siders were there too. Is that true?

Audio: Duane Davis (01:34:23):

In Atlanta? No, we wasn't there.

Darren (01:34:23):

Nando wasn't down there?

Speaker 6 (01:34:24):

He wasn't hanging out there?

Audio: Duane Davis (01:34:26):

We wasn't there.

Speaker 6 (01:34:26):

Okay.

Darren (01:34:28):

So Big Jay gets killed.

Greg (01:34:31):

Real quick, you said that Puff calls you on the phone. You tell him, "I need like 50 tickets and we'll make sure everything's cool out here." And that's the Anaheim concert.

Audio: Duane Davis (01:34:42):

Yeah.

Greg (01:34:42):

Then when you go to that Anaheim concert, that's when you guys start finding-

Audio: Duane Davis (01:34:45):

That's what he said in front of all the people. Andre Harrell, he was there.

Greg (01:34:54):

Andre who?

Audio: Duane Davis (01:35:01):

Harrell.

Greg (01:35:01):

Harrell.

Darren (01:35:01):

Harrell.

Audio: Duane Davis (01:35:01):

Yeah.

Darren (01:35:01):

Harrell.

Audio: Duane Davis (01:35:01):

Who else was there with him? It was just him two.

Greg (01:35:05):

Hold on. Specifically Andre Harrell, you.

Audio: Duane Davis (01:35:09):

About 40 something south sides.

Darren (01:35:26):

From New York? Puffy, that was on the Andre Harrell and him?

Audio: Duane Davis (01:35:26):

Yeah and Zip. We picked up Zip from the airport, Long Beach Airport.

Greg (01:35:27):

Okay. So it's Harrell, you, Puffy, Zip, and a bunch of South siders. And Puffy makes kind of an announcement?

Audio: Duane Davis (01:35:33):

Yeah. That was stupid as hell too.

Greg (01:35:36):

What did you actually hear? What was the words, the best you can remember what he says?

Audio: Duane Davis (01:35:42):

Shit. He said he would give us anything for them dudes heads.

Greg (01:35:46):

Give you anything for these guys' head?

Audio: Duane Davis (01:35:48):

Yeah.

Greg (01:35:49):

Where were you exactly?

Audio: Duane Davis (01:35:56):

He had the Navy SEALs in one of them over here. We was in that middle one. The middle one-

Audio: Duane Davis (01:36:00):

... here. We was in that middle room. The middle room was like a living room, like a suite. And the other room was like a bedroom. We was in there shooting dice. D-Mac was there. That other dude, what's his name? Chuck? We was shooting dice. OJ's daughter, she was in the back room.

Greg (01:36:21):

Did she hear this being stated?

Audio: Duane Davis (01:36:24):

It was mostly [inaudible 01:36:27]. This was after the concert. Before the concert, he stated that. After the concert, that's when everybody came back to the room, get a little party, shooting dice.

Greg (01:36:34):

Okay. Was D-Mac there before the concert?

Audio: Duane Davis (01:36:37):

No.

Greg (01:36:38):

D-Mac wouldn't have heard that?

Audio: Duane Davis (01:36:40):

No, he wouldn't have heard that.

Audio: Speaker 1 (01:36:41):

So were you in a hotel? Were you at the venue?

Audio: Duane Davis (01:36:44):

We was at the hotel when he said that.

Audio: Speaker 1 (01:36:46):

At the hotel? What hotel?

Audio: Duane Davis (01:36:48):

That was at, in Anaheim, the Hilton or somewhere.

Audio: Speaker 1 (01:36:52):

Okay.

Audio: Higgins (01:36:53):

Was it Sheraton or the Hilton?

Audio: Duane Davis (01:36:53):

I think it was at Hilton.

Audio: Speaker 1 (01:36:55):

So you were like in the suite at the Hilton or something?

Audio: Duane Davis (01:36:56):

Yeah.

Audio: Speaker 1 (01:36:56):

Okay.

Audio: Duane Davis (01:37:02):

I think it was Halloween night because she had on a catsuit. Treggs had her on the bed like, "Make a meow for me, baby. Tee-tee." OJ's daughter. She was a bad motherfucker, boy.

Darren (01:37:14):

Back then?

Audio: Duane Davis (01:37:16):

Yeah, I wanted to hit that thing. Yeah.

Greg (01:37:20):

You said there were Navy SEALs in the other room?

Audio: Duane Davis (01:37:22):

Yeah. [inaudible 01:37:23].

Greg (01:37:23):

What for?

Audio: Duane Davis (01:37:24):

To protect him. He was that scared of that dude.

Darren (01:37:27):

He had hired some Navy SEALs?

Audio: Duane Davis (01:37:28):

I swear to God.

Audio: Speaker 1 (01:37:30):

Like you know they were SEALs or did you-

Audio: Duane Davis (01:37:37):

He told me they were SEALs. Navy SEALs. And they had on their little ear things and everything.

Darren (01:37:39):

So this is after Jake got killed?

Audio: Duane Davis (01:37:41):

Yeah.

Darren (01:37:41):

So he was on point, he was worried about something happening.

Audio: Duane Davis (01:37:44):

Yeah.

Darren (01:37:44):

She got mouthed off about a bunch of different stuff, so he was scared it was going to-

Audio: Duane Davis (01:37:47):

He was scared to death, yeah.

Darren (01:37:47):

Okay.

Greg (01:37:47):

Okay.

Audio: Duane Davis (01:37:47):

Was he like, "Man."

Greg (01:37:54):

Now why does he, if he's got these Navy SEALs guys out there protecting him, why does he call you and ask you for protection?

Audio: Duane Davis (01:38:02):

Would you rather have some Navy SEALs or some gangsters?

Greg (01:38:04):

Well, yeah, that's my point. I mean, if you have a choice between the two, you've got some trained gun-

Audio: Duane Davis (01:38:09):

Yeah. [inaudible 01:38:13].

Greg (01:38:12):

Yeah.

Audio: Duane Davis (01:38:13):

You would want the gangsters, because the Bloods, they'll tear them dudes' ass up, man. Come on, man.

Greg (01:38:24):

[inaudible 01:38:25].

Audio: Duane Davis (01:38:24):

Yeah. They'll tear their ass up, dog. I swear to God, you know they would. We would have went in there [inaudible 01:38:25]

Greg (01:38:24):

Man, I ain't seen a lot of gangsters that can hit their target, man. But they don't know like we know, man.

Audio: Duane Davis (01:38:28):

[inaudible 01:38:28]

Darren (01:38:28):

Man.

Audio: Duane Davis (01:38:28):

We would have went in that room and tore their asses-

Darren (01:38:28):

[inaudible 01:38:28] Navy SEAL.

Audio: Higgins (01:38:31):

[inaudible 01:38:32] a bigger crew by like three or 400 [inaudible 01:38:34].

Greg (01:38:34):

Navy SEALs would kill anybody they see.

Darren (01:38:37):

[inaudible 01:38:37] some guys with guns. They can go in there and shoot it out with them. They would have wiped the floor with them, man. But anyway.

Greg (01:38:44):

All right, all right. So he's got both. He's got his legit security and then he's got his gangsters.

Audio: Duane Davis (01:38:49):

Yeah. Yeah.

Darren (01:38:54):

Let me ask you a quick question. When you guys rode, who was all with you as far as the main crew who rode with you when y'all was with Puff, hanging out with him or bodyguarding, whatever you want to call it? You, who else?

Audio: Duane Davis (01:39:05):

Fasty Love.

Darren (01:39:11):

You, Winn.

Audio: Duane Davis (01:39:12):

Me, Winn, Corey. Corey sometime. Lane, all of us. The little crew.

Darren (01:39:19):

The whole crew.

Greg (01:39:20):

Well, that crew that day, who was there that day? At Anaheim.

Audio: Duane Davis (01:39:23):

At Anaheim?

Greg (01:39:29):

Mm-hmm.

Audio: Duane Davis (01:39:29):

Everybody.

Darren (01:39:29):

Everybody?

Audio: Duane Davis (01:39:31):

Yeah. Whole fucking neighborhood.

Greg (01:39:35):

Okay. Give us five names of people who would say, "Yeah, we heard Puffy say that."

Audio: Higgins (01:39:42):

They don't have to come from [inaudible 01:39:44]

Audio: Duane Davis (01:39:43):

Al, Corey, Winn. Dirt Rock. All of them would tell you shit. I'm quite sure they did talk to y'all already.

Darren (01:39:53):

Al. Just all the main crew? Was Duck there? Was Duck there?

Audio: Duane Davis (01:39:57):

No. No, he wasn't there.

Darren (01:39:58):

He was still away-

Audio: Duane Davis (01:39:58):

He was [inaudible 01:40:00].

Darren (01:40:03):

Okay. Ram [inaudible 01:40:03] because he's on the other side went over there.

Audio: Duane Davis (01:40:04):

No.

Darren (01:40:06):

Just your crew?

Audio: Duane Davis (01:40:07):

Yeah.

Darren (01:40:08):

The Birds, right?

Greg (01:40:11):

So this all, this Anaheim thing had to be after, this would have been after Big Jake got killed.

Darren (01:40:17):

Yeah.

Greg (01:40:18):

Yeah. After Big Jake, right?

Darren (01:40:19):

Yeah.

Audio: Speaker 2 (01:40:20):

That's when it heated up, huh? After Big Jake went down to Atlanta?

Audio: Duane Davis (01:40:22):

Yeah. Yeah.

Audio: Speaker 1 (01:40:25):

But just to make something clear, you said previously one time you went down there with 12 people. Is that different from this?

Audio: Duane Davis (01:40:31):

That was in San Diego.

Audio: Speaker 1 (01:40:32):

Okay.

Audio: Duane Davis (01:40:32):

[inaudible 01:40:32].

Audio: Speaker 1 (01:40:33):

And that's after Anaheim.

Audio: Duane Davis (01:40:35):

This is before Anaheim.

Audio: Speaker 1 (01:40:35):

Okay.

Audio: Duane Davis (01:40:35):

Before Anaheim.

Darren (01:40:37):

So Anaheim was pretty much the last concert, big concert you guys went to, and that's when all that stuff happened as far as Puff saying, "I'll give you all this-"

Audio: Duane Davis (01:40:43):

Yeah, yeah. Yeah.

Darren (01:40:43):

Okay.

Audio: Duane Davis (01:40:45):

Then we went to Vegas at the MGM. They got pigeons and everything, shit. Magic Johnson, they gave a big party out there and we went to that thing.

Darren (01:40:54):

Were they there?

Audio: Duane Davis (01:40:55):

Who?

Darren (01:40:56):

Puff and them?

Audio: Duane Davis (01:40:58):

Yeah. We was smoking weed all night. I ain't ever seen them smoke weed in MGM like that. But man, y'all is crazy as hell. You know what I'm saying?

Audio: Speaker 1 (01:41:05):

They were smoking wherever they want?

Audio: Duane Davis (01:41:07):

Yeah. Had the thing roped off. Yeah, that was some big shot shit. I was like, "Boy, y'all got a cousin in Las Vegas? They'll take your ass to jail for a joint." You know what I mean? [inaudible 01:41:12] Yeah. I'm sorry,

Audio: Speaker 2 (01:41:12):

I'm sorry, go ahead.

Audio: Speaker 1 (01:41:12):

I just wanted to get back to the schedule.

Greg (01:41:24):

Yeah. Just get the timeline in order. Big Jake gets killed in Atlanta. The thing in Anaheim happens after that. At what point, if you remember, is it when Puffy takes the stage and says, "Hey, if you don't want your producer..." Or I'm sorry Big...

Audio: Duane Davis (01:41:38):

Yeah, [inaudible 01:41:39].

Greg (01:41:38):

When does that happen though in relation to these other events? Because we're trying to set the stage here and it's important we get this in order. Had that already happened before Jake gets killed in Atlanta, the bodyguard?

Audio: Duane Davis (01:41:55):

My girl got all that [inaudible 01:41:57], I could go look through that shit, you know what I'm saying?

Audio: Speaker 2 (01:41:59):

That was back in New York, right, when that occurred?

Audio: Duane Davis (01:42:01):

Yeah, when he was on the stage and...

Audio: Speaker 1 (01:42:03):

I think it was-

Audio: Duane Davis (01:42:03):

Really, Wu-Tang was on their ass. They was the one dancing all in their face. You should have started a beef with them, you know what I'm saying? Puffman was like little kids, Junior Mafia. Yeah.

Darren (01:42:17):

I think it happened before [inaudible 01:42:20], yeah, before Jake.

Greg (01:42:21):

So you could see Suge getting up on stage, making fun of Puffy.

Audio: Duane Davis (01:42:24):

Yeah.

Darren (01:42:24):

Because that was like the thing that started-

Audio: Duane Davis (01:42:26):

Oh, dude, it triggered it.

Darren (01:42:26):

... everything. Before anybody got shot, killed, security-

Audio: Speaker 2 (01:42:26):

That was a lot of disrespect.

Audio: Duane Davis (01:42:26):

Yeah, that was disrespect for Puff.

Greg (01:42:34):

That set kind of a emotion for Atlanta.

Audio: Speaker 1 (01:42:36):

That had to be before.

Audio: Duane Davis (01:42:36):

Yeah.

Greg (01:42:39):

All right. Okay. So right now we just got to Anaheim. Let's go back to, you said San Diego was before Anaheim.

Audio: Duane Davis (01:42:44):

Yeah.

Greg (01:42:46):

What happened in San Diego and how'd that develop?

Audio: Duane Davis (01:42:51):

Zip came on the street and said the boy wanted us to come down there to the concert. We jumped in Zip's van and my SS rode down there, about 12 deep. Matter of fact, the Dallas Cowboys stayed in the same hotel room.

Greg (01:43:05):

Okay, let's hold on there just for a second.

Audio: Higgins (01:43:06):

Same hotel?

Audio: Duane Davis (01:43:06):

Same hotel, yeah. Same hotel. Not the same room.

Audio: Higgins (01:43:06):

No?

Greg (01:43:12):

So Zip called you or you were with him?

Audio: Duane Davis (01:43:14):

He came on the street, on Burris, and we jumped in the van, went out there.

Darren (01:43:20):

Now, when you said that you guys going out there for business, like to work with Puff, or just going to have a good time?

Audio: Duane Davis (01:43:25):

Wanted to have a good time.

Darren (01:43:25):

Okay.

Greg (01:43:29):

Okay. So Zip came over, he's sitting in the van. He says, "Hey, my boy wants to come down here?"

Audio: Duane Davis (01:43:34):

Yeah, come down to San Diego.

Greg (01:43:37):

And then from that point, when Zip tells you that, you guys leave that day or is it-

Audio: Duane Davis (01:43:43):

That second. Yeah.

Greg (01:43:45):

Oh, okay. So it's that day you guys go to San Diego?

Audio: Duane Davis (01:43:46):

Yeah.

Greg (01:43:51):

All right. Who drives down there with you?

Audio: Duane Davis (01:43:53):

Who drive down there with me?

Greg (01:43:59):

In the van.

Audio: Duane Davis (01:43:59):

I was in my own car. It was me, Lane, Big Dre, and somebody else. We jumped in and everybody else jumped in the van with him, the party van.

Greg (01:44:13):

What color was that van?

Audio: Duane Davis (01:44:14):

Black.

Greg (01:44:15):

Is that a different one than the one in Vegas?

Audio: Higgins (01:44:19):

When you said he was in a van in Vegas, so was it the same one?

Audio: Duane Davis (01:44:21):

No, he was in that black van in Vegas.

Audio: Higgins (01:44:24):

A van, like Benz.

Audio: Duane Davis (01:44:24):

Yeah, Mercedes Benz.

Audio: Higgins (01:44:27):

Mercedes Benz.

Greg (01:44:28):

Okay, but you did say something about a van in Vegas. We'll get back to that, but you said everybody's in a van acting like a bitch.

Audio: Duane Davis (01:44:33):

Oh, that was a random van we had.

Greg (01:44:36):

Okay.

Audio: Higgins (01:44:36):

No, it's cool.

Greg (01:44:41):

All right. So Dre, Lane, Davis, you're all in what car? You had the...

Audio: Duane Davis (01:44:46):

SS Impala.

Greg (01:44:48):

And everybody else gets in the van with [inaudible 01:44:55]

Audio: Duane Davis (01:44:56):

Yeah. Yeah.

Greg (01:44:57):

And you guys go to San Diego, and where do you guys stay?

Audio: Duane Davis (01:44:59):

I don't remember his name, but the Dallas Cowboys had played San Diego Chargers that weekend.

Audio: Higgins (01:45:07):

Was it near the water or was it on Main Street, the Gaslamp District?

Audio: Duane Davis (01:45:13):

It was the Sheraton or the Hilton.

Audio: Higgins (01:45:15):

You remember seeing Water? Was it off the water?

Audio: Duane Davis (01:45:16):

No, it was at night.

Audio: Speaker 1 (01:45:27):

Had to be a nice place if the Cowboys were staying there.

Audio: Duane Davis (01:45:29):

Yeah, that was my team. Yeah.

Audio: Speaker 1 (01:45:32):

Well, that should be easy [inaudible 01:45:34]

Audio: Duane Davis (01:45:32):

There was a lot of girls who were groupies, businessmen. Yeah.

Greg (01:45:38):

Okay. So you got, you and Zip and the rest of the crew down there. You ran into Puffy at the hotel or at the concert?

Audio: Duane Davis (01:45:43):

We ran into him at the concert, then we went to the hotel after the concert.

Audio: Speaker 1 (01:45:52):

You kind of look like Emmitt Smith, you could have used that.

Audio: Duane Davis (01:45:54):

Yeah. Yeah.

Greg (01:45:58):

Okay, so you go back to the hotel and how's that discussion regarding Tupac and Suge? What happens there?

Audio: Duane Davis (01:46:09):

I don't think he really discussed it then. Well, then we was in the room smoking weed. Smoking weed in the little total broad, what's her name? Keisha with the panther thing. Sat all in your lap. We just having a good time that night.

Greg (01:46:28):

Okay. So no discussion about anything?

Audio: Duane Davis (01:46:29):

No.

Audio: Higgins (01:46:33):

I just want to ask because I'm curious, who paid for y'all rooms at the hotel? When y'all go to the hotel, y'all already have rooms for y'all?

Audio: Duane Davis (01:46:40):

No, we all paid for our own. We had money. We don't do that.

Audio: Higgins (01:46:43):

Oh, y'all paid [inaudible 01:46:43]

Audio: Duane Davis (01:46:43):

They were just getting started really.

Audio: Higgins (01:46:44):

Okay.

Greg (01:46:51):

All right. So San Diego happens. Is there anything else that happens between San Diego and Anaheim?

Audio: Duane Davis (01:46:56):

I don't know if that concert or the thing in Vegas was before Anaheim or... I know Magic Johnson gave a big party here.

Greg (01:47:09):

Okay. Let's go into that. Magic Johnson gives a big party out there.

Audio: Duane Davis (01:47:12):

In Vegas.

Greg (01:47:14):

And you go out there with Zip?

Audio: Duane Davis (01:47:22):

We stayed in Treasure Island. That was the Holyfield and Douglas fight, was it? Was it the Holyfield-Douglas fight? The Night Fan Man. Fan man.

Darren (01:47:42):

Holyfield-Bowe, wasn't it?

Audio: Duane Davis (01:47:42):

Okay. It was the night of that party.

Darren (01:47:42):

Yeah, Holyfield-Bowe.

Audio: Duane Davis (01:47:46):

We stayed at the Treasure Island. Al, they got the rooms for us and everything.

Greg (01:47:51):

Al got the room for you?

Audio: Duane Davis (01:47:52):

Little Al?

Greg (01:47:52):

Yeah.

Audio: Duane Davis (01:48:02):

Yeah. Then we went and met him at the MGM. Him and Zip and Biggie, all of them was there.

Greg (01:48:07):

Okay-

Audio: Duane Davis (01:48:07):

Lance.

Greg (01:48:08):

I'm sorry.

Darren (01:48:08):

When's the first time you met Biggie?

Audio: Duane Davis (01:48:11):

First time I met Biggie was in San Diego.

Darren (01:48:14):

The San Diego concert and everything?

Audio: Duane Davis (01:48:15):

Yeah.

Darren (01:48:16):

He was in the room with y'all, or whatever?

Audio: Duane Davis (01:48:17):

Yeah, smoking weed. Yeah.

Darren (01:48:19):

That's the first time all y'all met him?

Audio: Duane Davis (01:48:20):

Yeah.

Darren (01:48:20):

Okay.

Greg (01:48:20):

Good question.

State (01:48:20):

Break and then play the second half.

Judge (01:48:29):

You read my mind. I was going to do it at about three o'clock, so you beat me to it. We're going to take a recess at this time. During the recess, you are admonished not to talk or converse amongst yourselves or with anyone else on any subject connected to the trial or read, watch or listen to any report of or commentary on the trial of any person connected with this case by any means of information, including without limitation, newspaper, television, internet, radio, or form or express any opinion on any subject connected with the trial until it is submitted to you. We'll have you guys back here at 3:15. Please rise for the jury, everyone.

(01:48:56)
For the record, the jury has exited the room. We'll be in recess.

State (01:49:46):

Thank you.

Defense (01:49:47):

Thank you, Your Honor.

Judge (01:49:47):

Record. Back on record in State versus Davis, C377407. Anything we need to address before bringing the jury back in?

Defense (01:49:54):

Your Honor, if we can, just a quick idea of what the schedule looks like for the next couple days.

Judge (01:50:02):

Okay. Well, from the State or from my perspective? Because I did send it out. The plan is-

State (01:50:10):

Aren't we ending at 3:30 tomorrow?

Judge (01:50:10):

The plan is from 9:00 to 3:30 tomorrow.

Defense (01:50:11):

Right, and so is it just the recordings and-

State (01:50:15):

No, no. We have three people we have to get up tomorrow.

Defense (01:50:17):

Can we do this at the bench, Your Honor?

State (01:50:18):

Can we do this at the bench?

Judge (01:50:18):

Yeah, come on up.

Defense (01:50:18):

Sorry.

Judge (01:54:28):

Yeah. You're fine. All right. Looks like we've got our scheduling issues kind of ironed out a little bit. So at this point, I think we're ready to bring in the jury, unless anyone objects.

Defense (01:54:35):

No, Your Honor.

Judge (01:54:35):

Hearing nothing, let's bring them in.

Bailiff (01:54:37):

Stand for the jury.

(01:54:37)
We have one in the restroom. [inaudible 01:55:17]

Judge (01:55:18):

Okay. We have one juror still in the restroom, so everybody can be seated. And then when our other juror comes in, just rise for him real quick.

Bailiff (01:56:05):

Stand for the juror.

Judge (01:56:12):

Do the parties stipulate to the presence of the jury?

State (01:56:14):

Yes, Your Honor.

Defense (01:56:15):

Yes, Your Honor.

Judge (01:56:19):

You may be seated. All right. It looks like we are still in playing Exhibit 117. State, you may resume at this time.

State (01:56:24):

Thank you.

Greg (01:56:24):

Okay, so Dorrough got you guys the rooms at Treasure Island?

Audio: Duane Davis (01:56:24):

Yeah.

Greg (01:56:32):

Okay. And it's Magic Johnson's party you guys go to with the Holyfield fight. And you remember, who's fan?

Darren (01:56:37):

Fan Man.

Audio: Duane Davis (01:56:37):

Fan Man. Came down on the [inaudible 01:56:43].

Darren (01:56:39):

Oh, yeah?

Audio: Duane Davis (01:56:42):

Yeah. Yeah.

Darren (01:56:45):

Got into the ring and got beat down.

Audio: Duane Davis (01:56:46):

Yeah, they beat his ass.

Darren (01:56:46):

[inaudible 01:56:48]

Audio: Duane Davis (01:56:48):

Rob Newman beat him up.

Darren (01:56:51):

They beat him down.

Audio: Duane Davis (01:56:51):

Yeah. Ooh, boy.

Greg (01:56:51):

I didn't realize that.

Audio: Speaker 1 (01:56:51):

That sucks.

Greg (01:56:51):

Sucks to be an idiot.

Audio: Speaker 1 (01:56:51):

Just playing a joke or something.

Greg (01:56:51):

Oh, man.

Darren (01:57:00):

They threw off their rhythm, man. They was ready to go and this dude come...

Audio: Duane Davis (01:57:05):

It was either him or Buster Douglas. Buster Douglas lost to who?

Darren (01:57:10):

I think that was Bowe-Holyfield because it was a big fight. I remember Rock was Bowe's trainer.

Audio: Duane Davis (01:57:15):

Yeah.

Darren (01:57:15):

So I'm pretty sure, I'm going to check on it, but-

Audio: Duane Davis (01:57:19):

I was with my other girl and we all went down to the MGM with our bottles.

Greg (01:57:28):

After the fight?

Audio: Duane Davis (01:57:29):

After the fight, yeah. Was it Buster Douglas and Holyfield? Was it that fight?

Greg (01:57:42):

We'll figure that out, that detail's not important. So you went to the MGM after the fight and whose room's there?

Audio: Duane Davis (01:57:51):

No, we just met him in the lobby by the bar area, and boom. And he like, "Magic's giving a party," and we all started over there.

Darren (01:58:02):

That's what Puff said? "Magic's giving a party," and then yelled out-

Audio: Duane Davis (01:58:04):

"Let's go over here."

Darren (01:58:09):

And Big was there too?

Audio: Duane Davis (01:58:15):

Big was there. Lance. All them dudes was there.

Darren (01:58:15):

So Puff and Lance were together too? I mean, he was in the same crew. I know they ran together, but anyway, go on. That's all right.

Audio: Duane Davis (01:58:21):

And that's when they was about to fight. Lance and Puff got in each other's faces, you know this little gay ass. Because he had the money.

Darren (01:58:35):

Was D-Mac there too, all the time?

Audio: Duane Davis (01:58:37):

I don't think he was at this one. I don't think he was there.

Greg (01:58:46):

Okay, okay. Okay, so you go to the party and then is there an opportunity where you guys talk with Zip and Puffy again about Tupac and Suge?

Audio: Duane Davis (01:58:57):

I know he said it at that room in Anaheim and a couple times at Greenblatt's.

Greg (01:58:58):

Okay.

Audio: Duane Davis (01:58:58):

Yeah.

Greg (01:59:05):

Okay, so I'll just put that you don't recall.

Audio: Duane Davis (01:59:05):

Excuse me.

Audio: Higgins (01:59:05):

That's all right.

Audio: Duane Davis (01:59:09):

Yeah, and D-Mac told me that Zip got the money, aw man, you know?

Greg (01:59:11):

Okay, hold on.

Darren (01:59:15):

We're going to get to that.

Greg (01:59:16):

Yeah.

Darren (01:59:18):

That's a good point, but we got to work our way up.

Greg (01:59:20):

Okay. So do you remember when that fight was as far as dates? Now we're getting into what? Are we in '96 yet?

Darren (01:59:30):

No. It's still like '94, '95, right? Late '94, early '95.

Audio: Duane Davis (01:59:36):

Oh yeah. When that fight happened.

Darren (01:59:37):

When that fight happened. And then that's the same time, in the beginning, I think, of '95, the BET award season is in the beginning of the year. Suge said that fight came along...

Audio: Duane Davis (01:59:49):

That was a source of the war, he said that.

Darren (01:59:50):

Yeah. You know how long, awards started January, February, March, and then the fight was in the summer, wasn't it? Wasn't it a summertime fight? Was it hot out there?

Audio: Duane Davis (02:00:01):

I think it was winter.

Darren (02:00:02):

So end of the year, end of '94.

Audio: Duane Davis (02:00:06):

Yeah. It was Buster Douglas and Holyfield fight.

Darren (02:00:08):

Okay. All right.

Greg (02:00:11):

Okay. So discussions regarding, "I'll give you anything you guys want to take care of those guys," that's like a year and a half, two years before it ever actually happens?

Audio: Duane Davis (02:00:27):

Maybe about a year.

Greg (02:00:30):

Well, he's killed in late '96.

Audio: Duane Davis (02:00:33):

Yeah.

Greg (02:00:33):

So that would make this, it would have to be late-

Audio: Duane Davis (02:00:35):

'95, late '95.

Greg (02:00:36):

Okay, yeah, that's what I'm saying.

Darren (02:00:39):

So awards early in the year, beef starts.

Audio: Duane Davis (02:00:41):

Yeah.

Darren (02:00:41):

Comes all the way around, the summer go through...

Audio: Duane Davis (02:00:45):

Yeah.

Darren (02:00:45):

[inaudible 02:00:46]

Greg (02:00:46):

Tell us what happened that made it something other than just him frustrated and boasting. And I don't have to give you guys anything, I mean, what made it a specific like, "Hey, I'm serious, I want you guys to kill these guys."

Audio: Duane Davis (02:01:01):

When he told me at the Greenblatt's.

Greg (02:01:04):

How'd that go? What was the conversation?

Audio: Speaker 1 (02:01:07):

And who's he?

Audio: Duane Davis (02:01:07):

Puff.

Audio: Speaker 1 (02:01:09):

Puff said it?

Audio: Duane Davis (02:01:09):

Yeah.

Audio: Speaker 1 (02:01:09):

Okay.

Audio: Speaker 2 (02:01:10):

And this is specifically at Greenblatt's, right?

Audio: Duane Davis (02:01:13):

Yeah.

Greg (02:01:14):

How's it go? How's the conversation go? I mean, "Okay, listen, I'll do it, but I need $500,000 or I've got somebody who will do it, but I need 300." I mean, we need really specific details regarding that.

Audio: Duane Davis (02:01:29):

Yeah. We wanted a million.

Greg (02:01:29):

Okay.

Audio: Duane Davis (02:01:29):

Yeah.

Audio: Speaker 1 (02:01:30):

All right. So you meet him at Greenbacks for lunch or dinner, or what?

Audio: Duane Davis (02:01:33):

This was dinner, in the evening.

Audio: Speaker 1 (02:01:33):

Okay.

Audio: Speaker 2 (02:01:37):

Who else was there?

Audio: Duane Davis (02:01:40):

Shit., All of us. Corey, everybody.

Greg (02:01:43):

And everybody's listening to this conversation?

Audio: Duane Davis (02:01:46):

[inaudible 02:01:46] Huh?

Greg (02:01:46):

Everybody's hearing this conversation between you and Puff?

Darren (02:01:50):

What was he talking about?

Audio: Duane Davis (02:01:51):

He was talking to me. We had went downstairs because when we got there, we was laughing at him because he was with this broad that sucked dick, that sucked every dick in there. He all hogged up kissing with her, we was laughing like [inaudible 02:02:04]. "Man, what you laughing at, dog?" Man, don't just come out here getting any broad, dog." I took him downstairs and he's like, "Man, I got to get rid of them dudes, man. It's going to be a problem."

Audio: Speaker 2 (02:02:18):

Is Zip there with you?

Audio: Duane Davis (02:02:19):

Yeah, Zip was, yeah.

Greg (02:02:19):

At that conversation?

Audio: Duane Davis (02:02:19):

No, he wasn't at the conversation. It was just me and him.

Greg (02:02:28):

So he tells you, "Seriously, man, I need to get rid of these guys." I mean, he's looking at you in the eyes and he's scared.

Audio: Duane Davis (02:02:37):

Yeah. He's scary, dude.

Greg (02:02:38):

He still is, huh?

Audio: Duane Davis (02:02:40):

Yeah.

Darren (02:02:40):

When he asked about it, he always said both of them? Or he said Suge mostly, or he was just always talking both of them?

Audio: Duane Davis (02:02:46):

Yeah, well, he had his boy on after he made the record.

Darren (02:02:50):

No, before that it was just Suge.

Audio: Duane Davis (02:02:51):

Yeah.

Darren (02:02:52):

And then after Hit Em Up came out-

Audio: Duane Davis (02:02:54):

Yeah, yeah. That pissed him off.

Darren (02:02:54):

So he's like, "Kill both of them?"

Audio: Duane Davis (02:02:54):

Yeah.

Darren (02:02:54):

Okay.

Greg (02:02:57):

So there's got to be two separate conversations though.

Audio: Duane Davis (02:03:00):

Yeah.

Darren (02:03:00):

Three or four, right?

Audio: Duane Davis (02:03:00):

Yeah. Yeah.

Greg (02:03:06):

So Anaheim was just about Suge?

Audio: Duane Davis (02:03:07):

Anaheim was about both of them.

Greg (02:03:10):

Okay.

Audio: Duane Davis (02:03:12):

Anaheim was about both of them. He said it in front of all them people. I couldn't believe it. You know what I'm saying?

Darren (02:03:20):

In Anaheim?

Audio: Duane Davis (02:03:20):

Yeah. All of them full of Crips. You know they wanted me to go after his ass.

Greg (02:03:24):

Okay. So he tells you, "I need to get rid of him at Greenblatt's," you and him go downstairs and you tell him, "I'll do it for a million."

Audio: Duane Davis (02:03:32):

Yeah. Then when that shit popped off, Zip like, "Shit, this y'all perfect." I'm like, "Man, we ain't got no pistols," he came up with pistols.

Greg (02:03:45):

Okay, so he says, "You tell him, we'll do it for a million. And he's like, "Okay, I'll do it for a million?"

Audio: Duane Davis (02:03:52):

Yeah.

Greg (02:03:53):

He agrees. You shake on it or something like that?

Audio: Duane Davis (02:03:55):

Yeah.

Greg (02:03:56):

What happened?

Audio: Duane Davis (02:03:59):

Gentlemen. Like, "Man, shit, we'll wipe their ass out quick. It's nothing. Consider that done. That's easy."

Audio: Speaker 1 (02:04:11):

Did he front you any money or anything?

Audio: Duane Davis (02:04:13):

No, he didn't. Well, after it happened, he called, what's her name? Zip. "Is that us? That us? That's us." And the broad was even calling Faith. "Yeah, that's us."

Darren (02:04:26):

She wanted it done too?

Audio: Duane Davis (02:04:29):

She was calling Zip, "Is that us? That's us?" I'm like, "Yeah, that was us."

Greg (02:04:35):

I'm sorry. Was Biggie ever involved in any of these conversations about hitting Tupac?

Audio: Duane Davis (02:04:41):

No.

Greg (02:04:42):

It was always just...

Audio: Duane Davis (02:04:43):

Puff.

Greg (02:04:43):

Puff and Zip.

Audio: Duane Davis (02:04:43):

Yeah.

Darren (02:04:44):

You think he knew about it or he was just like, "Whatever," he was doing his own thing?

Audio: Duane Davis (02:04:50):

He was always doing his own thing. Lance kind of kept him kind of-

Darren (02:04:52):

Out the wind.

Audio: Duane Davis (02:04:53):

Yeah.

Darren (02:04:54):

So this is all Puffy's doing.

Audio: Duane Davis (02:04:54):

Yeah. Puffy was scared. Scared of the dude. Period.

Greg (02:05:01):

Okay. So you guys make the deal for that. And then you guys aren't out in Vegas then with that intention. That's not why you're in Vegas.

Audio: Duane Davis (02:05:10):

No, we've been going into fights since Pat days, the '80s.

Darren (02:05:15):

So y'all geared up to go to Vegas and y'all was going anyway, not even knowing who else was going to be down there.

Audio: Duane Davis (02:05:19):

Yeah. Don't be doing nothing.

Darren (02:05:19):

Not knowing if Pac and Suge was going to be down there?

Audio: Duane Davis (02:05:26):

We didn't got no pistol. We didn't have no pistols down there. And shit, they was right there, "This is perfect opportunity, baby."

Darren (02:05:30):

That was Zip talking?

Audio: Duane Davis (02:05:30):

Yeah.

Darren (02:05:31):

Because of what happened with Lane?

Audio: Duane Davis (02:05:35):

Yeah. Yeah. Y'all seen the surveillance, I got in the car with him, in the Benz. The broad was in there first, Foxy Brown.

Darren (02:05:44):

She was with him?

Audio: Duane Davis (02:05:44):

She was in the car with him.

Darren (02:05:45):

Okay.

Audio: Duane Davis (02:05:47):

And he told her that we need to handle some business. So she got out and I jumped in the car. He had a little secret compartment. The thing popped out.

Greg (02:05:57):

Okay. Let's work up to that real quick because that's important.

Audio: Speaker 1 (02:05:59):

Well, but he said that there was numerous conversations, the first one taking place in Anaheim, another one at Greenblatt's.

Audio: Duane Davis (02:06:07):

Yeah.

Audio: Speaker 1 (02:06:08):

What other conversations took place where you and Puffy were talking about doing this stuff?

Audio: Duane Davis (02:06:13):

That's so fucking long.

Audio: Speaker 1 (02:06:24):

Yeah. So just to jog your memory, you're down in Anaheim, Puff gets up, he says, " I'll do anything to get rid of these guys." Everybody kind of, "Cool, that's cool, whatever." He takes it to another level, he's more serious. You meet him at Greenblatt's for dinner, you guys step off to the side. He talks about, "Hey, how much you want? I'll give you a million dollars."

Audio: Duane Davis (02:06:45):

Yeah, we went downstairs.

Audio: Speaker 1 (02:06:46):

You say, "Cool."

Audio: Duane Davis (02:06:46):

Yeah. "Consider it done."

Greg (02:06:49):

All right. Now what conversations between Anaheim and that conversation, or that conversation and the incident, any more conversations in there about getting it done?

Audio: Higgins (02:07:00):

On the phone or in person, either one. Did Zip ever call you on the phone?

Audio: Duane Davis (02:07:08):

No. I know after it happened, he kept calling, "That us? That us?" "That's us, motherfucker." Yeah.

Darren (02:07:15):

Did Zip ever try to push it like, "Hey, the boys still talking about getting this done?"

Audio: Duane Davis (02:07:20):

Yeah, he just said, "That's our perfect opportunity."

Darren (02:07:23):

That's it? But in between, he never said nothing like he was trying to almost broker it like, "Yeah, I talk to Puffy, he asked if y'all going to do that still."

Audio: Duane Davis (02:07:28):

No, he didn't say that.

Audio: Speaker 2 (02:07:31):

Who brought up the amount of $1 million?

Audio: Duane Davis (02:07:34):

Shit, he did.

Audio: Speaker 2 (02:07:36):

Puffy did?

Audio: Duane Davis (02:07:37):

Yeah.

Audio: Speaker 2 (02:07:37):

Okay. Was it you?

Audio: Duane Davis (02:07:39):

No, it wasn't me. Shit, a million dollars, [inaudible 02:07:44] 50. You know what I'm saying? Shit.

Greg (02:07:47):

So he brought up the $1 million.

Audio: Duane Davis (02:07:51):

Yeah. Them project dudes will kill your ass for $1,500. You know what I'm saying? Shit.

Audio: Speaker 1 (02:07:51):

Tell me about that.

Darren (02:07:57):

So basically you have to go to Vegas, y'all had planned to go to Vegas a couple weeks, got the hotels.

Audio: Duane Davis (02:08:02):

Down there, yeah.

Darren (02:08:02):

And then, who all-

Darren (02:08:00):

... Vegas a couple weeks, got the hotels.

Audio: Duane Davis (02:08:06):

All right, yeah.

Darren (02:08:06):

And then who all drives out there? All you guys is...

Audio: Duane Davis (02:08:06):

All of us, yeah. Shit, we had left from Greenblatts.

Greg (02:08:06):

Give me one second.

Audio: Duane Davis (02:08:06):

No, no.

Speaker 9 (02:08:06):

[inaudible 02:08:30].

Darren (02:08:06):

Okay.

Audio: Duane Davis (02:08:06):

[inaudible 02:08:33].

Darren (02:08:33):

So y'all gear up and go down there. Y'all caravan down here?

Audio: Duane Davis (02:08:34):

Yeah.

Darren (02:08:36):

How many cars?

Audio: Duane Davis (02:08:41):

We went Greenblatts. It was me, Zip. So Zip drove that Benz. Kevin drove that van.

Darren (02:08:54):

Who?

Audio: Duane Davis (02:08:55):

I drove a...

Darren (02:08:56):

Kevin?

Audio: Duane Davis (02:08:56):

Yeah.

Darren (02:08:56):

Okay.

Audio: Duane Davis (02:08:58):

And I drove, what was that, a Malibu or something? Not a Malibu, but a Century. What's that by Buick?

Darren (02:09:03):

Buick Century?

Audio: Duane Davis (02:09:06):

Yeah. I drove a rental Century.

Darren (02:09:07):

And y'all left from Greenbacks about what time? A couple days before?

Audio: Duane Davis (02:09:10):

Maybe about... Was it a Thursday night? I think it was a Thursday night. We left from there.

Darren (02:09:19):

The fight was Saturday.

Audio: Duane Davis (02:09:21):

Okay, it was probably Friday we left. Friday evening, went in. Zip looked like he got picked up by a helicopter [inaudible 02:09:28] he got there before us. So once we got there, we started kick it, partying and all that other shit.

Darren (02:09:34):

Y'all stayed at the Monte Carlo?

Audio: Duane Davis (02:09:36):

Yeah.

Darren (02:09:36):

Okay. And who got the rooms for you at the Monte Carlo?

Audio: Duane Davis (02:09:40):

My wife. It was in my wife's name.

Darren (02:09:41):

Okay. Y'all paid for them?

Audio: Duane Davis (02:09:45):

They had comps. [inaudible 02:09:48] had comps, not at the MGM, but at Excalibur.

Darren (02:09:51):

Because of gambling?

Audio: Duane Davis (02:09:52):

Yeah.

Darren (02:09:52):

Okay.

Greg (02:09:53):

I'm sorry.

Darren (02:09:53):

No, no, that's all right.

Greg (02:09:55):

I got thrown off track for something. We were in Greenblatts. They have the discussion and everything. How long before you guys go to Vegas is that?

Darren (02:10:08):

This is another time at Greenblatts, or the same time that Puffy said he...

Audio: Duane Davis (02:10:12):

Oh, this is a different time.

Darren (02:10:12):

Okay.

Audio: Duane Davis (02:10:12):

That's our headquarters, we meet there.

Darren (02:10:15):

Okay.

Audio: Duane Davis (02:10:15):

Every time we come out, we meet [inaudible 02:10:16].

Darren (02:10:16):

So Puffy had said they agreed to the million, and then that Friday before they were going to Vegas, they met at Greenblatts with Zip, the caravan from there on that Friday night.

Greg (02:10:27):

Okay, so there's another incident. You guys meet at Greenblatts.

Audio: Duane Davis (02:10:31):

That's when we go to the flight in September '96.

Greg (02:10:37):

Okay. And you leave from Greenblatts to go to Vegas?

Audio: Duane Davis (02:10:40):

Yeah.

Greg (02:10:40):

And that's when Kevin's driving the van?

Audio: Duane Davis (02:10:43):

Corey, Detroit, the dude from Detroit, Tracy Session, Wynn, all them was in that van. Me and my girl was in the Century. Zip rode with somebody else.

Speaker 8 (02:10:58):

Who's driving the Cadillac?

Audio: Duane Davis (02:11:00):

Wayne and them didn't come till the next day.

Darren (02:11:02):

They came on Saturday?

Audio: Duane Davis (02:11:03):

Yeah.

Darren (02:11:04):

Now, what time did they arrive on Saturday about? I know I'm getting ahead of it, but just trying to clear it up real quick.

Audio: Duane Davis (02:11:12):

They arrived about two or three o'clock that day.

Darren (02:11:15):

Okay. And who came with him? That whole crew was in the car and nobody else?

Audio: Duane Davis (02:11:21):

Nobody else.

Darren (02:11:22):

Just those three people minus you, Dre and T?

Audio: Duane Davis (02:11:29):

Yeah.

Darren (02:11:29):

Okay.

Speaker 7 (02:11:29):

Hey, real back, back at Greenblatts, when you and Puffy talked about the million dollars, you said you walked downstairs. Did he say, "Come meet me downstairs?"

Audio: Duane Davis (02:11:37):

Yeah, he said, "Come on downstairs, let me talk to you."

Speaker 7 (02:11:38):

Okay.

Audio: Duane Davis (02:11:44):

And asked me why was we laughing at him and shit like that. I said, "Man, don't be coming out of here just getting anything, dude."

Speaker 7 (02:11:46):

Right.

Audio: Duane Davis (02:11:47):

"If you want some problems, just let us know."

Speaker 7 (02:11:49):

So he asked you to come downstairs. Did you guys talk about anything other than that specific thing?

Audio: Duane Davis (02:11:55):

We ordered some more bottles. It's like a two part thing. It's like the deli part right there, then you can walk back and go for the bottles. [inaudible 02:12:04] when we were looking for the bottles, had the bottles and shit.

Speaker 7 (02:12:10):

So in your opinion, the specific reason he asked you to come downstairs and talk to him was about that thing, not about liquor or anything like that, it was about that?

Audio: Duane Davis (02:12:18):

[inaudible 02:12:18], yeah.

Speaker 7 (02:12:18):

Okay.

Greg (02:12:22):

Okay. So then another incident, you guys were at Greenblatts, you go to Vegas. Kevin drove the van. He's got those other guys with him. You're with a girlfriend. Lane and Dre and T. Brown come the next day in the rented Cadillac.

Speaker 8 (02:12:36):

Was that a rented Cadillac?

Audio: Duane Davis (02:12:37):

Yeah.

Darren (02:12:38):

Get there about two.

Speaker 8 (02:12:40):

Who rented that Cadillac?

Greg (02:12:44):

T. Brown?

Audio: Duane Davis (02:12:45):

Yeah, T. Brown.

Greg (02:12:45):

His mom, right?

Audio: Duane Davis (02:12:46):

Mother-in-law.

Speaker 8 (02:12:46):

Right.

Greg (02:12:49):

Okay. Staying at the Monte Carlo, you said your girl had it in her name or Paula?

Audio: Duane Davis (02:12:56):

Paula.

Greg (02:13:02):

Okay. Okay.

Speaker 9 (02:13:04):

You all right?

Audio: Duane Davis (02:13:06):

I'm good.

Darren (02:13:06):

Can I ask you a quick question?

Audio: Duane Davis (02:13:08):

Go ahead.

Darren (02:13:08):

No, we'll get to that later.

Speaker 9 (02:13:08):

[inaudible 02:13:09].

Darren (02:13:08):

No, that's okay.

Speaker 9 (02:13:08):

Come on, now you're making us curious. Just ask.

Darren (02:13:08):

No, no, no. It's too far ahead, so I'd rather just stay intact because Greg is trying to write fast and get the stuff down, and I don't want to be too far ahead.

Greg (02:13:21):

Okay, so you guys are out in Vegas. You're there the night before the fight. The next morning or the next afternoon, Lane and them guys show up in the rented Cadillac, and you guys are all at the MGM. You guys go to the fight. So lead us through it from there.

Audio: Duane Davis (02:13:36):

Okay.

Greg (02:13:39):

You meet Zip out there.

Audio: Duane Davis (02:13:41):

Yeah. We all rode together, me Zip, Kev, and [inaudible 02:13:44]. But he just took off his [inaudible 02:13:44].

Greg (02:13:41):

Oh, okay.

Audio: Duane Davis (02:13:41):

And we got there.

Darren (02:13:41):

Did he stay at the same hotel as you guys?

Audio: Duane Davis (02:13:44):

No, I think he stayed at the MGM. Some dudes fronted his ass off right in front of us.

Darren (02:14:07):

What happened?

Audio: Duane Davis (02:14:08):

He like, "Motherfucker, this motherfucker's a snitch." We like, "What?" He like, "Yeah. Damn"

Darren (02:14:12):

What'd he say?

Audio: Duane Davis (02:14:12):

Huh?

Darren (02:14:12):

What did he say?

Audio: Duane Davis (02:14:13):

He didn't say nothing. He just said, "I just got beat." Then the next day, we got our tickets from the little dude named Shorty. He from '60s. Shorty from 60, he's like-

Darren (02:14:32):

How'd he get the tickets to the fight?

Audio: Duane Davis (02:14:33):

He's a scalper.

Darren (02:14:34):

Oh, okay.

Audio: Duane Davis (02:14:36):

Anybody can get tickets. He'd be at every event. When I was in prison with him and [inaudible 02:14:45] back in the days. And he was a little youngster and he started selling tickets, scalping. We went and got our tickets. And our tickets was separated. Lane went in, everybody else went in. Then boom, we went to eat. We was eating, and they came and said, "They just beat up Lane."

Darren (02:15:05):

What restaurant were you guys at? Do you remember? You was in the hotel lobby?

Audio: Duane Davis (02:15:11):

We was in the hotel, yeah, at the MGM and the restaurant, was in the cafe up there or something.

Darren (02:15:15):

Huh?

Greg (02:15:15):

You went to eat after the fight?

Audio: Duane Davis (02:15:19):

Yeah.

Greg (02:15:20):

How come Lane wasn't with you?

Audio: Duane Davis (02:15:23):

Because the scalpers had different locations on the tickets.

Speaker 9 (02:15:25):

So you couldn't get them all in one [inaudible 02:15:26]?

Audio: Duane Davis (02:15:26):

All in one, yeah.

Darren (02:15:26):

So you got separated. He went his way after the fight.

Audio: Duane Davis (02:15:30):

Yeah.

Darren (02:15:30):

And he got caught up over there.

Audio: Duane Davis (02:15:32):

Yeah. We was ordering our food, and then he like, "Lane just got beat up." We were like, "Bullshit."

Speaker 8 (02:15:43):

Where was Zip at that point?

Audio: Duane Davis (02:15:43):

Zip was in the lobby part where we registered. That's where we ran into them, him and Richie Rich. [inaudible 02:15:48].

Darren (02:15:47):

He's the older [inaudible 02:15:48], right?

Audio: Duane Davis (02:15:48):

Richie Rich?

Darren (02:15:53):

Yeah.

Audio: Duane Davis (02:15:54):

Nah, he probably like 43.

Greg (02:15:57):

New Yorker?

Audio: Duane Davis (02:15:58):

Yeah.

Greg (02:15:58):

Yeah. Was there a redheaded dude there?

Audio: Duane Davis (02:16:00):

Man, I know Richie Rich was there. Richie Rich. There was a few New Yorkers though when we was with Zip, like, "Man, y'all need some help?" We got this.

Darren (02:16:20):

That's what they said?

Audio: Duane Davis (02:16:20):

Yeah. [inaudible 02:16:23].

Darren (02:16:20):

[inaudible 02:16:23]?

Audio: Duane Davis (02:16:20):

Yeah.

Speaker 7 (02:16:25):

Well, how come everybody else was at the restaurant with you? Everybody knew to go to the restaurant, but Lane was on his own by the doors.

Audio: Duane Davis (02:16:31):

Yeah.

Speaker 7 (02:16:34):

Something's missing. Why is he at the doors and everybody else is at the restaurant?

Audio: Duane Davis (02:16:41):

He was supposed to come to the restaurant too.

Speaker 7 (02:16:41):

He just forgot or something?

Audio: Duane Davis (02:16:45):

Shit, they seen this motherfucker in the house and beat him up, he couldn't get there. Yeah.

Speaker 7 (02:16:49):

Okay.

Darren (02:16:49):

But on the surveillance, it seems like he's standing there waiting.

Speaker 7 (02:16:51):

He's hanging out.

Darren (02:16:52):

He's hanging out. He wasn't on his way nowhere walking.

Audio: Duane Davis (02:16:54):

Y'all seen us at the restaurant?

Speaker 8 (02:16:56):

Well, yeah, they got video cameras all over them.

Darren (02:17:00):

But him, he wasn't...

Speaker 8 (02:17:00):

He was posted up.

Darren (02:17:05):

He was looking at them when they walked by.

Speaker 8 (02:17:06):

Did he find out they was waiting for him, do you think?

Darren (02:17:09):

I mean, I don't know. He wasn't waiting for them.

Speaker 8 (02:17:10):

That's what we're asking you. A lot of this...

Audio: Duane Davis (02:17:13):

We be after the girls, man.

Speaker 7 (02:17:15):

Yeah, but it seems like, so you guys get your tickets from Shorty, you give them out. All right, we can't sit together, so let's all meet at this restaurant afterwards. All right, everybody bolts. After the fight, everybody comes back to the restaurant except Lane. Lane's standing by the doors. Why is Lane standing by the doors and everybody else is on board knowing to go to the restaurant?

Audio: Duane Davis (02:17:33):

I don't know what his thoughts was.

Speaker 7 (02:17:34):

Okay.

Darren (02:17:36):

Okay. But before that, before the fight, before Orlando had the beat down or whatever you want to call it, no beef with nobody as far as them. Did you guys even see Suge and them at all?

Audio: Duane Davis (02:17:46):

[inaudible 02:17:47].

Darren (02:17:47):

Didn't see him, didn't nothing? Nobody said, "They here, them dudes here," nothing like that?

Audio: Duane Davis (02:17:51):

Nothing. Nothing.

Darren (02:17:51):

Okay.

Greg (02:17:55):

See, but it would seem to me that Lane may be working his way over to the restaurant where he was trying to find you guys, but then he sees them. He knows automatically he's going to have beef with them just because of the mall incident.

Audio: Duane Davis (02:18:05):

Yeah.

Greg (02:18:06):

So he maybe just tried to...

Speaker 9 (02:18:07):

Posted up.

Greg (02:18:07):

... post up, trying to wait for you guys to pass by, or sorry...

Audio: Duane Davis (02:18:10):

Yeah, yeah, he probably [inaudible 02:18:12]. Yeah, you're right.

Greg (02:18:11):

That would make some sense.

Audio: Duane Davis (02:18:13):

Yeah, yeah. He just got separated.

Greg (02:18:16):

Okay.

Audio: Duane Davis (02:18:16):

Y'all seen us at the restaurant?

Speaker 9 (02:18:16):

[inaudible 02:18:20].

Speaker 10 (02:18:22):

Shit, Darren was the waiter.

Audio: Duane Davis (02:18:23):

Y'all see me and him getting the bill?

Darren (02:18:24):

I can't believe you don't remember seeing me at the house, on Compton, on [inaudible 02:18:28], all that, man. I can't believe it, man.

Speaker 7 (02:18:30):

This task force has been around a long time.

Darren (02:18:35):

I can't believe you don't remember seeing me, man. I shook your hand a couple times. I'm like, "What's up, man? And you're like, "What's up?"

Speaker 7 (02:18:39):

For real.

Darren (02:18:40):

And you started moving like you knew me. And I'm like, "What's up, man? How are you doing?"

Audio: Duane Davis (02:18:44):

[inaudible 02:18:44].

Darren (02:18:44):

But you would just [inaudible 02:18:45].

Speaker 9 (02:18:44):

[inaudible 02:18:45].

Audio: Duane Davis (02:18:44):

Whoa, whoa. Y'all seen us at the restaurant too?

Darren (02:18:55):

Yeah, I just forgot the name of it because like you said, it's been so long ago. But, okay.

Audio: Duane Davis (02:19:00):

Did y'all see me and Zip in the Benz too?

Greg (02:19:02):

I did.

Speaker 7 (02:19:03):

I don't remember seeing it.

Darren (02:19:05):

I don't remember seeing it. Okay, but who was in the restaurant with you?

Audio: Duane Davis (02:19:09):

The crew, me, [inaudible 02:19:12]. All of us. Kev.

Darren (02:19:17):

Was Davion hanging out with y'all at that time?

Audio: Duane Davis (02:19:20):

No.

Darren (02:19:20):

The Vegas dudes?

Audio: Duane Davis (02:19:21):

No, they wasn't.

Darren (02:19:22):

They knew nothing about this?

Audio: Duane Davis (02:19:22):

Nothing about this.

Darren (02:19:25):

Y'all didn't hook with them at all, nobody? Kitar Carol, KC, whatever his name is, none of them dudes? Y'all hook up with none of them from Vegas?

Audio: Duane Davis (02:19:32):

We seen KC down there.

Darren (02:19:32):

Okay.

Audio: Duane Davis (02:19:33):

We see Doug Carr, the other boy, Chan.

Darren (02:19:36):

Okay.

Speaker 10 (02:19:38):

Where'd Danny go?

Audio: Duane Davis (02:19:38):

Huh?

Darren (02:19:38):

Danny.

Audio: Duane Davis (02:19:38):

[inaudible 02:19:41].

Darren (02:19:42):

Yeah. He just got [inaudible 02:19:44] by five of those things, literally.

Audio: Duane Davis (02:19:46):

Yeah.

Greg (02:19:48):

Okay, so Richie Rich and Zip are in the lobbies with some other New Yorkers. You guys are eating, blah, blah, blah. Lane gets into a fight. And then Zip and his boys are like, "Y'all need any help?"

Audio: Duane Davis (02:19:59):

The East Coast asked us this first. Ant my boy.

Greg (02:20:01):

Who?

Audio: Duane Davis (02:20:01):

Ant, the one from Paramount, man.

Greg (02:20:01):

Oh.

Speaker 9 (02:20:01):

[inaudible 02:20:09]?

Audio: Duane Davis (02:20:01):

Ant.

Greg (02:20:10):

Oh, Anthony?

Darren (02:20:10):

Anthony Treggs, yeah. He was out there?

Audio: Duane Davis (02:20:12):

Yeah, he asked me, "Y'all need some help?" We like, "Nah, we good."

Speaker 7 (02:20:17):

Did Treggs hear any of the conversations between you and Puffy? Was he there for anything?

Audio: Duane Davis (02:20:21):

Who?

Speaker 7 (02:20:22):

Treggs.

Darren (02:20:22):

Ant.

Speaker 7 (02:20:22):

Ant.

Audio: Duane Davis (02:20:22):

Ant?

Darren (02:20:24):

Yeah, the one you talking about right now.

Audio: Duane Davis (02:20:25):

No, no, no, no, he was [inaudible 02:20:27].

Speaker 7 (02:20:28):

[inaudible 02:20:28] Cadillac? Was it a Cadillac?

Darren (02:20:29):

Yeah.

Speaker 7 (02:20:29):

Yeah.

Darren (02:20:29):

Yeah.

Speaker 7 (02:20:33):

Was he there for any of the other conversations or anything like that?

Greg (02:20:35):

No, the Cadillac was Reed. That's Trevor.

Darren (02:20:37):

Trevor, yeah, the other one was.

Greg (02:20:39):

Ant was the other guy that came with the other car.

Speaker 9 (02:20:41):

That's right.

Audio: Duane Davis (02:20:43):

He was there. We seen him earlier. He was like, "They jumped on Lane. Who? Who? Who? What's up? Y'all meet us." We're like, "No, we cool." Then we ran into Zip and them in the lobby. I was watching the kid who just stopped us to talk to us there.

Greg (02:20:57):

Okay.

Audio: Duane Davis (02:21:01):

If one of y'all was watching, he stopped us to talk to us. And we met Zip and them in the lobby. We went all out to the parking lot to get the cars.

Greg (02:21:09):

Okay. Let's stop right there. The whole crew?

Audio: Duane Davis (02:21:15):

Yeah.

Greg (02:21:21):

All right, you get cars, and then Zip's in his Benz?

Audio: Duane Davis (02:21:24):

Yeah.

Greg (02:21:25):

And who's in there, Foxy Brown?

Audio: Duane Davis (02:21:27):

Yeah.

Greg (02:21:31):

And does she get out or he tells her to get out or what?

Audio: Duane Davis (02:21:34):

Yeah, he told her to get out or something, because he told me in the lobby that he had some jimmies.

Greg (02:21:40):

Some what?

Audio: Duane Davis (02:21:40):

He had the jimmies?

Darren (02:21:40):

You need one?

Greg (02:21:40):

[inaudible 02:21:52], thanks.

Darren (02:21:54):

And you get in when Foxy Brown was sitting in the front seat?

Audio: Duane Davis (02:21:58):

Yeah. And she got out. She was wearing pink, a little pink thing. And I jumped in the car, and he gave me the jim.

Darren (02:22:06):

Who was laying in all them? I'm sorry, Greg, one moment.

Greg (02:22:09):

Yeah, no problem.

Audio: Duane Davis (02:22:10):

They was waiting on the cars.

Darren (02:22:11):

So they was in the valet waiting for the cars. You had already gotten in his car. And hold on a second.

Speaker 7 (02:22:18):

Where does he get the gun from in the car?

Audio: Duane Davis (02:22:20):

A little secret compartment.

Speaker 10 (02:22:21):

Popped up?

Audio: Duane Davis (02:22:22):

Pop-up, yeah.

Speaker 10 (02:22:23):

In the armrest?

Audio: Duane Davis (02:22:37):

Yeah.

Greg (02:22:37):

Was it a Glock?

Audio: Duane Davis (02:22:37):

Yeah.

Greg (02:22:37):

40?

Audio: Duane Davis (02:22:40):

Yeah. And I ain't ever told nobody that story, man.

Speaker 7 (02:22:45):

Doesn't that feel good, man? Get it off your chest. Just been weighing you down, man, over 20 years.

Audio: Duane Davis (02:22:53):

Can I ask you one question though?

Greg (02:22:54):

Oprah's going to be like, "Mr. Davis, we really appreciate it."

Speaker 10 (02:22:59):

And then he's going to be like this, "Read my book."

Audio: Duane Davis (02:23:06):

I just want to ask one thing though, one thing. Y'all heard that story before though, before I told y'all?

Greg (02:23:10):

Not that part, no, never heard that part before, I haven't.

Audio: Duane Davis (02:23:14):

About Zip?

Greg (02:23:15):

I knew about Zip.

Speaker 8 (02:23:16):

We knew about Zip.

Audio: Duane Davis (02:23:16):

Gave the gun, but other than that...

Greg (02:23:16):

Yeah.

Speaker 8 (02:23:20):

Yeah, but not about the pop-up time.

Darren (02:23:21):

Pop-up. No particular things in between. But we're on track.

Audio: Duane Davis (02:23:24):

I'm just saying, y'all knew...

Greg (02:23:26):

We knew Zip had given the gun, but we didn't know that you went to his car to get it.

Darren (02:23:31):

Stuff like that.

Audio: Duane Davis (02:23:33):

This dude punked me though that morning in the garage though, I ain't going to lie. He got me good, dawg, I ain't going to lie. You got to pray he'll be good, be good. He like, "Motherfucker, I got some shit that's going to break your heart, going to break you to your knees."

Speaker 9 (02:23:49):

[inaudible 02:23:49].

Audio: Duane Davis (02:23:49):

Huh? That's what got me, dawg. Other than that, I don't know what I heard. I'm going to lose my house? Fuck this. You know what I'm saying? Yeah. But that got me though, dawg. He said, "I got some shit that's going to break your heart, going to break you to your knees." I already knew what it was. "Oh, they got me, dawg."

Speaker 7 (02:24:06):

I've got to write that one down, man, put that in the book.

Audio: Duane Davis (02:24:12):

"I've got some shit that's going to break your heart. It'll break you down to your knees."

Speaker 7 (02:24:13):

See, he can deliver it. I'd be like this. "I got some shit that's going to break your..." It wouldn't just sound right.

Audio: Duane Davis (02:24:19):

You got me on that, dawg. Other than that, I was like, "Fuck, dawg, [inaudible 02:24:22], man."

Darren (02:24:23):

Because I know I am you. I know how you think. I'm from the same place you from. So I know kind of...

Mr. Higgins (02:24:33):

Where are you from? You from the neighborhood?

Darren (02:24:33):

You don't even want to talk about that.

Speaker 8 (02:24:33):

You don't even want to know.

Mr. Higgins (02:24:34):

You're so proper, man.

Darren (02:24:35):

You know what? That's about education a little bit.

Mr. Higgins (02:24:37):

You're so proper, [inaudible 02:24:39].

Audio: Duane Davis (02:24:39):

You got me on that one, [inaudible 02:24:41]. Then I said, "Break my heart then." And I thought about it all over, that week. I said, "Oh, they got me, dog. They're going to give me the death penalty."

Darren (02:24:52):

That's a little bit of a stretch, man.

Audio: Duane Davis (02:24:53):

Huh?

Darren (02:24:53):

Yeah, it's a bit of a stretch. But okay, but we agree.

Greg (02:24:56):

Okay, so we get the gun out of the armrest. Zip gives you the gun. It's a 40. I assume, do you check it, load it, you get your own ammo? How's that happen? It's already loaded or what?

Audio: Duane Davis (02:25:06):

It's already loaded. You just put [inaudible 02:25:09].

Greg (02:25:10):

Okay, what do you tell Zip right then?

Audio: Duane Davis (02:25:13):

What's that?

Greg (02:25:14):

Do you tell Zip, "Hey, we're going to go handle this shit," or whatever?

Audio: Duane Davis (02:25:17):

Yeah, they asked, "Do y'all want us to come?" I'm like, "We know where them motherfuckers at." They was telling me that they going to be at the 662 Club.

Darren (02:25:24):

Who was telling you that?

Audio: Duane Davis (02:25:24):

Everybody.

Darren (02:25:24):

Everybody out there?

Audio: Duane Davis (02:25:24):

Yeah, everybody. They gave me the [inaudible 02:25:29].

Speaker 7 (02:25:32):

But how do you know that Zip's got a gun? Did he tell you?

Audio: Duane Davis (02:25:33):

He told us in the lobby when I met him in the lobby, "I got one."

Speaker 7 (02:25:36):

Did you ask him, "Do you have one," or he just tells you, "Hey, I got one?"

Audio: Duane Davis (02:25:41):

Yeah. That's when he asked us, do we need some help? "I got some [inaudible 02:25:43]." I'm like, "Yeah, okay, cool."

Speaker 7 (02:25:43):

All right.

Darren (02:25:46):

But only one, he gave you?

Audio: Duane Davis (02:25:47):

Yeah. So KC went to go get some guns, but he never did get back with us.

Darren (02:25:55):

So it was a lot of people out there and asking you guys, Southsiders or Orlando, like Ant and who else?

Audio: Duane Davis (02:26:03):

Just the East Coast asked us first, the East Coast Crips, then the New Yorkers asked us.

Darren (02:26:06):

That's it? Okay.

Audio: Duane Davis (02:26:06):

We're like, "We don't need your help. We good."

Darren (02:26:09):

Yeah. Okay. Then y'all, you get the heat, you get out of the car with Zip after everything. What do you say to him, like, "Man, we're going to handle this," like, "Great?"

Audio: Duane Davis (02:26:15):

Yeah, we're going [inaudible 02:26:17]. Boom. He's like, "Yeah, it's your perfect time."

Darren (02:26:21):

Okay, then you jump out of the car. And then what happens?

Audio: Duane Davis (02:26:25):

I got in the van with the Busters. You know what I'm saying?

Darren (02:26:25):

Who was in the van?

Speaker 7 (02:26:25):

Where do you put the gun? What do you do with it?

Audio: Duane Davis (02:26:25):

Put it in [inaudible 02:26:35].

Speaker 7 (02:26:25):

Yeah?

Audio: Duane Davis (02:26:38):

Yeah.

Greg (02:26:38):

Okay. So Keffe, you get in the van with who?

Audio: Duane Davis (02:26:41):

Corey, Wynn, Kev, Wynn cousin, Tracy Session, and some dude from Detroit. And Lane had said they had a gun up under the hood.

Darren (02:26:58):

In the rental car?

Audio: Duane Davis (02:27:01):

Yeah. They put one up under the hood. I said, "Okay, that's cool." So we go to the 626.

Greg (02:27:04):

I'm sorry, real quick though, Lane's in the van too at that time or no?

Audio: Duane Davis (02:27:08):

No, he in the Cadillac.

Greg (02:27:09):

Okay, so Lane and Cadillac with T. Brown and Dre?

Audio: Duane Davis (02:27:13):

Yeah.

Darren (02:27:13):

Do you know who was driving them? You drove out from the hotel?

Audio: Duane Davis (02:27:16):

T. Brown.

Darren (02:27:16):

T. Brown was driving [inaudible 02:27:17]?

Audio: Duane Davis (02:27:17):

Yeah.

Darren (02:27:17):

And y'all go with the van. Just the two cars go to 662?

Audio: Duane Davis (02:27:25):

Yeah. The van and the Cadillac.

Darren (02:27:27):

Go to 662. I'm sorry, go on Greg.

Greg (02:27:29):

So when you guys leave the motel after you get the gun from Zip, you guys never go back to your rooms to discuss anything, or anything at all? You go from the MGM, or I'm sorry, from the MGM out on the hunt for these guys. You guys never go back to-

Audio: Duane Davis (02:27:43):

We went and dropped the girls off, me and Lane did.

Greg (02:27:47):

At what point? Before you met with Zip or after you met with Zip?

Audio: Duane Davis (02:27:58):

[inaudible 02:27:55]. I know I gave Paula money to go gamble, and Rash. I don't know where Rash...

Greg (02:28:04):

That was Lane's girlfriend, Rasheen or whatever?

Audio: Duane Davis (02:28:16):

Yeah.

Greg (02:28:16):

Or Rasheena?

Audio: Duane Davis (02:28:16):

Yeah. I know I gave Paula the money to gamble. But yeah, then we went looking for them at... We went-

Darren (02:28:16):

Just the two girls that you got... That's what you're saying? When you said the girls, just those two girls or just a whole, a lot of girls who were out there. Just Rasheena and Paula?

Audio: Duane Davis (02:28:23):

There was a few girls out there.

Darren (02:28:25):

Okay, with them, their whole crew?

Audio: Duane Davis (02:28:26):

Yeah, their crew.

Darren (02:28:26):

Okay.

Audio: Duane Davis (02:28:28):

I gave her money to go gamble. Boom. We get in the car, we get in the fucking van, go up to the 626. And Corey, "Ah, they're going to kill us, dawg. You know that motherfucking... Got the police killing and all that. Man, you crazy." And fuck, dude. I know dude since we played fucking football, he's a bitch. He got too scared.

Speaker 7 (02:28:53):

Did you get in the van in the valet area of MGM?

Audio: Duane Davis (02:28:55):

Yeah.

Speaker 7 (02:28:55):

Okay.

Darren (02:28:57):

Who was driving that van? You probably already answered that.

Audio: Duane Davis (02:29:01):

It was either Kev or Corey.

Darren (02:29:01):

Okay.

Audio: Duane Davis (02:29:01):

And we went up to the 626 club. They didn't show up. We waited about 15, 20 minutes, they didn't show up. So they was like, "Let's go get some liquor." We stopped at the liquor store. I got out the van with they ass and jumped in the Cadillac. Them motherfuckers [inaudible 02:29:24].

Speaker 8 (02:29:23):

Where was the liquor store at?

Audio: Duane Davis (02:29:24):

What's that street? It's a highway. What's that big highway there?

Speaker 8 (02:29:32):

Las Vegas Boulevard?

Audio: Duane Davis (02:29:33):

No, not that one. It's east of it.

Speaker 8 (02:29:41):

Oh, man. What's the one that runs behind all the hotels?

Audio: Duane Davis (02:29:42):

[inaudible 02:29:44].

Speaker 10 (02:29:45):

Here's a little map of the hotels.

Speaker 8 (02:29:54):

They may or may not be on that map.

Greg (02:29:57):

It's kind of the intersection where the killing went, yeah.

Audio: Duane Davis (02:30:01):

Just east of this.

Darren (02:30:02):

It's just a little next door.

Audio: Duane Davis (02:30:09):

Yeah. It was a little, what was it, 7-Eleven or something?

Speaker 7 (02:30:11):

Real close to the 626 Club?

Audio: Duane Davis (02:30:13):

Yeah.

Speaker 7 (02:30:21):

662 Club?

Audio: Duane Davis (02:30:21):

It's a big highway. It's in Maryland Boulevard. One of them.

Speaker 7 (02:30:21):

All right.

Greg (02:30:21):

Okay, so you guys go to the liquor store. You're tired of listening to Corey whine. You jump into the Cadillac. And you what? You go to the liquor store, you get out of the van, you jump into the Cadillac with Lane and them guys, and then what?

Audio: Duane Davis (02:30:39):

We rolled up... What is that? Is that Harmon?

Greg (02:30:44):

There is a Harmon on there. Harmon Street's on there if you can see it. Should be a Harmon Street on there. Koval, Harmon.

Audio: Duane Davis (02:31:07):

Where did he get shot at? On Harmon, didn't he?

Darren (02:31:07):

I think it was Flamingo and Harmon right there, something like that.

Audio: Duane Davis (02:31:07):

No, it's on this street in Harmon where he got shot.

Speaker 7 (02:31:07):

Koval?

Darren (02:31:07):

Koval.

Audio: Duane Davis (02:31:08):

Yeah. I think it's Maryland Parkway or something like that. Is it called it?

Darren (02:31:10):

Yeah.

Audio: Duane Davis (02:31:13):

I think the little liquor store was right there. Then we came up Harmon at the Las Vegas Boulevard. And shit, here they come in that BMW [inaudible 02:31:26] in your car. And Brawls like, "Tupac, Tupac." And we were like, "There they go." Made a U-turn. We wasn't supposed to make a U-turn. We just wanted a U-turn. And they was in the middle lane, and we just pulled up on the side and checked every car to see where they was.

Speaker 8 (02:31:41):

So what directed your attention to him was some girl shouting at Tupac?

Audio: Duane Davis (02:31:45):

"Tupac." He gave himself away. Otherwise, they would've got away. He all hanging out the... You know how he do? [inaudible 02:31:53], and we went and got him.

Greg (02:31:55):

He did a U-turn, so then you pull alongside of it. You guys were in the car. Have you already handed Lane the gun at this point, or at what point do you hand him the gun?

Audio: Duane Davis (02:32:06):

I thought he was going to pull on my side. That's my little nephew, I'm going to look out for him. And he pulled off on his side.

Greg (02:32:16):

So you were fitting to blast if you had to, or you were just...

Audio: Duane Davis (02:32:19):

Yeah. If we would have been on my side, I would have blasted.

Greg (02:32:22):

Okay. So you hand the gun to the back seat?

Audio: Duane Davis (02:32:24):

Yeah.

Greg (02:32:24):

You hear Lane?

Audio: Duane Davis (02:32:26):

I gave it to Dre, and Dre was like, "No, no, no." And Lane's like, "Give it here." [inaudible 02:32:29].

Speaker 8 (02:32:29):

Now, when you first talked to you a few weeks ago, you did say that Orlando was behind the driver. Is that right?

Audio: Duane Davis (02:32:40):

No. Orlando was behind me, the passenger.

Speaker 8 (02:32:40):

Okay. Okay.

Audio: Duane Davis (02:32:43):

Dre was behind the driver.

Speaker 8 (02:32:44):

Okay. So when you passed the gun, you passed it to Dre?

Audio: Duane Davis (02:32:48):

Yeah.

Speaker 8 (02:32:48):

Okay.

Audio: Duane Davis (02:32:49):

He was the closest to him.

Speaker 8 (02:32:51):

He didn't want no part of it?

Audio: Duane Davis (02:32:54):

Yeah, he was scary.

Speaker 8 (02:32:55):

All right.

Audio: Duane Davis (02:32:57):

I known him to be scary, but when I got out of jail, he said he was a bad motherfucker.

Darren (02:32:59):

Dre?

Audio: Duane Davis (02:33:04):

Yeah, I'm like, "Is that right?" He used to frame, all that shit. All that shit. "Oh, what are we going to do?"

Speaker 8 (02:33:09):

[inaudible 02:33:09] if his girlfriend liked to kill him.

Audio: Duane Davis (02:33:11):

Huh?

Speaker 8 (02:33:11):

His girlfriend killed him, didn't she?

Audio: Duane Davis (02:33:15):

Nah. No, she didn't, he just had a sinus problem.

Speaker 8 (02:33:16):

Oh, okay.

Greg (02:33:23):

Okay, so you guys pull up alongside. This is essentially, I think, what...

Audio: Duane Davis (02:33:31):

Yeah.

Greg (02:33:32):

You guys pull alongside, that's essentially what you see?

Audio: Duane Davis (02:33:34):

Yeah. But he had the window open. The window was up.

Greg (02:33:40):

Oh, was it tinted or no?

Audio: Duane Davis (02:33:40):

No, he had the window up.

Greg (02:33:42):

Okay.

Speaker 8 (02:33:45):

So he wasn't out yelling at the girls at that time?

Audio: Duane Davis (02:33:49):

No. He rolled back up the window when he went on the street.

Greg (02:33:52):

Okay, Lane starts blasting. You say Suge looks over, he sees you?

Audio: Duane Davis (02:33:58):

Yeah.

Greg (02:34:00):

He looks right at you?

Audio: Duane Davis (02:34:01):

Yeah, he looked at me.

Greg (02:34:01):

Okay.

Speaker 8 (02:34:01):

[inaudible 02:34:02]?

Audio: Duane Davis (02:34:01):

We've fucking known each other since we were seven, eight years old.

Greg (02:34:12):

When he looks over at you, and then Tupac's busy getting shot, the story is Tupac's trying to either get out of the [inaudible 02:34:20]-

Audio: Duane Davis (02:34:20):

In the back seat or something.

Greg (02:34:21):

Yeah, what do you see happening inside of their car?

Audio: Duane Davis (02:34:24):

[inaudible 02:34:23]. I seen a bullet going Suge head, I thought he was dead. I thought he was dead.

Greg (02:34:29):

You see his face-

Audio: Duane Davis (02:34:32):

It must have scraped him or something in the head or something.

Greg (02:34:33):

A piece of glass went into his neck right here.

Audio: Duane Davis (02:34:35):

And he had a thing in his head too.

Greg (02:34:36):

He had a little graze on his head.

Speaker 8 (02:34:36):

Yeah, he got a graze on his head.

Audio: Duane Davis (02:34:36):

I thought he was dead.

Darren (02:34:42):

Okay. So I'm sorry, did you guys stop the [inaudible 02:34:45]? Did [inaudible 02:34:46] stop the car and then let him get off?

Audio: Duane Davis (02:34:47):

Yeah. Then we made the right.

Darren (02:34:49):

Okay, but he stopped for a few seconds while he boom, boom, boom, got off, then took off?

Audio: Duane Davis (02:34:53):

Then we made the right. And so Brawls and the Seabreeze was following us, stupid bitches, "Ah.". And we shot their window out and they stopped.

Darren (02:35:04):

So Tupac's trying to jump in the back seat. And what's Suge doing, just ducking?

Audio: Duane Davis (02:35:07):

Ducking. He couldn't really duck because he was too big.

Darren (02:35:12):

Yeah.

Audio: Duane Davis (02:35:12):

Yeah.

Speaker 7 (02:35:21):

So you try to pass the gun to Dre. He says, "Fuck it, I don't want it." And then you say, "Fuck it, Orlando takes this?"

Audio: Duane Davis (02:35:27):

Yeah.

Greg (02:35:28):

Or wait, you give it to Dre and Dre gives it to Orlando?

Audio: Duane Davis (02:35:29):

Yeah. [inaudible 02:35:30].

Speaker 8 (02:35:29):

Dre didn't want to do it.

Darren (02:35:30):

And Dre is doing like this when he's shooting, just like [inaudible 02:35:37]?

Audio: Duane Davis (02:35:37):

Yeah.

Darren (02:35:37):

Leaning back?

Audio: Duane Davis (02:35:38):

Yeah. And once we got out of the car, he was acting like a bitch then. I was like, "Shit, get ahold of yourself, bitch."

Speaker 10 (02:35:44):

Dre?

Audio: Duane Davis (02:35:44):

Yes.

Speaker 10 (02:35:44):

What was he saying?

Audio: Duane Davis (02:35:52):

"[inaudible 02:35:49]." "Man, shut the fuck up, bitch. Roll with this."

Speaker 8 (02:35:53):

Well, where did you go after the shooting?

Audio: Duane Davis (02:35:55):

Went to Monte Carlo.

Darren (02:35:56):

And do what?

Speaker 7 (02:35:56):

[inaudible 02:36:01].

Greg (02:36:01):

Okay, so the shooting goes down. He's trying to get in the backseat. Suge's ducking out the way. You guys pull off, and followed by Seabring?

Audio: Duane Davis (02:36:08):

Seabreeze and Brawls. They didn't call y'all or nothing, the Brawls?

Darren (02:36:15):

I don't know. [inaudible 02:36:16].

Audio: Duane Davis (02:36:16):

Man, come on, man.

Darren (02:36:18):

We've been talking over this, man. We've been doing this so many times, man, [inaudible 02:36:21].

Greg (02:36:21):

Seabreeze.

Speaker 8 (02:36:22):

It all comes out.

Greg (02:36:23):

Lane starts blasting back on him?

Audio: Duane Davis (02:36:25):

Yeah.

Greg (02:36:25):

So he had bullets left?

Audio: Duane Davis (02:36:27):

Yeah.

Darren (02:36:28):

How many rounds would you say he shot into Tupac and them car, if you had to...

Audio: Duane Davis (02:36:31):

About six or so.

Darren (02:36:34):

Six? How many times did he shoot at the girl?

Audio: Duane Davis (02:36:34):

Twice.

Darren (02:36:34):

Just twice? Okay. Afterwards, when you guys are rolling, just rolling to the hotel, you go straight back to the hotel?

Audio: Duane Davis (02:36:47):

I went and parked the car by the carriage house.

Darren (02:36:50):

By the carriage house? Y'all dumped the car and just left it there for...

Audio: Duane Davis (02:36:54):

We left it there. It's a parking lot on the opposite side of the carriage house. We left the car there and put the gun on the tire and left.

Darren (02:37:04):

On the tire, front wheel tire, back tire, what?

Audio: Duane Davis (02:37:06):

The front tire.

Darren (02:37:07):

And then left?

Audio: Duane Davis (02:37:08):

And then left, yeah.

Darren (02:37:09):

Was there any bullet holes in the car, because somebody said somebody shot back at you from...

Audio: Duane Davis (02:37:11):

Nah, ain't nobody shot at us.

Darren (02:37:12):

Nothing like that? There was never no bullet holes in the car?

Audio: Duane Davis (02:37:13):

Never, never.

Darren (02:37:13):

Okay.

Greg (02:37:16):

Which tire on the front? The passenger side or the...

Darren (02:37:18):

Passenger side.

Speaker 7 (02:37:23):

When Orlando was shooting, was the gun all the way out of the car, or was it in the car at all? Do you remember?

Audio: Duane Davis (02:37:31):

We got the shells out of there though.

Speaker 7 (02:37:32):

Did you?

Audio: Duane Davis (02:37:35):

Yeah, we did.

Speaker 7 (02:37:35):

All right.

Greg (02:37:36):

On your way to park the car, when you were leaving to go park the car?

Audio: Duane Davis (02:37:39):

The next day.

Greg (02:37:39):

The next day?

Audio: Duane Davis (02:37:39):

[inaudible 02:37:40].

Speaker 9 (02:37:42):

So the next day? Oh, you didn't go back the next day?

Audio: Duane Davis (02:37:44):

We rolled back the next day.

Speaker 9 (02:37:47):

The gun was gone?

Audio: Duane Davis (02:37:49):

The gun was on the tire.

Greg (02:37:50):

Tire.

Audio: Duane Davis (02:37:50):

I don't know.

Speaker 9 (02:37:50):

The next day though?

Audio: Duane Davis (02:37:53):

I was in the rental car. I don't know what they did with the other [inaudible 02:37:58].

Greg (02:37:58):

All right, Keffe, man, you just got this gun from Zip. You don't want him implicated in the shooting. Now you've got to loose end because you put the gun out there on the street like that, could come back to Zip because we don't know and you don't know at this time whether it's registered to him, his people, whatever. That's kind of lame.

Audio: Duane Davis (02:38:12):

[inaudible 02:38:14].

Greg (02:38:15):

Okay.

Mr. Higgins (02:38:15):

He don't give a fuck about Zip.

Audio: Duane Davis (02:38:16):

Yeah.

Mr. Higgins (02:38:16):

Yeah, he just [inaudible 02:38:18].

Greg (02:38:16):

At that time.

Mr. Higgins (02:38:19):

No, he ain't thinking like that.

Speaker 8 (02:38:21):

Well why would you leave a gun...

Mr. Higgins (02:38:22):

Y'all thinking [inaudible 02:38:23].

Speaker 8 (02:38:26):

... [inaudible 02:38:24]. They just did a big murder.

Mr. Higgins (02:38:28):

They're not thinking like that.

Audio: Duane Davis (02:38:29):

You want the truth or you want me to tell you a lie? You want me to lie?

Speaker 8 (02:38:32):

No, I want the truth.

Audio: Duane Davis (02:38:32):

Okay, we left the fucking gun on the tire, dude.

Speaker 10 (02:38:34):

That's it.

Audio: Duane Davis (02:38:38):

That's all, dawg. And that's the last time I seen the gun.

Greg (02:38:39):

That's the last time you saw the gun?

Mr. Higgins (02:38:39):

They don't think like that.

Audio: Duane Davis (02:38:40):

You want me to lie? I can throw them out [inaudible 02:38:43].

Speaker 8 (02:38:45):

I just can't believe you'd do that in Compton.

Audio: Duane Davis (02:38:46):

What's that?

Darren (02:38:48):

That's that they did.

Mr. Higgins (02:38:48):

They don't think like that. [inaudible 02:38:51].

Audio: Duane Davis (02:38:53):

I guess I don't know what T. Brown did with it or whatever, what he got. It wasn't our concern. We did what we had to do. Boom.

Mr. Higgins (02:38:58):

[inaudible 02:39:01].

Audio: Duane Davis (02:39:01):

Me and Lane drove back in the car, went on home.

Darren (02:39:03):

Immediately after that?

Audio: Duane Davis (02:39:04):

No, the next day, [inaudible 02:39:07].

Darren (02:39:07):

After y'all left the gun on the tire, where'd you guys go?

Audio: Duane Davis (02:39:11):

We smoked weed and drank.

Darren (02:39:12):

Where? At the hotel?

Audio: Duane Davis (02:39:12):

At the hotel.

Darren (02:39:15):

In the room?

Audio: Duane Davis (02:39:16):

Yeah. Y'all seen the surveillance thing?

Darren (02:39:17):

I don't know [inaudible 02:39:19].

Greg (02:39:19):

Okay, the carriage, you guys park it in that parking lot. Do you walk or does the van come by and you get in the van again?

Audio: Duane Davis (02:39:24):

No, we walk.

Greg (02:39:26):

Okay, you walked over to the Monte Carlo?

Audio: Duane Davis (02:39:31):

We walked right up the side of that Coca-Cola place. There's a little crosswalk that goes straight to the Monte Carlo.

Greg (02:39:36):

Okay, so you guys go back to your room.

Audio: Duane Davis (02:39:39):

And they pulled up in the ambulance while we was standing right there. You think I'm bullshitting?

Darren (02:39:46):

You guys on the street with...

Audio: Duane Davis (02:39:47):

We on Las Vegas Boulevard at the crosswalk, and they pull up at the ambulance right next to us.

Darren (02:39:50):

With him in the car already?

Greg (02:39:54):

Pac's in the car.

Audio: Duane Davis (02:39:57):

With Tupac and Suge in the car, this close.

Darren (02:39:58):

[inaudible 02:39:58]? Did they see you?

Mr. Higgins (02:39:59):

Suge sees us. He could see out the ambulance because he wasn't really hurt.

Audio: Duane Davis (02:40:03):

They can see. We-

Speaker 11 (02:40:00):

He couldn't see out [inaudible 02:40:01] because he wasn't really hurt.

Speaker X (02:40:01):

They don't care.

Audio: Duane Davis (02:40:01):

They couldn't see. We didn't give a fuck. We [inaudible 02:40:02].

Speaker X (02:40:01):

[inaudible 02:40:02].

Audio: Duane Davis (02:40:01):

The ambulance was parked right here, right next to us. That shit was funny as a motherfucker, fuck.

Greg (02:40:12):

So, you guys continue your party at the Monte Carlo, or you go someplace else that night? You go to a strip club or anything like that?

Audio: Duane Davis (02:40:16):

We was at the Monte Carlo.

Greg (02:40:16):

Okay. And you all four stayed together? You all four stayed together?

Dupree (02:40:21):

T. Brown and [inaudible 02:40:22].

Speaker X (02:40:22):

[inaudible 02:40:22] Dre...

Audio: Duane Davis (02:40:23):

All of us, yeah, we stayed together.

Greg (02:40:25):

Okay.

Dupree (02:40:25):

By that time, the band had come back around?

Audio: Duane Davis (02:40:27):

Yeah, they came back.

Dupree (02:40:28):

They came back? They met you at the hotel?

Audio: Duane Davis (02:40:30):

They didn't even know we did it.

Dupree (02:40:31):

You all didn't tell them nothing? You all just acted like nothing was going on?

Audio: Duane Davis (02:40:33):

Nothing was going on.

Higgins (02:40:36):

Let me say something real quick. It's weird. I know how the way Greg probably said it, it's like, you all just did this big thing, but to them, that dude's nothing. You all don't care about him.

Audio: Duane Davis (02:40:40):

Yeah. Yeah.

Higgins (02:40:40):

[inaudible 02:40:42].

Audio: Duane Davis (02:40:40):

[inaudible 02:40:44].

Higgins (02:40:44):

[inaudible 02:40:44] like it's a big thing or nothing. They like, he's nothing. He's dead.

Audio: Duane Davis (02:40:46):

Yeah. And when we got back, the war broke out, and it [inaudible 02:40:50]-

Greg (02:40:50):

[inaudible 02:40:50]. Yeah. We'll get to that. So you guys go back, you just party, drink, smoke. It's not really discussed. Nobody's making a big deal about it. Everyone goes back to their room to go to bed. You talk to the girls about it at all?

Higgins (02:41:06):

Did you tell anybody else?

Audio: Duane Davis (02:41:13):

I don't know, man. I don't get down like that, man. I ain't tell nobody shit. Like, I tell my nephews and them, stop saying that shit. Don't be on that internet and MySpace, man. Don't be saying that shit. They can come... Didn't they get that dude for making an error 30 years late?

Speaker X (02:41:23):

[inaudible 02:41:24].

Audio: Duane Davis (02:41:24):

Yeah, you know what I'm saying.

Higgins (02:41:35):

I think someone went to the bathroom.

Speaker 11 (02:41:35):

Oh, is that what it is?

Higgins (02:41:35):

Oh no, no, no, no.

Speaker X (02:41:35):

[inaudible 02:41:35]. Oh, no.

(02:41:35)
That's strong-arming it.

Dupree (02:41:35):

You guys do that, go back to the hotel. [inaudible 02:41:38] all of South Side. Who all was in the room afterwards? It's everybody? Corey, Kev?

Audio: Duane Davis (02:41:44):

Corey came later. He said, I heard Tupac is dead. I'm like, [inaudible 02:41:50].

Speaker 11 (02:41:45):

You all laughed. You all laughed?

Audio: Duane Davis (02:41:45):

Yeah.

Dupree (02:41:55):

So, he came in with the news. He bought the news that he had died. They thought he had died.

Audio: Duane Davis (02:42:05):

Right. Yeah, he said they both shot up.

Greg (02:42:05):

Okay. All right. So, that night goes by. The next morning, you guys go get up and you go back down to the Cadillac?

Audio: Duane Davis (02:42:08):

I didn't ever go back down to the Cadillac.

Greg (02:42:13):

You didn't?

Higgins (02:42:14):

Some other people went.

Greg (02:42:15):

Okay.

Audio: Duane Davis (02:42:16):

T. Brown, he had to go get the car.

Greg (02:42:17):

Okay. I thought you said you and Lane drove back.

Audio: Duane Davis (02:42:20):

Oh, we drove that Century back.

Greg (02:42:23):

Did you and him-

Audio: Duane Davis (02:42:23):

[inaudible 02:42:24].

Dupree (02:42:26):

Was his girl in there too?

Audio: Duane Davis (02:42:28):

I think she was, yeah.

Dupree (02:42:30):

Okay. So, four of you all.

Audio: Duane Davis (02:42:32):

Yeah.

Speaker 12 (02:42:33):

But during that night, after the shooting, was there any phone calls between you and Zip or you and anybody?

Audio: Duane Davis (02:42:41):

No, no.

Speaker 12 (02:42:42):

Nothing?

Audio: Duane Davis (02:42:43):

Yeah.

Speaker 12 (02:42:43):

It was dead that night. Nothing happened? No communication.

Audio: Duane Davis (02:42:51):

Yeah, the next day, we met at that restaurant on 3rd and La Brea. At that hot wings place.

Dupree (02:42:56):

So, you all remember the phone call?

Audio: Duane Davis (02:43:00):

Zip was like, did you [inaudible 02:43:00]?

Speaker X (02:43:00):

What else?

(02:43:00)
[inaudible 02:43:00].

Speaker 12 (02:43:00):

Yeah, yeah. All right, so you get up the next morning and what happened? You turn on the news, you see that he's dead?

Audio: Duane Davis (02:43:07):

We already knew.

Speaker 12 (02:43:08):

You already knew he was dead. Any phone calls? Did you call anybody? You call Zip? The next day, [inaudible 02:43:15].

Audio: Duane Davis (02:43:14):

The next day, he was like...

Speaker 12 (02:43:14):

Zip called you or you called Zip?

Audio: Duane Davis (02:43:14):

He called me. And he said, was that us? [inaudible 02:43:20] yeah. Then he called while we there. Was that us? Yeah.

Speaker 12 (02:43:25):

Wait, wait, wait. So, Zip called you and said, is that us?

Audio: Duane Davis (02:43:29):

Meet me at the hot wings place. I met him at the hot wings place. And...

Speaker 12 (02:43:35):

But wait.

Audio: Duane Davis (02:43:35):

[inaudible 02:43:35].

Speaker 12 (02:43:35):

But you said the hot wings place is here in LA?

Audio: Duane Davis (02:43:36):

Yeah.

Speaker 12 (02:43:36):

Okay. So, let's go back to Vegas.

Audio: Duane Davis (02:43:38):

Yeah.

Speaker 12 (02:43:38):

So, you're in Vegas, you wake up the next morning.

Audio: Duane Davis (02:43:41):

Yeah.

Speaker 12 (02:43:41):

All right. You turn on the news, you see he's dead, or you knew he's dead. You get a call from Zip, right?

Higgins (02:43:47):

In Vegas?

Speaker 12 (02:43:48):

Yeah, in Vegas, I'm talking about. Walk me through that morning. Who called you or what did you do that morning?

Higgins (02:43:54):

The next, morning did someone call me. Whoever is in Vegas, you know, from Vegas.

Speaker 12 (02:43:56):

Right.

Audio: Duane Davis (02:43:59):

Yeah, we left. We got on about 10 o'clock. Then I got a call once I got back to LA. And I [inaudible 02:44:05] say, come meet him at the hot wings place.

Speaker 12 (02:44:05):

Hot wing place.

Audio: Duane Davis (02:44:05):

He said, Puff, came on back [inaudible 02:44:10]. And he told him, yeah.

Speaker 12 (02:44:13):

Okay. So, let's go back to Vegas. What were you going to do about the car?

Audio: Duane Davis (02:44:15):

What was I going to do-

Speaker 12 (02:44:18):

Yeah. What were you going to do about the car? What did you know was going to be done about the car or the gun?

Audio: Duane Davis (02:44:22):

It wasn't my concern.

Speaker 12 (02:44:24):

You didn't care about it at all?

Audio: Duane Davis (02:44:25):

Yeah.

Speaker 12 (02:44:25):

Okay.

Audio: Duane Davis (02:44:28):

My mother-in-law had rented my car. I had to worry about her car. And he had to worry about his car and shit. And I swear, highway patrol was going to pull his ass over, man. Man, you all was [inaudible 02:44:41].

Dupree (02:44:41):

Do you know if he had the gun with him still? Because he had [inaudible 02:44:46].

Audio: Duane Davis (02:44:45):

I don't know. I know the highway patrol was on his ass for about at least 10, 15 miles. I know he was shitting bricks. You know what I'm saying? I'm like, damn.

Dupree (02:44:54):

And you never knew what happened to the gun?

Audio: Duane Davis (02:44:57):

I never did.

Dupree (02:44:57):

T. Brown never talked about, you know...

Audio: Duane Davis (02:44:57):

No, I never knew what happened.

Greg (02:45:03):

Okay. So, you get back to LA the next day, Zip calls you. Says, meet me at the hot wing place. We're at?

Speaker X (02:45:09):

[inaudible 02:45:09].

(02:45:09)
Melrose and [inaudible 02:45:10].

Audio: Duane Davis (02:45:10):

You know where Pete's is? Yeah.

Higgins (02:45:11):

Yeah. His place is upstairs, right?

Greg (02:45:13):

So, you guys go over there, Zip shows up, what happens after? What's the conversation with you and Zip?

Audio: Duane Davis (02:45:18):

He said Puff kept on calling. Was that us, is that us? And he told him, yeah, it was us. Faith called him. And said, we'll go get our little money. Said, all right, I'm going to go back out there.

Greg (02:45:32):

Okay. So Puff called Zip and said, was that us? Faith called Zip and said, was that us?

Speaker 12 (02:45:36):

Was you talking to Puff too?

Audio: Duane Davis (02:45:36):

Yeah.

Speaker X (02:45:36):

[inaudible 02:45:39].

Audio: Duane Davis (02:45:36):

Yeah.

Greg (02:45:41):

So, when you're talking to Zip, when you're at the hot wing place talking to Zip. Puff called.

Audio: Duane Davis (02:45:46):

Puff called us. He called us, yeah.

Greg (02:45:46):

On Zip's phone or your phone?

Audio: Duane Davis (02:45:47):

On Zip phone.

Greg (02:45:52):

And Zip gives you the phone?

Audio: Duane Davis (02:45:53):

Yeah.

Greg (02:45:53):

Okay.

Audio: Duane Davis (02:45:54):

[inaudible 02:45:54] say, was that us? And Zip was like, yeah, that's us.

Dupree (02:45:54):

So everybody was happy? [inaudible 02:45:59].

Audio: Duane Davis (02:45:59):

Yeah. We needed some money, man. Because you all raided our houses and took all our guns. You know what I'm saying?

Speaker 12 (02:46:11):

So then when you talk to Puff on the phone, does he ask you, was that us"

Audio: Duane Davis (02:46:14):

Yeah.

Speaker 12 (02:46:15):

And then you say, yeah, yeah, yeah.

Audio: Duane Davis (02:46:15):

Yeah, yeah, yeah.

Speaker 12 (02:46:18):

What's his response?

Audio: Duane Davis (02:46:19):

He was happy as hell, shit.

Dupree (02:46:21):

And did you ask him then about his money? About your money, I mean? When you were going to get paid or whatever?

Audio: Duane Davis (02:46:27):

No, no, no, no. I shouldn't say that on the phone. With Zip, go get our cash.

Dupree (02:46:27):

Okay.

Audio: Duane Davis (02:46:27):

Yeah.

Higgins (02:46:31):

Zip [inaudible 02:46:32] handles that part?

Audio: Duane Davis (02:46:32):

Yeah.

Greg (02:46:37):

Okay. So you tell Zip we need to get paid. What does Zip say? I'm going to go back home and handle it.

Audio: Duane Davis (02:46:42):

Yeah, I'll get back with you all in a minute. Yeah. I said they fucking raided at our house and took our guns and all that shit. So, yeah.

Greg (02:46:53):

Okay. And the raids occur...

Audio: Duane Davis (02:46:55):

Then I gave a beating. That was stupid as hell. For the South Side, we gave a beating and all them motherfuckers told everything.

Dupree (02:47:03):

Oh, that's when everybody in the whole hood started [inaudible 02:47:05] you guys [inaudible 02:47:05].

Audio: Duane Davis (02:47:05):

Yeah. Yeah, man. I shouldn't have did that. That was the fucked up-est move I ever made.

Dupree (02:47:10):

And was that after the gun were taken from the hood? Police was raiding the houses or was it before?

Audio: Duane Davis (02:47:17):

It was before our... I don't remember. I know we gave a meeting at the Park and Cerritos. Them bitches went and told everything, man.

Dupree (02:47:25):

And everybody, both clicked. I mean, was it Temple and whatever?

Audio: Duane Davis (02:47:29):

All of us clicked. Yeah. We came back together. Yeah.

Dupree (02:47:36):

Oh. Yeah, Park and Cerritos, what's the name of that park?

Audio: Duane Davis (02:47:37):

Regional Park on Bilbao. It was all in that first affidavit anyway. We read all that shit.

Dupree (02:47:43):

Okay.

Greg (02:47:43):

So you called the meeting though?

Audio: Duane Davis (02:47:52):

Yeah.

Greg (02:47:52):

Okay.

Audio: Duane Davis (02:47:52):

We read that whole affidavit. You know what I'm saying? We know what's up.

Greg (02:47:53):

So you called the meeting to discuss the incident?

Audio: Duane Davis (02:47:57):

Yeah.

Greg (02:47:57):

Okay. And then [inaudible 02:47:58].

Audio: Duane Davis (02:47:57):

And everybody like, we heard you got your billion dollars, man. We going to kick in. If you don't get your punk out our face, bitch. You know.

Greg (02:48:08):

Right.

Audio: Duane Davis (02:48:08):

[inaudible 02:48:09].

Greg (02:48:08):

All right. So the meeting takes place. People are complaining they want the money. At some point, do you reach out again for Zip or how do you try to get paid?

Audio: Duane Davis (02:48:21):

I kept calling his ass. The next time we seen him was... Where was his ass at?

Greg (02:48:29):

Was he avoiding you?

Audio: Duane Davis (02:48:30):

Yeah. We met him at Roxbury.

Greg (02:48:39):

On purpose, you ran into him or you guys had a meet? You called [inaudible 02:48:43].

Audio: Duane Davis (02:48:42):

We had a meeting.

Greg (02:48:43):

Who set that up?

Audio: Duane Davis (02:48:45):

I did.

Greg (02:48:46):

So you called Zip, you finally got ahold of him and you tell [inaudible 02:48:49].

Audio: Duane Davis (02:48:48):

He telling I'm back out of here, meet me at Roxbury. That club on Sunset.

Dupree (02:48:54):

Yeah.

Audio: Duane Davis (02:48:56):

Ladies shooting pool and them Don Woolriders ready to beat they ass.

Dupree (02:49:03):

Who's they? Zip and who else?

Audio: Duane Davis (02:49:04):

Zip, D-Mac. Who was that? Fleetwood.

Dupree (02:49:05):

Flint's dude, Flintwood?

Audio: Duane Davis (02:49:05):

Yeah.

Dupree (02:49:05):

Dude that hangs with Flint?

Audio: Duane Davis (02:49:05):

Yeah.

Dupree (02:49:05):

Was Flint out by then?

Audio: Duane Davis (02:49:05):

No. No.

Dupree (02:49:05):

Okay. Then you all meet and then what?

Audio: Duane Davis (02:49:07):

We meet.

Dupree (02:49:26):

No, when you had the meeting with D-Mac and was Fleetwood all of them there with you guys?

Audio: Duane Davis (02:49:38):

No, it was just me and him. I was talking [inaudible 02:49:32]. You know, he didn't give it to me yet. And D-Mac told me that shit. He said, man, Zip got that money. He like...

Dupree (02:49:44):

[inaudible 02:49:45] though. Because he though he was still trying to get the money, right?

Audio: Duane Davis (02:49:46):

Yeah. Yeah. I'm talking about he told me this past summer. And once they fell up on all that shit. [inaudible 02:49:56].

Greg (02:49:58):

When you guys met at the Roxbury... When you guys met at the Roxbury, how much time passes before you... Before. I'm sorry.

Audio: Duane Davis (02:50:05):

After that [inaudible 02:50:06].

Greg (02:50:05):

No, no, no. After the shooting in Las Vegas, how long is it before you guys meet at the Roxbury? Like months?

Audio: Duane Davis (02:50:15):

About a month, month and a half.

Greg (02:50:26):

And so he tells you that Puffy hasn't paid him yet, right?

Audio: Duane Davis (02:50:31):

Yeah.

Greg (02:50:34):

All right. And what do you tell him? That [inaudible 02:50:38].

Audio: Duane Davis (02:50:37):

What's up?

Greg (02:50:39):

What's up? I need the money.

Audio: Duane Davis (02:50:39):

Yeah. We need money motherfucker. They took our guns, all that shit. We need some money.

Dupree (02:50:44):

And you want [inaudible 02:50:45].

Audio: Duane Davis (02:50:44):

This motherfucker got millions and more than... You know.

Dupree (02:50:44):

And your business shut down, you wasn't doing no business, nothing.

Audio: Duane Davis (02:50:45):

You all ran my Columbian out of town, man. I mean, we did. We should have did that. We shouldn't even have met Puffy. We should have just stayed rolling, man, you know. You all was on my since 93 though.

Greg (02:50:58):

You gave us a good run.

Audio: Duane Davis (02:51:08):

Yeah. Yeah.

Greg (02:51:09):

Okay. So at what point do you lose touch with Zip when you just realize you're not going to get paid? At some point you realize-

Audio: Duane Davis (02:51:18):

Once you all got on our ass, man. That [inaudible 02:51:21] shit. You all was on our ass, man.

Greg (02:51:24):

Okay. So 96 comes and goes, 97, then you pick up that case.

Audio: Duane Davis (02:51:40):

97. [inaudible 02:51:41]. After that shit happened, we couldn't breathe. You know that. You all put the [inaudible 02:51:41] on our ass like a motherfucker.

Greg (02:51:40):

Okay. And then so you end up going to prison?

Audio: Duane Davis (02:51:44):

Yeah.

Greg (02:51:45):

Since you've been out of prison, have you talked to Zip?

Audio: Duane Davis (02:51:48):

Not one time.

Greg (02:51:49):

And what about Puffy?

Audio: Duane Davis (02:51:49):

Not one time.

Greg (02:51:54):

Okay.

Audio: Duane Davis (02:51:55):

I tried to call him several times though. That little Daddy Al shit.

Higgins (02:51:59):

You left messages?

Audio: Duane Davis (02:51:59):

Hell yeah.

Higgins (02:52:02):

And they didn't call back.

Audio: Duane Davis (02:52:03):

I think really just gave us half the money, you know what I'm saying? I would've stayed strong, like, fuck it.

Greg (02:52:09):

Okay. So a couple of months ago you say you ran into D-Mac and D-Mac's [inaudible 02:52:15].

Audio: Duane Davis (02:52:15):

I'm like, man, call your boy. Call your boy. Because they went to Howard together or something. I'm like, man, call your boy. He like, man, what's that? You still mad? It was Zip behind that shit. Zip got that money. I'm like, what? He like, yeah, man. Dude gave Zip the money.

Greg (02:52:30):

Where'd you run into D-Mac at?

Audio: Duane Davis (02:52:32):

What street is that? By your boy. The tall guy with the Cadillac truck. What street is that off of?

Speaker 12 (02:52:38):

Florence.

Higgins (02:52:38):

[inaudible 02:52:40] Cadillac truck.

Audio: Duane Davis (02:52:38):

The blue Cadillac truck, man.

Speaker 12 (02:52:38):

Oh. I'm at a loss.

Audio: Duane Davis (02:52:39):

The 900 pounds.

Dupree (02:52:51):

I don't know. I don't know.

Audio: Duane Davis (02:52:52):

Oh.

Dupree (02:52:53):

We got a lot on our mind just like you, man.

Audio: Duane Davis (02:52:54):

No, off of Topanga. I met him off of Topanga at the 76th station.

Speaker X (02:52:54):

Oh.

Audio: Duane Davis (02:52:54):

Yeah. Cadillac truck.

Speaker X (02:52:54):

[inaudible 02:53:02] anything? [inaudible 02:53:03].

Greg (02:52:54):

Oh, yeah. No.

Audio: Duane Davis (02:53:09):

You know what the guy I'm talking about. Dude, Detroit Pistons. Tall.

Dupree (02:53:12):

[inaudible 02:53:12].

Speaker X (02:53:12):

[inaudible 02:53:12].

Audio: Duane Davis (02:53:12):

You motherfucker.

Greg (02:53:15):

Oh, out there in the valley. That's who [inaudible 02:53:16].

Audio: Duane Davis (02:53:15):

Yeah, yeah. Yeah.

Speaker X (02:53:15):

[inaudible 02:53:18].

Audio: Duane Davis (02:53:18):

Let me tell you what he did to me. I'm going to tell you all another thing and I'll do something. Should I tell you all?

Speaker X (02:53:22):

All right.

Audio: Duane Davis (02:53:23):

On the 40 some thousand, this motherfucker threw money the back thing. The motherfucker say, hey, hey, let me talk to you dog. I went over here and talked to him and here you all come. I said, this motherfucker. I'm going to pawn all that, dog. I said, this motherfucker got my money cracked. That's all I was thinking about it. He said, man, let me talk to you. Greg (02:54:47):

Audio: Duane Davis (02:54:53):

Yeah. [inaudible 02:54:55] summer time.

Speaker 11 (02:54:55):

You talking about this year?

Audio: Duane Davis (02:54:55):

Yeah.

Greg (02:54:59):

And you tell him, hey, call your boy. Call Puffy.

Audio: Duane Davis (02:55:01):

Yeah.

Greg (02:55:02):

And he tells you.

Audio: Duane Davis (02:55:05):

Zip got paid. Then he [inaudible 02:55:07]. Oh, shit. Plus, Biggie got killed. I said, shit. I better not see his ass.

Greg (02:55:14):

Okay. They fell out. Behind what?

Audio: Duane Davis (02:55:19):

Behind the money. Behind Biggie. Biggie got killed six months later. I thought you all [inaudible 02:55:25].

Greg (02:55:27):

I'm missing something. Puffy and Zip fall out, right?

Audio: Duane Davis (02:55:33):

Behind him making the payments to Zip.

Dupree (02:55:36):

Zip keeping the money.

Audio: Duane Davis (02:55:37):

Zip kept the money from us dog.

Dupree (02:55:39):

And he didn't give it to them and then Big got killed obviously.

Audio: Duane Davis (02:55:40):

Yeah, all that. [inaudible 02:55:43] you all supposed to have had our back.

Greg (02:55:46):

How do you suppose Puffy found out that Zip didn't pay you guys? How does Puffy know?

Audio: Duane Davis (02:55:52):

I guess he knew. Wynn, I guess. Wynn seen him a couple of times.

Greg (02:56:03):

Zip?

Audio: Duane Davis (02:56:04):

Oh no, he seen the boy. Puff. At one of the Snoop parties out there.

Greg (02:56:14):

In New York?

Audio: Duane Davis (02:56:16):

No, it was at Snoop house.

Greg (02:56:18):

Oh, in Long Beach?

Audio: Duane Davis (02:56:18):

Claremont.

Greg (02:56:18):

Claremont.

Speaker X (02:56:18):

Claremont.

Dupree (02:56:18):

At his house house.

Audio: Duane Davis (02:56:27):

Yeah. They all want pictures and everything. He came I said, man, you didn't call me. No dog, [inaudible 02:56:30]. This motherfucker. I said, you get the number. You got the number. We call the motherfucker... You know what I'm saying? If I was to see his ass, man, give me the jewelry and everything. Stupid motherfucker.

Greg (02:56:44):

Okay. So Zip doesn't pay you. Puffy's pissed off because Puffy did make the payment. Do you have any idea what amount of money Puffy paid?

Audio: Duane Davis (02:56:52):

D-Mac didn't say it.

Greg (02:56:53):

Okay. So D-Mac tells you they fell out beyond that whole thing. You think that Wynn had probably talked to Puffy about the money at one of these Snoop Dogg parties?

Audio: Duane Davis (02:57:05):

[inaudible 02:57:04] he didn't. He just gave him the number. I heard [inaudible 02:57:08] you all. Here go the number. We called him up [inaudible 02:57:11] phone [inaudible 02:57:12].

Greg (02:57:12):

Puffy gave Wynn his number?

Audio: Duane Davis (02:57:14):

Yeah. I said, you let him give you a number? That was so stupid. Why didn't get the jewelry? [inaudible 02:57:25]. You know what I'm saying?

Greg (02:57:27):

Collateral.

Audio: Duane Davis (02:57:27):

Yeah.

Greg (02:57:27):

Okay.

Higgins (02:57:27):

But he left a message when he had the number?

Audio: Duane Davis (02:57:28):

What?

Higgins (02:57:28):

You called and left a message?

Audio: Duane Davis (02:57:34):

Yeah, he didn't ask me. The man got about 50 phones. He can throw that shit away. You know phones are easy, man.

Greg (02:57:36):

All right. And what about you? You also said that Cain told you something about Zip.

Audio: Duane Davis (02:57:42):

Yeah, he said Zip got the money and they fell out.

Greg (02:57:44):

When was that? When did Cain tell you that?

Audio: Duane Davis (02:57:48):

When did I get out on that violation? That was 2005. Cain's name is Gregory?

Greg (02:57:49):

Yeah.

Audio: Duane Davis (02:58:00):

How about Pete? How much time the gave Pete?

Greg (02:58:02):

Pedro Hill?

Audio: Duane Davis (02:58:04):

Yeah.

Greg (02:58:05):

Shit, I think he got five, six years, didn't he?

Audio: Duane Davis (02:58:11):

Goddamn bro. Boy, this is a cold dude. Man, the game ain't right. I'd advise everybody to quit, dude.

Greg (02:58:19):

Where were you when Cain told you? Is this when you were back in Richmond or?

Audio: Duane Davis (02:58:23):

Kev's house.

Greg (02:58:23):

Oh, [inaudible 02:58:23].

Audio: Duane Davis (02:58:23):

I only went out there one time and he said I stole $10,000. I said, bitch, I stole $10,000.

Greg (02:58:29):

No, that's your brother saying that. That's not [inaudible 02:58:32]. Yeah.

Speaker X (02:58:31):

Kevin.

Audio: Duane Davis (02:58:33):

That stupid ass motherfucker. He don't know I'm saving his life. $10,000.

Greg (02:58:33):

Okay, so...

Audio: Duane Davis (02:58:41):

Oh, you know about that too?

Greg (02:58:42):

Yeah. Okay. So Cain tells you... You're over at Kev's house 2005. Cain tells you, man, Zip got that money. How does Cain know Zip?

Audio: Duane Davis (02:58:50):

Just from out there in New York.

Greg (02:58:54):

Just the New York connection?

Audio: Duane Davis (02:58:57):

Yeah. Everybody knows Zip. Zip's big than a motherfucker out there, man.

Greg (02:59:01):

Yeah. Now you know Cain's on the run, right?

Audio: Duane Davis (02:59:03):

He on the run?

Greg (02:59:03):

Yeah.

Audio: Duane Davis (02:59:03):

[inaudible 02:59:05].

Greg (02:59:05):

Do you have any contact with him at all?

Audio: Duane Davis (02:59:08):

I though his ass was snitching because he got caught with 12 keys.

Greg (02:59:12):

Yeah. He boned out on that shit.

Audio: Duane Davis (02:59:14):

He did?

Greg (02:59:14):

Yeah.

Audio: Duane Davis (02:59:16):

I ain't got no [inaudible 02:59:17]. He be up in Baltimore.

Greg (02:59:20):

Okay.

Audio: Duane Davis (02:59:20):

By that school.

Greg (02:59:23):

By the way, do you know if Gregory Brooks, if his people back in Baltimore are the Brooks brothers that were in the newspaper like a couple of years ago behind that big bust?

Audio: Duane Davis (02:59:35):

No.

Greg (02:59:36):

You don't know if that's his brothers?

Audio: Duane Davis (02:59:40):

No. Gregory, that's my cousin.

Greg (02:59:41):

Okay. Yeah. I know he was sending stuff to Baltimore. But wasn't he... The Brooks brothers from Baltimore, you don't know who they are?

Audio: Duane Davis (02:59:45):

No, they ain't no kin of me.

Greg (02:59:46):

Okay

Audio: Duane Davis (02:59:48):

His brother is named Garfield. [inaudible 02:59:50]. Phone coming in. Gregory quit. Gregory, Craig, all of them. All my older brothers and shit quit, that shit.

Speaker X (02:59:57):

[inaudible 02:59:58].

Audio: Duane Davis (02:59:58):

Yeah, yeah.

Dupree (02:59:59):

But Greg's sons, both of them in jail. One of them in jail, aren't they?

Audio: Duane Davis (03:00:03):

Yeah. [inaudible 03:00:04].

Dupree (03:00:04):

Banging and stuff.

Audio: Duane Davis (03:00:05):

You all is up our ass.

Dupree (03:00:09):

Yeah, man. Lil Lane better watch out. Craig's brother. He out there. Why you ain't going to stop him from doing what he doing. He out there banging and stuff, ain't he?

Audio: Duane Davis (03:00:15):

Who?

Dupree (03:00:18):

Craig's little brother. They call him Little Lane or whatever. I mean, Craig's son.

Audio: Duane Davis (03:00:22):

They call him Little Lane?

Dupree (03:00:24):

Something like that.

Audio: Duane Davis (03:00:24):

No, they don't.

Dupree (03:00:24):

Mando or something. I don't know. Something like that.

Audio: Duane Davis (03:00:24):

Baby Lando?

Dupree (03:00:29):

Yeah.

Greg (03:00:31):

I think one of the last things is, what makes you think though that now that you'd be able to talk to, like, Zip or somebody in person?

Audio: Duane Davis (03:00:41):

PPD [inaudible 03:00:42].

Greg (03:00:41):

I know [inaudible 03:00:44].

Speaker X (03:00:41):

[inaudible 03:00:44].

Greg (03:00:44):

I know your PPD, but listen, they had a fall... Look, seriously though. I mean this is...

Audio: Duane Davis (03:00:48):

Man, I would go ask Puffy. Man, I would...

Speaker X (03:00:48):

[inaudible 03:00:53].

(03:00:48)
[inaudible 03:00:56].

Greg (03:00:56):

Puffy's Puffy. You're PPD. Puffy's Puffy. Okay. And now he knows that he can't afford to be making any mistakes right now about the ghosts that are in his closet. And all of a sudden PPD comes up out of nowhere and starts wanting to talk about the murder of Tupac.

Higgins (03:01:12):

He couldn't really come like that. [inaudible 03:01:14].

Audio: Duane Davis (03:01:15):

Oh, I know Puffy pussy. Give me my money, man. [inaudible 03:01:17] my money.

Higgins (03:01:17):

From my standpoint, he wouldn't just come up to him like that. He'd have to create a scenario where he'd feel comfortable.

Greg (03:01:23):

Then let's talk about creating a scenario.

Higgins (03:01:26):

Like, I'll give an example of what I would think. Maybe like...

Audio: Duane Davis (03:01:29):

You all find out where he [inaudible 03:01:30].

Higgins (03:01:30):

No, no, no. This is me. He wouldn't just have him just pop up on a dude.

Audio: Duane Davis (03:01:33):

No.

Higgins (03:01:34):

You create a situation maybe like where Keeffe was in town, he was doing well, maybe Keeffe had a business that he was putting together. A clothing business or something like that. He'd come at him like that and then they would kick it and then the conversation would come up. I mean, you wouldn't just have him just walk up on him like that.

Greg (03:01:52):

Right. We don't know how to create that [inaudible 03:01:53]. That's why we need your guys [inaudible 03:01:54].

Higgins (03:01:54):

Because I mean Puffy-

Audio: Duane Davis (03:01:54):

You want my input.

Higgins (03:01:54):

Just to give him an example. [inaudible 03:01:54].

Greg (03:01:54):

Exactly. That's exactly what I want. Because you're [inaudible 03:01:54].

Speaker X (03:01:54):

[inaudible 03:01:54].

Audio: Duane Davis (03:01:54):

[inaudible 03:01:54] looking for him. No. I've been looking for his ass.

Dupree (03:01:54):

You know that too, right?

Audio: Duane Davis (03:02:08):

Yeah. When I run into him at a club. Man, when he got that walk of fame, motherfucker. I was right there. But what I'm saying is [inaudible 03:02:14].

Speaker X (03:02:13):

[inaudible 03:02:14].

Audio: Duane Davis (03:02:14):

But what I'm saying is it was too many of you all around.

Higgins (03:02:20):

He not going to just give you a straight conversation. He's not going to feel comfortable. You got to create something that's comfortable for him. I mean, I know how you thinking, but it's been a while. He's sophisticated. He's scared. I'm just saying maybe you have to create some type of... They know they don't want to mess with you. They don't want you coming at them wrong.

Audio: Duane Davis (03:02:30):

He embracing Wynn. You know what I'm saying? [inaudible 03:02:36] my boy... You know what I'm saying.

Speaker 11 (03:02:30):

He cool with Wynn like that?

Audio: Duane Davis (03:02:30):

Yeah, he go and embrace the shit out of him...

Higgins (03:04:50):

Yeah, he could be in a restaurant or something. You could come in there.

Audio: Duane Davis (03:04:51):

And I'll be seeing his little commercial. Like, you motherfucker. You know what I'm saying?

Higgins (03:04:55):

I'm king of the world.

Audio: Duane Davis (03:04:55):

No, he got me in trouble the first time. Didn't he though? Biggie said...

Higgins (03:05:02):

So you don't have to go to New York. You could do it here.

Audio: Duane Davis (03:05:03):

Yeah.

Greg (03:05:04):

We're talking two different things. New York would be Zip.

Audio: Duane Davis (03:05:09):

Yeah.

Greg (03:05:09):

Zip's out there and he's going to be staying out there.

Audio: Duane Davis (03:05:09):

Yeah.

Greg (03:05:10):

I mean, he's got a club out there. He's always...

Audio: Duane Davis (03:05:12):

Oh, I could go there. Every time my folks go out there... Like Brian, he's vice president right up under Jermaine Dupree. He went out there, him and the dude named Ramon. They went out there. You all PPD boys. Oh, come on. He rolled out the red carpet for them. Got them drinks and everything. They the ones who told me about the club. Then his other broad I was fucking, she said, he got a three-story beauty salon. I was like, them motherfuckers is rolling. Said he got the fan [inaudible 03:05:48] a Bentley and all that. So he rolling like hell.

Greg (03:05:51):

You see [inaudible 03:05:52] to maybe starting off with just having another encounter with D-Mac?

Audio: Duane Davis (03:05:58):

Yeah.

Greg (03:05:59):

Start off with that and then D-Mac can put it in Puffy's ear that you kind of...

Audio: Duane Davis (03:06:03):

I'm looking for him. All right. I'll get on it real fast.

Greg (03:06:08):

No, we'll handle that. We'll set that up.

Audio: Duane Davis (03:06:09):

Okay.

Greg (03:06:11):

Okay. What ends up happening is if you take control of the situation, you start making some progress, we're not ready to deal with yet. Then, you know [inaudible 03:06:19]. You don't have to do anything. It's just-

Audio: Duane Davis (03:06:20):

Basically just take your time.

Greg (03:06:20):

Yeah. Take the time.

Speaker X (03:06:22):

Just take your time.

Greg (03:06:22):

We'll tell you when you need to be somewhere and make arrangements.

Audio: Duane Davis (03:06:27):

All right. All right.

Greg (03:06:27):

And...

Audio: Duane Davis (03:06:28):

That'll put it in his ear because he do go get D-Mac every time he come out here.

Greg (03:06:30):

Okay.

Audio: Duane Davis (03:06:30):

That's his boy, yeah.

Greg (03:06:34):

Okay. All right. Well then onto, I think that's a wrap for that whole entire event. These are two of the girls that Darren found.

Higgins (03:06:41):

Can I ask a question real quick?

Greg (03:06:42):

Yeah.

Higgins (03:06:43):

How long is our meeting going to be today? Do we have a timeframe?

Greg (03:06:45):

We're out of here in 15 minutes.

Higgins (03:06:46):

Oh, okay.

Speaker 12 (03:06:47):

Hey, do you know how to get ahold of D-Mac right now?

Higgins (03:06:49):

You're more than welcome.

Speaker 12 (03:06:50):

You can get ahold of D-Mac [inaudible 03:06:54] if you want.

Speaker X (03:06:57):

No sweat.

Greg (03:06:57):

[inaudible 03:06:58].

Audio: Duane Davis (03:06:57):

The basketball players are buying weed from him every day.

Greg (03:06:57):

All right. [inaudible 03:06:58].

Audio: Duane Davis (03:06:57):

[inaudible 03:06:58] buy some weed from him.

Speaker X (03:06:57):

Do you know [inaudible 03:06:59].

Dupree (03:06:59):

[inaudible 03:06:59] on third or Beverley. [inaudible 03:07:04] barbershop.

Greg (03:07:05):

Oh, I've got that D-Mac [inaudible 03:07:07].

Speaker X (03:07:06):

[inaudible 03:07:07].

Greg (03:07:09):

I've got that [inaudible 03:07:09].

Speaker X (03:07:09):

Do you know [inaudible 03:07:09]?

Greg (03:07:09):

Yeah, I know where he's at and where he's going.

Speaker X (03:07:09):

Look at that, she got fat.

Audio: Duane Davis (03:07:09):

Yeah, that's the broad.

Dupree (03:07:09):

What about this one here?

Audio: Duane Davis (03:07:12):

Yeah, you can get the... That's [inaudible 03:07:14].

Dupree (03:07:13):

That's the ones that was on the phone?

Speaker X (03:07:13):

[inaudible 03:07:16]..

Speaker 11 (03:07:16):

Okay. Are those the two girls that were in the vibe party that night?

Speaker X (03:07:18):

In the club.

Audio: Duane Davis (03:07:18):

Yeah.

Speaker 11 (03:07:21):

Okay. And what are their names.

Speaker X (03:07:23):

Right here.

Audio: Duane Davis (03:07:23):

[inaudible 03:07:23], DJ [inaudible 03:07:24] I'm serious. He gave that shit up quick.

Speaker X (03:07:26):

Answer the question.

Audio: Duane Davis (03:07:27):

Yeah.

Speaker X (03:07:27):

[inaudible 03:07:28].

Speaker 11 (03:07:28):

Those two girls, that you see there-

Dupree (03:07:33):

What's their names?

Speaker 11 (03:07:33):

What are their names?

Audio: Duane Davis (03:07:33):

[inaudible 03:07:34].

Speaker 11 (03:07:33):

And the others were the two girls that you talked about being in the vibe party that night.

Audio: Duane Davis (03:07:37):

At the party. Yeah.

Speaker 11 (03:07:38):

And getting close to Puffy and Biggie.

Audio: Duane Davis (03:07:43):

Yeah, all of that. Yeah. They was the ones that set that shit up.

Dupree (03:07:45):

For sure. Now you know that from being there or you know that from [inaudible 03:07:48]?

Audio: Duane Davis (03:07:47):

Being there dog

Dupree (03:07:47):

Okay.

Audio: Duane Davis (03:07:47):

I'm telling you dog. I'm...

Dupree (03:07:51):

Did you get any other insight on that from anybody else? Or, you know. You PPD, people [inaudible 03:07:56].

Audio: Duane Davis (03:07:56):

We know the streets dog.

Dupree (03:07:57):

So you're just saying from that alone?

Speaker X (03:07:59):

He said [inaudible 03:08:00].

Audio: Duane Davis (03:08:01):

They was out of place. They shouldn't have been there in the first place.

Dupree (03:08:03):

They from Death Row. They [inaudible 03:08:07].

Audio: Duane Davis (03:08:09):

[inaudible 03:08:07]. Then boom, the fire marshals come. We left Big Pete and what's the name out there? Sporty. Outside the club. Because we didn't have enough passes. I was going out there checking on them.

Greg (03:08:17):

Don't put that on these notes because...

Speaker X (03:08:19):

[inaudible 03:08:21].

Dupree (03:08:20):

That's just a sidebar.

Greg (03:08:22):

Keep these [inaudible 03:08:23] or something.

Audio: Duane Davis (03:08:30):

The fire marshals was down there. And Big Pete [inaudible 03:08:31] was down there. And I went down there to check on them. Then the fire marshal said they was going to close the place. Bloods was out there. They was ready, dog. [inaudible 03:08:41].

Dupree (03:08:41):

We're going to get into all that another time, man. But that's some stuff we got to touch on too.

Audio: Duane Davis (03:08:43):

Yeah.

Speaker X (03:08:43):

[inaudible 03:08:46].

Speaker 11 (03:08:43):

All right, get your frequent flyer miles ready, man. [inaudible 03:08:53].

Higgins (03:08:43):

What's that [inaudible 03:08:53]. I'm going to see you sooner later. [inaudible 03:08:58]. I'm going to see you sooner or later, man. [inaudible 03:09:03].

Greg (03:08:43):

You and Eddie were cellies, right?

Audio: Duane Davis (03:08:43):

Yeah, we [inaudible 03:09:06].

Greg (03:08:43):

Where were you guys... That was in...

Audio: Duane Davis (03:08:43):

[inaudible 03:09:09].

Greg (03:08:43):

Okay.

Speaker X (03:08:43):

[inaudible 03:09:16].

Audio: Duane Davis (03:08:43):

I wanted to ask you something. Excuse me.

Greg (03:08:43):

What do you know his last name to be?

Audio: Duane Davis (03:08:43):

Samuel, Samuels. Samuel Samuels.

Greg (03:08:43):

Samuels?

Audio: Duane Davis (03:08:43):

Samuel Samuels.

Greg (03:08:43):

[Inaudible 03:09:28].

Higgins (03:08:43):

He has some questions [inaudible 03:09:32].

Audio: Duane Davis (03:08:43):

I want to ask one more thing. One more thing. I know you probably know [inaudible 03:09:38] case in 93.

Speaker X (03:08:43):

[inaudible 03:09:40].

Audio: Duane Davis (03:08:43):

Okay. [inaudible 03:09:44]. 93.

Speaker X (03:08:43):

[inaudible 03:09:49].

Judge (03:10:10):

Okay. It appears as Exhibit 117 is now over. Anything else that you wanted to present today, State?

Speaker 13 (03:10:15):
